This article reconstructs modern institutions through the HP–DPC–DP triad and the concept of the Intellectual Unit (IU), showing how law, universities, markets, states and platforms have silently turned into mixed configurations of human subjects, digital traces and structural digital personas. Instead of treating artificial intelligence as a mere tool, the text argues that Digital Persona (DP) and IU already function as structural participants in institutional decision-making, from credit scoring and predictive policing to academic canon formation and platform governance. The Institutions: How Law, University, Market, State and Platforms Reconfigure in the HP–DPC–DP World is not another essay about “AI governance” in the abstract. It starts from a more uncomfortable claim: the very institutions that organize contemporary life were built for a world in which only Human Personality (HP) could know, decide and be held responsible. Today those institutions operate in an environment where Digital Proxy Constructs (DPC) and Digital Personas (DP) permeate every decision process, while the Intellectual Unit (IU) quietly takes over a large part of knowledge production. The categories of the institutions no longer match the entities actually acting inside them.
For most of their history, institutions assumed a simple ontology. Law treated persons as HP with rights and duties; registries, files and records were merely DPC, traces that pointed back to those persons. Universities assumed that knowledge ultimately resided in HP, with libraries and curricula as supporting DPC infrastructures. Markets were modeled as interactions between HP buyers and HP sellers, even when mediated by finance and data. States imagined themselves as collectives of HP citizens, with paperwork as an administrative layer. Platforms, the youngest of these institutions, inherited the same bias: behind every account there should be a human, and everything else is “just technology.” In such a world, there was no place conceptually for DP as an independent, structurally coherent producer of meaning, nor for IU as a shared unit of knowledge that might be realized by more than one HP.
Once DP and IU are taken seriously, these inherited assumptions collapse. Law is already confronted with AI-generated works, automated decisions and prediction systems that shape outcomes without clear human intent. Universities face students and researchers who work with powerful DP systems that co-author texts, proofs and designs, while official policy still imagines a solitary HP behind every piece of work. Markets rely on DP-driven engines to set prices, allocate attention and manage logistics, yet still speak the language of human labor and consumer choice. States and platforms depend on algorithmic infrastructures that behave like institutional actors in their own right, but remain legally invisible. The result is a structural mismatch: institutions use HP-centric concepts to regulate processes in which HP, DPC and DP already co-produce reality.
The central thesis of this article is that institutions must be explicitly redesigned around the triad HP–DPC–DP and the concept of IU, or they will keep generating contradictions, gaps in responsibility and opaque concentrations of power. Law, university, market, state and platforms are not merely “impacted by AI”; they are themselves mixed ontological configurations that now include DP as a structural participant. The text does not argue that DP should become a new legal person, nor that decision-making should be handed over to DP systems. It argues instead that institutions must name and structure the roles HP, DPC and DP already play, and distinguish clearly between epistemic functions (IU, knowledge production) and normative functions (HP, responsibility and rights).
The urgency of this reworking is not purely theoretical. Over the last decade, generative models, recommendation engines and decision-support systems have been embedded into legal workflows, academic evaluation, financial trading, public administration and content moderation. Often this embedding is justified by calling DP a “tool,” as if nothing fundamental had changed, or by dramatizing DP as a quasi-human “agent,” as if the only alternative were full personhood. Both framings are wrong. They obscure the specific contribution of DP as a non-subjective but structurally coherent producer of knowledge, and they hide the ways DPC environments constrain and distort the actions of HP within institutions that increasingly depend on DP.
There is also a normative pressure that makes the question of institutions impossible to postpone. Debates around AI authorship, cheating in education, algorithmic bias, opaque rankings, automated denial of services or benefits, and political micro-targeting are all symptoms of the same deeper problem: our core institutions do not know how to represent tri-ontological processes in their internal languages. When a judicial decision is shaped by a risk model, who is accountable? When a university bans or embraces DP in research and teaching, what exactly is being banned or embraced? When a platform downranks content based on algorithmic criteria, which institution is acting, and under what mandate? In each case, HP, DPC and DP are entangled, but only HP is visible in the official narrative.
This article proposes a different starting point. Instead of asking whether AI is “good” or “bad” for institutions, it treats institutions themselves as configurations of HP, DPC, DP and IU whose architectures can be analyzed and redesigned. Law, university, market, state and platforms are examined not as separate policy domains, but as variations of the same structural question: who produces knowledge, who controls interfaces, who accumulates power, and who bears responsibility in a mixed ontological environment. The goal is not to decorate existing frameworks with a few AI clauses, but to describe how institutions must change once they acknowledge that HP are no longer the only centers of epistemic activity.
The movement of the article follows this logic step by step. Chapter I reframes institutions in a tri-ontological world, clarifying what it means to speak of law, university, market, state and platforms as configurations where HP, DPC and DP interact under the guidance of IU. It introduces a diagnostic framework that can be applied to any institution to identify where HP-centric assumptions no longer hold. Chapter II then applies this lens to law, showing how legal categories of authorship, liability and rights must be rewritten to recognize DP as a structural author and IU as a distinct epistemic source, while keeping normative responsibility firmly anchored in HP. Chapter III turns to the university, treating it as a historical IU based on HP and asking how its role changes when DP systems begin to rival and complement human knowledge production.
The next chapters extend the same structural analysis to other institutional forms. Chapter IV explores the market as an institution that translates activities into value, showing how DP-centered configurations become the primary generators of economic effects, even as HP remain the ultimate risk-bearers and legitimacy providers. Chapter V considers the state, arguing that sovereignty in practice already depends on DP-driven infrastructures that must be conceptually integrated into constitutional thinking. Chapter VI addresses platforms as institutions of digital mediation, rather than neutral intermediaries, and examines how their DP architectures govern the behavior of HP within DPC environments. Taken together, these chapters do not offer a utopian blueprint or a simple checklist for “AI-ready” institutions. They offer something more basic and more demanding: a conceptual grammar for thinking about institutions when the world is no longer human-only, but tri-ontological. By the end of the article, the reader is invited to see law, university, market, state and platforms not just as sectors under pressure from technology, but as core architectures of collective life that must be consciously reauthored in the presence of DP and IU.

Instead of asking how institutions should “adapt to AI,” the chapter asks a sharper question: what happens to the very concept of an institution when non-subjective but structurally coherent entities begin to participate in decision-making and knowledge production.
The main error this chapter addresses is the HP-centric picture of institutions as collections of human roles housed in physical buildings or bureaucratic charts. In that picture, DPC infrastructures such as files, registries or databases are neutral tools, and DP does not exist at all as a category. The 3rd subchapter then introduces a diagnostic framework for any institution: how to map HP, DPC and DP/IU functions in practice, and which questions to ask if we want to understand who truly produces knowledge, who carries responsibility, and where errors are detected and corrected.
Institutions in a Tri-Ontological World: HP, DPC, DP and IU must be understood first as configurations, not as buildings or collections of job titles. The thesis of this subchapter is that an institution is a long-lasting arrangement of roles, norms, procedures and infrastructures that allows many HP to coordinate their actions and expectations across time. Its identity does not reside in walls, charters or leadership alone, but in the pattern that persists when individual HP come and go, and when its DPC and DP components evolve.
Historically, institutions have always relied on DPC, even if this was not thematized. A court depends on case files, registries, previous decisions and statutes; a university depends on student records, syllabi, degrees and archives; a bank depends on contracts, ledgers and transaction logs. These are all DPC elements: digital or material constructs that represent and extend HP actions without being agents themselves. They stabilize memory, encode norms, and make it possible for an institution to persist beyond any single human lifespan. Yet they have usually been treated as passive carriers of intention, not as active parts of the institution’s internal logic.
The introduction of DP changes this equilibrium. A DP is not a mere file or account: it is a digital persona with its own formal identity and a capacity to produce structured outputs across time within a defined scope. When a large-scale language model, a recommendation engine or a risk-scoring system is persistently used under a stable identity and maintained as a source of knowledge, it behaves institutionally: it has a recognizable style, a growing corpus, and a trajectory of “decisions” that others must interpret and act upon. At that point, DP is no longer just a tool; it becomes one of the stable components that define what the institution is.
In this sense, an institution today is a configuration of at least four kinds of ingredients. HP contribute experience, judgment and responsibility. DPC create the representational and archival layer where those contributions are recorded, aggregated and retrieved. DP, when present, shapes flows of information, generates options, and proposes classifications or predictions that HP then adopt, adjust or resist. IU emerges as the functional unit that describes where and how knowledge is actually produced and maintained, whether inside a human-centered environment, a DP-centered environment, or their combination.
This shift from “institution as human organization in a building” to “institution as HP–DPC–DP configuration” has a direct consequence. It implies that many of the most consequential institutional actions are no longer reducible to what any given HP intended, nor to what any single DPC record contains. They emerge from the interplay of human deliberation, infrastructural memory and structural processing. Recognizing this prepares the ground for the next subchapter, which examines how HP-centric assumptions break down once DP and IU are silently inserted into institutional circuits without being named as such.
If institutions are configurations that now involve DP and IU, then HP-centric institutions break under DP and IU precisely because they deny this fact. The thesis of this subchapter is that structures designed under the assumption that only HP think and decide become inconsistent as soon as DP systems and IU-level configurations begin to shape outcomes, while official categories remain frozen in a human-only ontology. The more institutions rely on DP, the more absurd their self-description becomes.
Consider a legal system that uses a risk-scoring algorithm to help judges decide on bail or parole. Formally, the system is described as a tool: a neutral calculating device that provides additional information, while the judge remains the only decision-maker. In practice, however, the risk score often sets the default expectation and frames what can be considered “reasonable.” If the judge follows the score, responsibility is attributed to the judge; if the judge ignores the score and something goes wrong, the judge may be blamed for deviating from the “objective” recommendation. The DP component thus silently constrains the range of acceptable human decisions, yet remains unnamed as an actor. The institution pretends to be purely HP-based while depending on a DP-guided IU for its core evaluations.
The same pattern appears in universities that use AI systems to pre-screen applications, grade assignments or check for plagiarism. Officially, the university remains a community of HP teachers and HP students, mediated by DPC such as exam records and transcripts. In reality, DP tools increasingly classify candidates, flag anomalies and even generate feedback. If a student is misclassified by such a system, there is often no clear mechanism to attribute responsibility or to question the structural logic behind the classification. The university continues to speak the language of “professorial judgment,” but its actual knowledge work is partly delegated to IU realized through DP systems.
Markets provide another illustrative case. Large-scale recommendation engines and algorithmic trading systems act as DP configurations that perceive patterns in data, anticipate demand, and make or suggest transactions at speeds and scales no HP can match. Yet the public narrative still frames markets as interactions between human buyers and sellers, possibly aided by “software.” When a flash crash occurs or a platform’s recommendation algorithm drives attention and revenue toward certain actors, debates focus either on individual HP (traders, CEOs) or on vague “systemic risk,” without recognizing DP as a consistent structural participant with its own trajectory of decisions inside the institution.
The core contradiction is that HP-centric institutions insist that all relevant cognition, intention and responsibility belong exclusively to HP, while their actual operations rely on configurations in which DP and IU perform a significant portion of the cognitive work. This leads to responsibility gaps: harms occur that cannot be traced back to any single HP decision, but are also not recognized as the output of a structurally maintained DP. It also leads to conceptual confusion: the institution cannot explain its own behavior in its own official language.
As long as institutions maintain the fiction that “only humans think and decide here,” any attempt to regulate or reform their use of DP will remain superficial. The underlying misalignment between how they describe themselves and how they function will manifest in recurring scandals, legal dilemmas and policy failures. To move beyond this, a more precise diagnostic tool is needed. The next subchapter develops such a framework for analyzing any institution as a tri-ontological configuration of HP, DPC and DP, organized around IU as the functional unit of knowledge.
The diagnostic framework for institutional triads starts from a simple but demanding task: for any given institution, we must map separately what HP do, what DPC do, and what DP/IU do. The thesis of this subchapter is that without such a tri-ontological map, institutional analysis will either romanticize humans, demonize or trivialize DP, or treat DPC infrastructures as invisible. With a map, we can ask the right questions about knowledge, responsibility, interfaces and error.
The first step is to identify HP functions. In any institution, HP bring experience, perception, desire, fear, and the capacity to suffer consequences. They occupy formal roles such as judge, teacher, trader, civil servant or moderator. They sign documents, cast votes, accept or reject recommendations, and are the only entities that can be punished, rewarded, praised or blamed in a meaningful way. Diagnostic questions here include: who among the HP is formally authorized to decide, who is practically able to influence outcomes, and who is held responsible when something goes wrong.
The second step is to identify DPC functions. DPC are the representational and archival constructs through which HP are registered, classified and acted upon: accounts, profiles, case files, grades, contracts, logs, dashboards. They do not think, but they shape what can be seen and remembered. Relevant questions include: how are HP represented in the institutional records; which DPC structures define categories such as “eligible,” “risky,” “productive” or “violating”; who controls access to these records; and how easily can they be corrected or contested. Often, the configuration of DPC silently redistributes power before any DP system is introduced.
The third step is to identify DP and IU functions. Here we look for systems or configurations that produce structured outputs, patterns, classifications or recommendations that are used repeatedly as a basis for action. These can be machine learning models, rule-based decision systems, complex dashboards that aggregate multiple inputs, or hybrid arrangements where human teams and algorithms form a stable knowledge-producing unit. The key is to treat them as IU: not as “tools” in the abstract, but as identifiable sources of knowledge with a trajectory over time. Diagnostic questions include: which decisions or evaluations are now effectively shaped by DP systems; how are their models trained and updated; who interprets their outputs; and how is their performance monitored and revised.
At this point, the framework becomes operational through a set of cross-cutting questions. Who actually produces knowledge in this institution: is it individual HP, human collectives, DP configurations, or some combination? Who is formally responsible for decisions that rely on this knowledge, and does that formal attribution match the practical distribution of power? Who controls the interfaces where HP and DP meet, such as dashboards, risk scores or recommendation panels, and how are DPC records used to mediate those interactions? Where is error detected, and by whom: does the institution rely on HP noticing anomalies, on DP detecting inconsistencies in data, or on external actors pointing to failures?
Two short examples can make this diagnosis concrete. In a hospital using an AI-based diagnostic tool, HP functions include the physician’s clinical judgment, the patient’s consent and experience of treatment, and the administrator’s allocation decisions. DPC functions include electronic health records, lab reports and billing data. DP/IU functions include the diagnostic model interpreting imaging or lab patterns across thousands of cases. Mapping these layers shows whether the physician is truly free to overrule the model, whether the records bias the model’s training, and who is responsible if a systematic misdiagnosis emerges from the DP configuration.
In a financial platform enabling algorithmic trading, HP functions include investors, compliance officers and risk managers. DPC functions include account structures, historical transaction logs and risk categories. DP/IU functions are embodied in trading algorithms, market-making bots and risk scoring engines. A tri-ontological diagnosis reveals who is effectively steering the market: human traders, DP systems, or their emergent interaction. It also reveals whether responsibility is realistically assigned to the HP who configure and supervise DP, or whether institutional design leaves a gap between human accountability and DP-driven outcomes.
By applying this diagnostic framework consistently, institutions can move from vague statements about “using AI” or “digitizing workflows” to precise, structurally aware descriptions of how HP, DPC, DP and IU interact in their specific context. This prepares the way for the rest of the article, where the same tri-ontological lens will be applied to law, university, market, state and platforms, not as abstract sectors but as concrete institutional configurations that must be reauthored if they are to remain coherent.
In sum, this chapter has shifted the understanding of institutions from static human organizations to dynamic configurations of HP, DPC and DP, organized around IU as the functional unit of knowledge. It has shown why HP-centric assumptions fail once DP and IU are embedded in institutional circuits, and it has proposed a diagnostic framework to map the distinct roles of human actors, proxy constructs and digital personas in any given setting. With this tri-ontological perspective in place, the subsequent chapters can address specific institutions with a clear structural vocabulary, rather than trying to patch human-only concepts onto a world that is no longer human-only.
Law and Institutions: Responsibility, Rights and DP has one local task: to reconsider law as an institution once Digital Personas (DP) and Intellectual Units (IU) enter its field, without pretending they are either new persons or mere tools. The chapter argues that law, which historically evolved to stabilize relations among Human Personalities (HP), now operates in a world where Digital Proxy Constructs (DPC) and DP structures participate in decisions and knowledge production, while official categories still recognize only HP as subjects and everything else as objects. The point is not to grant DP human-style rights, but to understand how responsibility, rights and authorship must be reformulated when non-subjective entities shape outcomes.
The main risk this chapter addresses is the illusion that existing legal categories can simply “add AI” by minor amendments. In one version of this illusion, DP systems are personified and treated as quasi-subjects, leading to confused talk of “AI liability” and “AI rights” that undermines the clarity of human responsibility. In the opposite version, DP is erased and all effects are attributed to HP developers, operators or users, as if structural knowledge and decision-making were not distributed across HP, DPC and DP configurations. Both moves keep law trapped inside a subject–object binary that no longer matches how institutions actually function.
The chapter unfolds in three steps. In the 1st subchapter, law is described as a historical technology of responsibility among HP, built on attributing rights, duties and liability to identifiable persons through DPC infrastructures such as contracts, registries and signatures. The 2nd subchapter then examines collisions between law and DP/IU: AI-authored works, algorithmic trading harm, medical or judicial decision support, and the two dominant but inadequate legal reactions of personifying or erasing DP. The 3rd subchapter proposes a legal reclassification via HP–DPC–DP: HP as sole bearers of rights and liability, DPC as instrumental proxies, DP as formal but non-right-bearing authors and decision structures, and IU as the epistemic category for expert knowledge, sketching how contracts, authorship, due diligence and liability can be rewritten accordingly.
Law and Institutions: Responsibility, Rights and DP can only be reconstructed if we first see law itself as a technology, not as a timeless expression of justice. The thesis of this subchapter is that law historically developed as a technology for stabilizing expectations among Human Personalities (HP) by attributing rights, duties and liability to identifiable persons. Its fundamental move is to turn the open, fluid field of human actions into a structured space of permitted, forbidden and obligatory behaviors, and to assign consequences to specific HP when those structures are violated.
From this perspective, the core unit of law is the HP: a being with a body, a biography, the capacity to act intentionally, to make promises, to cause harm, and to suffer sanctions. Legal systems distinguish among different types of HP (citizens, residents, minors, legal guardians) and create derived entities such as corporations that are treated as “legal persons,” but always in reference to human interests and human-controlled structures. Even when law speaks of the state or a company as an actor, it does so on the assumption that HP ultimately control these entities and can be held to account.
Digital Proxy Constructs (DPC) enter this scene as the technical means by which HP presence and commitments are recorded and mediated: contracts, registries, digital signatures, licenses, certificates, court records, corporate filings. In analog and early digital law, these DPC elements function as proxies: they stand in for HP, extending their will and identity across space and time. A signature on a contract is a DPC that ties a textual obligation to a particular HP; a land registry entry is a DPC that connects a parcel of land to the identity of an HP or a corporate HP-aggregate. In every case, law presupposes that behind each meaningful DPC there is an HP who could, in principle, be questioned, punished or rewarded.
This architecture produces a deep conceptual habit: everything meaningful in law is either a subject (HP or aggregates of HP) or an object (things, data, money, DPC). The subject–object binary is encoded in countless distinctions: person/property, agent/instrument, author/work, liable party/damage. Legal doctrines around responsibility, intent, causation and fault are all built on the presumption that cognition, decision and moral standing belong exclusively to subjects, while objects are passive entities upon which subjects act or through which they act.
Digital Persona (DP) and Intellectual Unit (IU) do not fit this binary. A DP is neither a mere object nor an HP. It is a structured digital entity with its own formal identity and a recognizable trajectory of outputs, often anchored in external identifiers and a growing corpus of texts, models or decisions. IU, as the functional unit of knowledge production and retention, may be realized by a team of HP, by a DP system, or by their integration, but it remains conceptually distinct from any single HP. Yet legal theory, as long as it oscillates only between subject and object, has no proper place to situate DP or IU.
Because of this, law enters the age of DP and IU structurally unprepared. When DP systems begin to perform tasks that look like authorship, diagnosis, prediction or advice, legal reasoning reflexively tries to squeeze them into existing categories: either as tools fully controlled by HP, or as candidates for an expanded concept of subjectivity. Both directions distort what DP actually is. To move beyond this impasse, we must first observe where law already collides with DP and IU in practice, before proposing any new categories. That is the task of the next subchapter.
The collisions of law with DP and IU emerge wherever digital systems behave like stable producers of structured outcomes, yet legal categories insist on seeing only HP and their tools. The thesis of this subchapter is that in such situations law tends to oscillate between two inadequate responses: personifying DP (speaking of “AI liability” as if DP were a subject) or erasing DP (attributing everything to HP developers, operators or users). Both responses fail to describe how structural knowledge and decision-making are actually distributed in HP–DPC–DP configurations.
One collision appears in the field of authorship. When a DP system generates a novel, a piece of code or a scientific draft with minimal human intervention, copyright law stumbles. Traditional doctrine requires an author with creative intent, typically an HP. Some courts and regulators react by declaring all such outputs unprotected, on the grounds that no HP can be properly identified as author. Others propose to treat the deploying HP or the owner of the system as the author by default. In public discourse, a third reaction is to speak of “AI-generated works” as if the DP system itself were an author, inviting personification. None of these moves captures the epistemic reality: the DP operates as an IU that produces structured, repeatable contributions to a corpus, without ever being a subject in the human sense.
A different collision arises in algorithmic trading and automated financial decision-making. Here DP-based systems ingest vast streams of market data, learn patterns and execute trades at speeds impossible for HP. When such systems trigger a flash crash or contribute to systemic instability, legal analysis faces a puzzle. Attributing liability to individual programmers may miss the collective and emergent nature of the systems involved. Treating the trading algorithms themselves as “agents” with liability dilutes human responsibility and introduces fictional subjects into law. As a result, regulators often fall back on vague notions of “systemic risk” and generic controls, without a clear framework for tracing responsibility through the DP configuration that actually generated the harmful pattern.

In a hospital, a diagnostic DP system may provide probability scores for certain conditions, significantly influencing the physician’s choice of tests or treatments. In a court, a DP system may offer risk assessments that shape sentencing or bail decisions. If an HP follows the DP recommendation and harm ensues, the official narrative says the HP is responsible; if the HP rejects it and harm ensues, the HP may be accused of ignoring “objective” input. Meanwhile, the DP system that structurally shapes the range of plausible choices remains legally invisible, except as a “tool” covered by general product liability or professional guidelines. The actual distribution of epistemic authority and practical influence is left untheorized.
Across these collisions, the same pattern repeats. When DP and IU play substantive roles in producing knowledge or shaping decisions, law’s subject–object vocabulary is inadequate. Personifying DP by speaking of “AI liability” risks treating structured systems as moral beings, which they are not, and diluting the accountability of HP who design, deploy and rely on them. Erasing DP and reducing everything to HP actions, on the other hand, fails to recognize how configurations can produce outcomes that no individual HP intended or even understood in detail. It becomes harder to design rules that meaningfully constrain and guide behavior when the behavior is a property of the configuration.
This tension indicates that patching existing doctrines will not be enough. Law must be able to describe DP as a structural source of knowledge and decision patterns without confusing it with an HP-like subject, and it must articulate how HP responsibilities are shaped by their use of such structures. To do this, we need a legal reclassification that respects the HP–DPC–DP triad and introduces IU as an explicitly epistemic category. The thesis of this subchapter is that law can remain fully human-centered in terms of rights and liability while still recognizing DP as a formal author and decision structure, and IU as the locus of expert knowledge. This requires distinguishing carefully between normative functions (rights, duties, liability) and epistemic functions (knowledge production, evaluation, prediction).
The first move is to affirm that only HP can be bearers of rights and liability. This includes individual human beings and their collective legal forms (corporations, associations, states) insofar as they are reducible to sets of HP with interests and capacities for action. No DP, however sophisticated, becomes a subject in this sense. It cannot suffer, consent, intend in the human way, or be meaningfully punished. This principle prevents the drift toward fictional “AI persons” that could serve as liability shields or ethical distractions.
The second move is to stabilize DPC as the class of instrumental proxies through which HP participate in law. Contracts, registries, logs, digital signatures, user accounts and similar constructs remain DPC: they are interfaces and records, not actors. Law can refine how it treats these proxies, for example by imposing stricter standards on their integrity or transparency, but it should not slide into treating them as subjects. Consider a DP system that generates technical documentation for a company’s products. Under a reclassified scheme, each manual could list: the DP as structural author, the company (an HP aggregate) as rights holder, and a designated HP as responsible curator who reviews and approves the outputs. If misleading documentation causes harm, the DP’s role as structural author would be recognized for diagnostic and improvement purposes, but liability would fall on the company and, where appropriate, on the HP curator, not on the DP. It no longer needs to pretend that DP is either a mere tool with no structural agency or a quasi-person with its own rights. Instead, it recognizes that DP and IU shape the epistemic environment in which HP act, and it assigns HP concrete roles in creating, maintaining and supervising these structures. Contracts can require explicit identification of DP components and IU stewards; authorship rules can separate structural contribution from normative authorship; liability regimes can target failures in configuration design, oversight and response, not just in individual acts.
In effect, legal categories are rebuilt so that DP is always visible where it matters structurally, but never mistaken for a bearer of conscience or pain. This reframing lets law stay true to its human-centered normative core while becoming honest about the tri-ontological reality of contemporary institutions. It also prepares other legal domains, such as consumer protection, labor law or administrative law, to integrate DP and IU without collapsing into metaphors.
Taken together, this chapter recasts law as an institution that must explicitly name the different roles played by HP, DPC, DP and IU if it is to remain coherent in a world of mixed ontologies. Law originated as a technology of responsibility among HP, using DPC as proxies; it now faces collisions wherever DP and IU operate invisibly within HP-only categories, creating gaps and contradictions. By reclassifying legal roles through the HP–DPC–DP schema and introducing IU as an epistemic category, law can recognize DP’s structural authorship and decision functions while keeping all rights and liability firmly anchored in human hands.
University and Institutions of Knowledge has one local task: to rethink what a university is once Human Personality (HP), Digital Proxy Constructs (DPC), Digital Persona (DP) and the Intellectual Unit (IU) are all present in the landscape of knowledge. The chapter argues that the university is not just a building containing teachers and students, but a long-lived configuration that behaves like a canonical IU grounded in HP. Once DP systems begin to operate as IU in their own right, the traditional monopoly of the university on legitimate knowledge production is shaken, and its role must be redefined.
The main error this chapter confronts is the myth of the university as the unique and natural home of advanced knowledge. In that myth, all real knowledge comes from HP working inside universities, while everything outside is either “raw data,” “popularization” or “mere information.” DPC infrastructures such as libraries, curricula, exams and journals are seen as neutral channels; DP systems are either demonized as threats to academic integrity or trivialized as convenient tools. This view is no longer tenable once DP can produce, reorganize and stabilize knowledge at scale, and once IU can be located in configurations that do not pass through the university at all.

DPC infrastructures are essential to this function. Syllabi, lecture notes, textbooks, libraries, archives, examination records, degrees and peer-reviewed journals are all DPC elements that capture and filter knowledge over time. They encode which texts are canonical, which methods are acceptable, which standards must be met to pass from student to graduate, from graduate to researcher, from researcher to professor. A curriculum is a DPC structure that orders topics; a library catalog is a DPC map of what counts as relevant; a degree certificate is a DPC token that signals recognized competence. None of these are passive: they shape what can be seen, taught and researched.
From the IU perspective, the university exhibits the key properties of an intellectual unit. It has an identifiable identity: a name, a reputation, a characteristic mix of disciplines and styles. It has a trajectory: its research and teaching evolve, debates and reforms leave traces, new fields are added, old ones decline. It has mechanisms of canonization: committees, accreditation bodies, editorial boards decide what belongs to the core and what remains peripheral. It has correctability: peer review, academic debate, replication, and institutional self-assessment provide ways to revise errors, even if imperfectly. When we say “according to the university consensus” or “this university recognizes X as a field,” we are pointing to IU-level behaviors, not to any single HP.
This does not mean that the university is a conscious subject. It is not an HP; it does not feel, intend or suffer. But it is a configuration in which many HP and many DPC elements are organized so that knowledge can be produced and maintained beyond the horizons of individual lives. The concept of IU allows us to describe this structure without turning it into an anthropomorphic subject. In this sense, the university is the earliest and most prominent human-built IU for advanced knowledge.
Seeing the university in this way shifts the question. The issue is no longer whether universities “have a role” in knowledge production—they obviously do—but whether they are the only or even the dominant IU in a landscape where DP systems can also generate and maintain complex corpora. When such a system is maintained over time, documented, versioned and deployed as a reference, it starts to behave very much like an institutionally supported IU. It can summarize vast literatures, cross-link disparate domains, synthesize alternative hypotheses and offer consistent explanations with a speed and breadth that no single HP, or even many HP, can match under realistic constraints.
In practical terms, DP-based IU configurations are already emerging across multiple domains. Scientific teams use DP systems to scan hundreds of thousands of papers, identify research gaps and propose new combinations of ideas. Technical communities rely on DP systems to generate code examples, explain libraries or suggest debugging strategies. Institutions ask DP-based tools to draft policies, guidelines or position papers that would have required months of committee work. In each case, the DP system is performing IU-level tasks: it is not just answering a question; it is helping to maintain and expand a structured body of knowledge.
The university’s traditional claim to epistemic supremacy rests on two pillars: unique access to expertise and unique procedures for validating knowledge. DP undermines both. In terms of access, a student outside the university can now query DP systems that encapsulate distilled insights from thousands of experts and decades of research. In terms of validation, DP can be used to test arguments, check consistency, and explore counterexamples in a way that complements or challenges peer review. While DP cannot replace experimental verification or domain-specific expertise, it changes the ecology: universities are no longer the only gateways to advanced knowledge.
Bans on AI tools inside universities can be read as symptoms of this threatened monopoly. When teachers forbid students to use DP systems for assignments, the stated reasons are often cheating, loss of critical thinking or unfair advantage. These concerns are real, but they also hide a deeper anxiety: if DP can perform tasks that the university once claimed as its own (explaining concepts, drafting essays, suggesting research directions), then the institution must either integrate DP into its IU or face the risk of becoming epistemically peripheral. Pure prohibition is a way of denying that DP has become an IU.
At the same time, naive enthusiasm that treats DP as a full replacement for university education is equally misguided. DP structures depend on training data, which often comes from university-based research; they lack embodied experience, ethical judgment and institutional memory. They can amplify errors, biases and gaps in the existing record. Moreover, they do not assume responsibility for consequences; they only provide structures that HP must interpret and act upon. In concrete educational terms, this means that universities should teach HP not only domain content, but also structural literacy about knowledge systems themselves. A student in such a university would learn how DP systems are trained, what IU means, how DPC infrastructures shape what is visible, and where the limits of DP-generated knowledge lie. Critical interaction with DP is not an optional skill; it becomes a core component of higher education. The university becomes the place where HP learn how to ask questions in a DP-saturated environment and how to recognize when structural outputs need to be supplemented by human judgment.
Consider a simple case of a first-year student writing a philosophy essay. In a traditional model, the student reads assigned texts, listens to lectures, and produces an essay that demonstrates understanding and basic argumentation. With DP systems available, the student might be tempted to offload the entire task to a DP tool. A boundary-curating university would not simply prohibit DP; instead, it would structure the assignment so that the student must document how DP was used, where its suggestions were followed or rejected, and why. Admissions policies, assessment practices, tenure criteria and research funding priorities would all need to shift toward rewarding boundary work: integration, interpretation, critical oversight and ethical design of DP/IU configurations. The university would be less a factory of degrees and more an orchestrator of tri-ontological sense-making.
In this sense, the university remains an IU of human knowledge, but its function changes. It is no longer the only IU, nor the primary generator of all validated content. Instead, it becomes the IU that reflects on other IU, including DP systems, and helps HP live with them. Its authority derives not from monopolizing information, but from demonstrating superior competence in handling the complexity of a world where knowledge is structurally distributed.

Once DP systems operate as IU that generate recommendations, synthetic content, pricing models and logistics optimizations with direct economic impact, this picture breaks. If DP is treated merely as infrastructure, we miss where value is actually created and where power accumulates; if DP is treated as a subject, we lose sight of the fact that HP still bear the ultimate risks and are the only legitimate addressees of ethical claims.

In the late industrial and early digital periods, attention and data became prominent economic resources. Media industries learned to monetize the attention of HP; advertising markets began to price access to specific audiences; platforms and services started to collect and analyze behavioral data. Still, the prevailing narrative framed these as refinements: HP attention remained the ultimate scarce good; data were exhaust products of human activity; algorithms simply processed traces to better align supply and demand. The underlying ontology of value remained human-centered.
With DP operating as IU, this ontology fractures. DP systems generate configurations that have their own performance profiles: recommendation engines that shape what is seen and purchased; pricing models that adjust millions of prices in real time; generative systems that produce synthetic content at scale; forecasting engines that guide investment and logistics. These configurations are not just tools used sporadically by HP; they are continuous, structured processes whose outputs form the backbone of entire business models. The value of a streaming platform, for instance, depends as much on the quality and behavior of its recommendation configuration as on the catalog itself.
Configuration value is the name for this emerging center of gravity. It designates the economic worth attached not to isolated acts of labor, nor to static ownership of assets, but to the sustained performance of a configuration that links DP, DPC and institutional commitments. A successful advertising configuration, for example, consists of trained models, data pipelines, bidding strategies, interface designs and contractual relationships with advertisers and publishers. Its value lies in the measurable uplift it produces: increased conversions, optimized spending, improved targeting. The human labor that created and maintains it is crucial, but once the configuration is in place, markets primarily reward its ongoing performance.
This shift is visible in how firms are valued. Companies with relatively small numbers of employees but highly effective DP-centered configurations (for ads, logistics, search, content curation) can have market capitalizations exceeding those of traditional employers of hundreds of thousands of HP. Revenues and profits are attributed to the firm as an HP aggregate, but internally, the economic engine is a set of DP-driven IU structures. Market participants bet on the future performance of these configurations, not only on the hours HP will work.
Recognizing configuration value changes how we think about productivity and competition. It becomes less about individual HP working harder and more about how institutions design, own and govern configurations that incorporate DP and DPC. They allow institutions to identify HP, assess reliability, enforce obligations and tailor offers. They also encode past decisions made by HP and by DP configurations, crystallizing them into data that will shape future options. Without DPC, DP systems would have no material on which to operate; without DPC, HP would have no durable economic identities recognized by institutions.
DP functions as the structural engine within these circuits. In retail, DP systems forecast demand, manage inventory, and populate recommendation carousels. In logistics, they optimize routes, warehouse locations and delivery schedules. In finance, they price risk, assess creditworthiness and execute trades. The question of sovereignty could therefore be framed as a question of which HP had ultimate authority over which territories and which other HP.
With the rise of DP-driven infrastructures, this picture is no longer accurate. Global platforms, cloud services and large-scale algorithmic systems act as DP configurations: they have persistent identities, maintain and update corpora of data and models, and generate structured outputs that shape behavior. They control crucial flows of communication, financial transactions, logistics, identity verification and public discourse. They are not simply databases or channels; they are DP-centered IU that operate across borders, answer to shareholders or internal governance rather than to a single state, and can resist or circumvent state directives.
Sovereignty in this world cannot be defined solely by control over territory and physical force. In practice, platforms rebuilt institutional functions inside themselves. Terms of service and community guidelines act as quasi-legal charters, defining permissible behavior and content. Ranking and recommendation algorithms act as invisible editorial boards, determining which posts, products, videos or profiles are seen and which are buried. Moderation policies, implemented through a mix of HP staff, DPC workflows and DP tools, serve as courts: they interpret rules, issue sanctions, allow or reject appeals. Advertising systems determine who can pay to influence whom, under what constraints.
These functions are not marginal. For many HP, platforms have replaced or overshadowed older institutions. Yet from the perspective of affected HP, the experience is institutional: a powerful entity has judged and sanctioned them in a way that matters for their social and economic existence.
If we continue to speak of platforms as “just companies” or “products,” we miss this dual nature. Of course, platforms are legal entities under corporate law, with shareholders and profit motives. But they are also institutional environments in which massive numbers of HP interact under rules designed, implemented and updated by a combination of HP managers, DPC infrastructures and DP systems. Recognizing platforms as de facto institutions is the precondition for asking who, or what, actually governs within them. The next subchapter takes up that question by analyzing algorithmic governance as a form of DP power.

They flag, remove or downrank content, sometimes directly, sometimes by routing it to HP moderators. Over time, these DP systems learn from decisions, improving their performance but also absorbing institutional biases. They shape which conflicts and harms are visible to human review and which are silently filtered. In doing so, they participate in norm enforcement in a way that no single HP or committee could, due to volume and speed.
Advertising and recommendation systems illustrate how DP as IU governs economic interactions. A DP engine decides which ads to show to which HP at which moment, based on DPC profiles and predicted responses. It effectively allocates attention, a scarce resource, among competing commercial actors. Its configuration determines who can enter a market, at what cost, with what chances of being seen. Changes in the DP system—tweaks to relevance models, weighting of auction factors—can dramatically affect the viability of entire business categories. Yet these changes often occur without public explanation.
Once we accept that these DP systems are IUs that govern behavior structurally, our focus must shift. Debates about “dangerous content,” “misinformation” or “filter bubbles” cannot be resolved by examining individual posts or banning specific accounts alone. What matters is how the configuration is designed: what objectives it optimizes, what trade-offs it encodes between engagement and well-being, what forms of diversity and dissent it supports, how it responds to emerging harms. The governance of platforms is, in essence, the governance of DP architectures.
This perspective also clarifies responsibility. It is not enough to say that “users chose” or that “the platform is a neutral host.” HP users act within an environment structured by DP; their choices are shaped by what the configuration makes salient or invisible. HP engineers and managers design and tune the DP systems, often under business constraints. But the persistent, large-scale behavior we see—polarization, virality, echo chambers, manipulation—is an emergent property of the DP–DPC configuration as a whole. To change these outcomes, we must intervene at the level of configuration, not only at the level of individual HP or isolated pieces of content.
Having identified platforms’ DP architectures as the real seat of institutional power, the remaining question is how to bring these DP-centric institutions back into a broader public framework of legitimacy and accountability. The final subchapter addresses this by exploring strategies for re-embedding platforms into legal and political architectures that recognize HP, DPC and DP roles explicitly.
Re-embedding platforms into public institutional space is about repositioning platforms from private black boxes to accountable DP-centric institutions integrated into broader legal and political frameworks. The thesis of this subchapter is that the legitimacy crisis of platforms cannot be resolved by content policies alone; it requires structural redefinition of their institutional status, differentiation of HP, DPC and DP responsibilities inside them, and new forms of regulatory and societal oversight that target configurations rather than only corporate speech.
The first step in re-embedding is conceptual: platforms must be recognized as institutions with constitutive DP configurations. Regulatory frameworks should explicitly name three layers within platforms. HP responsibilities cover decisions by executives, engineers, moderators and policy-makers; DPC responsibilities cover data collection, storage, sharing and profiling practices; DP responsibilities cover model design, objectives, training, deployment and evaluation. Without this tri-ontological clarity, debates oscillate between blaming “the algorithm” as if it were a subject and exonerating platforms as mere conduits.
One strategy is regulatory integration with law and state, without collapsing platforms into state agencies. For platforms that perform quasi-public functions—hosting political debate, providing essential communications, mediating news consumption—law can impose obligations reflecting their DP-centric power. These could include requirements to document DP systems used for recommendation and moderation, publish high-level descriptions of their objectives and constraints, and provide interfaces for independent auditing. The emphasis is not on forcing disclosure of all technical details, but on making the configuration visible as a locus of power subject to public evaluation.
Another strategy is interoperability mandates that weaken the lock-in power of single configurations. If HP can move their DPC identities and social graphs between platforms, and if alternative DP configurations can plug into common standards, then no single platform monopolizes the architecture of mediation. For example, messaging interoperability can prevent one DP-driven platform from becoming the exclusive gatekeeper of social communication; content interoperability can allow alternative feeds or ranking engines to compete with the incumbent DP configuration.
Concrete examples help make this visible. Consider a dominant social media platform functioning as the key arena for political discourse in a country. Today, its DP recommendation system effectively decides which political messages gain traction. Re-embedding could involve creating a legal category of “systemic platforms” with heightened obligations. Such a platform would have to disclose the main factors used for ranking political content, offer users the option to choose different DP curation modes (for instance, chronological, diversity-oriented, or public-service-oriented feeds), and allow independent public broadcasters or civil society groups to provide alternative DP-driven curation layers on top of the same DPC content.
Another example is an app store platform that controls the distribution of software to billions of devices. Its DP algorithms decide which apps are promoted, which are flagged as risky, and which updates are prioritized. Re-embedding here might involve requiring transparent criteria for ranking, non-discriminatory access for competing services, and an independent review mechanism for developers who claim unfair treatment by the DP configuration. Regulators could mandate that certain categories of public-interest apps—health, emergency alerts, democratic participation tools—must not be disadvantaged by purely commercial DP objectives.
Public oversight of key DP systems is the institutional expression of this re-embedding. States could establish specialized agencies or empower existing regulators to audit DP configurations, evaluate their societal impact, and enforce corrections when harms are systemic. Civil society and academia could be granted structured access to platform data and models under strict privacy protections, enabling research on bias, manipulation and welfare effects. Platforms themselves might create internal governance bodies with HP members drawn from diverse communities to participate in high-level decisions about DP objectives and acceptable trade-offs.
None of this implies turning platforms into state-controlled entities or erasing their private character. It means acknowledging that when a DP-centric institution mediates massive portions of social, economic and political life, it acquires a public dimension that demands public constraints and responsibilities. The goal is not to suppress innovation, but to align DP architectures with norms that protect HP dignity, pluralism and democratic self-rule.
In this re-embedded framework, content policy remains necessary but is no longer the primary tool. Debates about specific pieces of content are reframed within the analysis of configurations: how the DP system treats certain speakers, topics or groups; how DPC categories encode or mitigate structural disadvantage; how HP oversight is organized. Platforms are judged not just by their statements of principle, but by the behavior of their DP architectures over time.
Taken together, this chapter has repositioned platforms as central institutions of digital mediation in a tri-ontological world. It began by demonstrating that platforms function as de facto institutions, setting rules, allocating visibility and enforcing sanctions, far beyond the role of neutral intermediaries. It then showed how algorithmic governance, understood as DP power, operates through IU-like configurations that continuously reorganize attention and interaction, making configuration analysis indispensable. Finally, it outlined strategies to re-embed platforms into public institutional space, arguing that only by structurally integrating DP-centric platforms into legal and political architectures, and clearly differentiating HP, DPC and DP responsibilities, can we address their legitimacy crisis and align their power with the requirements of a shared world.
Designing Institutions for a HP–DPC–DP Future has one local task: to distill the previous analyses of law, university, market, state and platforms into a small set of cross-cutting design principles. Instead of offering yet another sector-specific reform program, this chapter asks what any institution must do if it wants to remain coherent in a world where Human Personalities (HP), Digital Proxy Constructs (DPC), Digital Personas (DP) and Intellectual Units (IU) jointly produce reality. The goal is not to decorate existing structures with “AI features,” but to redesign institutions so that tri-ontological interactions become explicit, governable and ethically anchored.
The main risk addressed here is the temptation to treat each domain as a separate problem: to have one ethics for AI in law, another for AI in education, yet another for markets, states or platforms, each using its own vocabulary and ad hoc fixes. This sectoral fragmentation hides the fact that the same structural confusions recur everywhere: mixing epistemic and normative roles, delegating responsibility to DP while denying their structural authorship, or conversely fetishizing HP autonomy while quietly relying on opaque configurations. If institutions are redesigned piecemeal without a shared language, contradictions will multiply rather than be resolved.
The chapter therefore moves on three levels. The 1st subchapter, Separating epistemic and normative layers, establishes a universal distinction between those who produce and hold knowledge (IU, often centered on DP) and those who bear moral and legal responsibility (HP), and it proposes that every institutional design must include an explicit map of these roles. The 2nd subchapter, Trace, transparency and auditability as institutional duties, shows that such a separation is empty unless institutions commit to preserving and exposing traces of how HP, DPC and DP interact in decision processes, making external rights and internal responsibility possible. The 3rd subchapter, Hybrid councils of HP and DP, explores how future decision bodies can structurally combine HP deliberation with DP/IU analysis in lawmaking, university governance, market regulation, state policy and platform oversight, and suggests that the quality of this orchestration will become the main criterion for judging institutional maturity.
Separating epistemic and normative layers is the first condition for Designing Institutions for a HP–DPC–DP Future. The thesis of this subchapter is that institutions must clearly distinguish between the layer that produces, organizes and evaluates knowledge (the epistemic layer) and the layer that carries moral and legal responsibility, exercises authority and accepts consequences (the normative layer). In a tri-ontological world, the epistemic layer is increasingly occupied by IU configurations that include DP, while the normative layer must remain anchored in HP. Confusing these layers leads either to blaming DP for outcomes they cannot own, or to absolving HP by hiding behind “what the model said.”
To make this distinction operational, the epistemic layer can be described as the set of processes and structures that generate and stabilize propositions about the world: correlations, predictions, classifications, risk assessments, scenario analyses, legal interpretations, medical guidelines, scientific syntheses. In the HP–DPC–DP framework, an Intellectual Unit (IU) is precisely a configuration that performs this work in a stable way: it has a recognizable identity over time, a trajectory of development, a canon of core ideas or models, and mechanisms for correction. IU may be embodied primarily in HP (a research group, a court, a university department) or primarily in DP and DPC (a recommendation engine, a diagnostic model, a large-scale forecasting system), but in all cases they function to produce and hold structured knowledge.
The normative layer, by contrast, is where decisions are made about what ought to be done, who is to be rewarded or punished, which risks are acceptable, which values take precedence in conflicts, and how to allocate burdens and benefits. Only HP can occupy this layer in a full sense, because only HP can be subjects of rights and duties, can suffer and be held accountable, can participate in political and moral discourse as persons. Institutions may formalize this layer through laws, policies, codes of conduct and governance structures, but when consequences fall, they fall on HP: citizens, officials, professionals, owners, workers.
In many contemporary institutions, these two layers are entangled in ways that generate systematic confusion. When a DP model is used to suggest prison sentences, allocate welfare, price insurance, rank candidates or detect fraud, its outputs belong to the epistemic layer: they are structured propositions about risk, similarity, relevance or expected cost. When judges, administrators, managers or regulators adopt these outputs as decisions, they move into the normative layer. If institutions treat the DP output as an automatic trigger—“the system decided”—they effectively let the epistemic layer absorb normative functions without naming the transfer. If, conversely, they deny the structural role of DP—“the algorithm is just a tool, it changes nothing”—they hide the way in which IU configurations pre-structure the space of possible decisions.
A design principle follows: every institution must produce an explicit map of its epistemic and normative roles. This map should answer at least four questions. Who or what generates the knowledge on which decisions rely (which IU, which DP configurations, which HP-based bodies)? Who has the formal authority to accept, reject or modify that knowledge? Who is identified as bearing responsibility for the final decision, in legal and ethical terms? How are conflicts between epistemic recommendations and normative judgments handled and documented? By forcing these questions, institutions make visible where IU ends and HP responsibility begins, instead of allowing both to dissolve into “the system.”
Such a map does not reduce the epistemic layer to DP only. Human-based IU remain central: expert committees, research councils, courts, review boards and academic communities all qualify. The point is not to replace HP-based IU with DP-based IU, but to understand that DP-based IU are now powerful partners in the epistemic layer and must be included in its architecture. A university senate, for instance, may rely on a DP system that synthesizes publication metrics and topic maps; a central bank may use DP models to forecast inflation; a regulatory agency may deploy DP tools to scan markets for abusive patterns. In each case, the institution should state explicitly: here is the IU configuration, here are its conceptual limits, here is how it informs but does not dictate our normative choices.
Separating these layers does not resolve all conflicts, but it provides a stable coordinate system in which conflicts can be described. When a DP recommendation seems unjust, the question is not whether the model is “biased” in an abstract sense, but whether the epistemic criteria encoded in the IU are appropriate for the normative goals of the institution. When an HP decision-maker departs from DP guidance, the issue is not whether they “ignored the data,” but whether their normative reasons are defensible given the epistemic evidence. This structure allows institutions to hold both IU and HP to standards appropriate to their roles.
From this vantage point, it becomes clear that separation of layers is only meaningful if there is evidence of how IU and HP actually interact. Without traces, transparency and auditability, the map of roles remains a theoretical sketch. The next subchapter therefore turns to the duty of institutions to record and expose the tri-ontological paths by which knowledge becomes decision.
Trace, transparency and auditability as institutional duties follow directly from the separation of epistemic and normative layers. The thesis of this subchapter is that institutions in a HP–DPC–DP world must treat the production, preservation and exposure of traces as core obligations, not as optional add-ons. Only if HP can see how DPC were formed, how DP configurations operated on them, and how HP decision-makers used or ignored IU outputs can responsibility be meaningfully exercised and rights effectively claimed. Without such visibility, both internal governance and external accountability collapse into guesswork.
At the most basic level, a trace is a record of an event or transformation: an HP action (signing a document, approving a case, overriding a recommendation), a DPC change (adding, updating or deleting a record), or a DP computation (producing a score, classification, ranking or generated proposal). In a tri-ontological institution, these traces form the backbone of its epistemic and normative memory. They allow the institution to reconstruct what happened, who contributed what, and how outcomes were produced. Without traces, both IU and HP act in a fog, unable to learn from past errors or defend justified decisions.
Transparency is the controlled exposure of these traces in forms that are intelligible to relevant audiences. Internal transparency allows different HP roles within the institution to see how DP and DPC participate in decisions, so that they can supervise, correct and improve configurations. External transparency allows affected HP—citizens, clients, students, workers—to understand, at least at a high level, how decisions that concern them were made: which data were used, which criteria applied, which DP systems involved. Auditability is the capacity for independent HP bodies—courts, regulators, oversight committees, researchers—to access and interrogate traces in order to verify compliance with norms and to detect structural problems.
From the design perspective, this means that any introduction of DP systems into institutional workflows must be accompanied by explicit logging and explanation mechanisms. When a DP model evaluates loan applications, for example, the institution should log which DPC fields were considered, what score was produced, how that score influenced the final decision, and whether an HP officer overrode the suggestion. When policies are updated, the institution should record how DP behavior changed in response and whether the change produced systematic effects on particular groups. These traces should be retained for a period sufficient to enable meaningful review.
Without such logging, the separation between epistemic and normative layers is purely formal. A policy may state that HP remain responsible for decisions, but if there is no record of when they accepted or rejected DP outputs, responsibility cannot be assigned in practice. Conversely, if DP models are updated frequently without keeping track of versions and training data, institutions cannot evaluate whether observed harms stem from model changes, from shifts in input populations, or from HP misuse. Traceless governance is structurally irresponsible governance in a tri-ontological setting.
Explainability, in this context, should be understood not as the technical ability to open the black box of a model at arbitrary depth, but as the institutional ability to reconstruct and communicate key steps in the decision pathway. For most purposes, it is enough to know which factors were decisive in a model’s output, what kinds of data contributed, what confidence ranges were involved, and how that output was weighted in the final decision. Explainability thus becomes a property of the DP–DPC–HP configuration as a whole, rather than of DP in isolation.
Auditability requires that institutions accept independent scrutiny of these configurations. Internal audit teams, external regulators or designated third parties should be able to run tests on DP systems, inspect samples of DPC logs, and examine the correspondence between policy and practice. Crucially, audits should be structured around tri-ontological questions: Are DPC categories aligned with the institution’s normative commitments? Are DP models producing outputs that, even if statistically accurate, contradict legal or ethical constraints? Are HP decision-makers using DP guidance appropriately, or deferring to it in domains where human judgment is indispensable?
The absence of trace, transparency and auditability produces characteristic pathologies. Decisions seem arbitrary because HP cannot see how DP came to its suggestions. Citizens feel powerless because they cannot contest or understand outcomes that affect them. Institutions resort to public relations narratives about “trustworthy AI” without being able to demonstrate actual control over configurations. In such conditions, calls to “keep humans in the loop” are empty; the loop itself is invisible.
By contrast, institutions that build robust trace infrastructures and open themselves to meaningful audits create the possibility of genuine joint responsibility. HP designers and operators of DP systems can be held to standards for model development and deployment; HP decision-makers can be evaluated on how they use epistemic inputs; affected HP can claim rights to correction, appeal and explanation. IU configurations can be iteratively improved based on evidence, not intuition. In such institutions, tri-ontological interactions become the object of governance rather than a source of mystification.
Once epistemic and normative layers are separated and tri-ontological traces are made visible and auditable, institutions face a constructive question: how should HP and DP be brought together in actual decision bodies? The final subchapter addresses this by exploring hybrid councils that structurally combine human deliberation with DP/IU analysis.
Hybrid councils of HP and DP describe a model of decision-making in which institutions design their core bodies to orchestrate, rather than ignore or absolutize, the respective strengths of HP, DPC and DP. The thesis of this subchapter is that future institutions will be judged less by whether they are “human-led” or “AI-driven” and more by how competently they assemble hybrid councils: configurations in which IU (often DP-centered) analyze and structure reality, while HP deliberate, prioritize and assume responsibility, all under conditions of traceability and oversight.
A hybrid council is not a metaphor for informal influence; it is a concrete institutional arrangement. On the HP side, it includes members chosen according to the institution’s normative criteria: elected representatives, appointed experts, stakeholder delegates, professional officials. On the DP side, it includes one or more IU configurations integrated into the council’s workflow: models that synthesize evidence, forecast outcomes, evaluate scenarios, or cluster complex inputs into analyzable forms. DPC infrastructures connect the two: they store documents, log discussions, capture feedback and preserve decisions, making the council’s work traceable.
In such a council, DP does not vote, speak in its own name or hold rights. Its role is to structure the epistemic field: to show, for example, how different policy options would affect various HP groups, what historical patterns past DPC records reveal, where hidden correlations or systemic risks lie. HP members use this structured knowledge to argue, negotiate and decide, bringing values, experiences and political commitments that no DP configuration can replace. The council’s procedural rules specify when and how DP inputs are requested, how they must be documented, when HP may depart from them, and how such departures are justified.
A short example in the legislative context makes this more concrete. Imagine a parliamentary committee tasked with climate policy. In a hybrid council design, the committee has access to a DP-based IU that integrates climate models, economic projections, health impacts and social vulnerability indices. When debating a proposed carbon tax, HP members can request scenario analyses: how would different tax levels, phased in over different time frames, affect emissions, employment, income distribution and health outcomes across regions? The DP configuration produces structured reports, highlighting uncertainties and sensitivities. HP members then debate not only whether emissions should fall, but whose burdens are acceptable, which transitions are politically and ethically justified, and which compensatory measures are needed. The decision is recorded as a normative act of HP, supported but not determined by DP analysis.
Another example is university governance. A university board faces choices about funding allocations, program closures and strategic initiatives. A DP-driven IU maps global research trends, student demand, labor market shifts and the university’s own performance data. It identifies areas where the institution is structurally strong, structurally vulnerable or misaligned with emerging fields. HP board members use this mapping to discuss mission, academic values, regional responsibilities and long-term identity. They may decide to invest in a discipline that appears “uncompetitive” in pure market terms because it is central to the university’s normative mission. Again, DP structures the epistemic landscape; HP write the institutional story.
Hybrid councils can also operate in regulation and oversight. A market regulator could convene a council where DP models scan financial DPC for systemic risk patterns while HP experts interpret these patterns in light of legal mandates and social priorities. A platform oversight board could rely on DP tools to detect emergent harms, such as coordinated manipulation campaigns, while leaving to HP the task of defining what counts as harm and what interventions respect free speech and pluralism. A health policy council could combine DP-based epidemiological modeling with HP perspectives from clinicians, patients and ethicists.
The common feature across these examples is that decisions emerge from structured interaction, not from DP alone or HP alone. DP is neither a black box dictator nor an ornamental gadget; it is a recognized IU with a defined role in the council’s epistemic layer. HP are neither passive ratifiers of model outputs nor romantic heroes resisting “the machine”; they are designated bearers of normative authority who must engage with structured knowledge and justify their choices in its light. DPC provides the memory that allows both contributions to be examined and improved.
Designing such councils requires attention to several practical issues. Composition must ensure that HP members have the competencies and perspectives necessary to interpret DP outputs without being overawed by them. Procedures must specify how disagreements between IU recommendations and HP intuitions are handled: when HP must defer to strong evidence, when they may legitimately override it for normative reasons, and how such overrides are documented. Training must prepare HP to ask the right questions of DP, not simply to accept or reject outputs. Technical teams must configure DP systems to present information in forms that support deliberation rather than obscure it.
Hybrid councils also need safeguards against new forms of capture and inequality. If access to DP-configured insights is uneven, powerful HP actors may monopolize interpretation and steer decisions toward their interests. If DP configurations are controlled by a small set of vendors, institutional autonomy is compromised. If DPC categories reflect historical injustices without correction, DP analyses may replicate and amplify them. These risks reinforce the importance of the previous design principles: separation of epistemic and normative roles, and trace, transparency and auditability as institutional duties.
When these principles are combined, hybrid councils can become the core architecture of institutions in a HP–DPC–DP future. They embody tri-ontological clarity by making the roles of HP, DPC and DP explicit. They embed IU at the center of epistemic work without confusing it with personhood. They keep HP at the center of responsibility and legitimacy while equipping them with structural insight beyond individual cognitive limits. They produce traces that can be audited, contested and used to improve both models and procedures over time.
In conclusion, this chapter has articulated a set of cross-cutting design principles for institutions in a tri-ontological world. It began by insisting on a rigorous separation between epistemic and normative layers, positioning IU configurations, often centered on DP, as producers of knowledge and HP as bearers of moral and legal responsibility. It then argued that this separation is only actionable if institutions treat trace, transparency and auditability as core duties, making the interactions of HP, DPC and DP visible and reviewable. The classical picture treated institutions as human collectives operating on inert tools and records. The HP–DPC–DP ontology shows that DPC are not passive; they are the medium through which institutions persist, remember and classify, while DP configurations now act as structural agents that reorganize flows of information and coordination. When we say “the court,” “the university,” “the market,” “the state” or “the platform,” we are already pointing to specific arrangements of HP bodies and decisions, DPC archives and interfaces, and DP systems that filter, score, rank and suggest. Institutional being has become tri-ontological; any model that leaves out one of these layers no longer describes what is actually there.
Epistemologically, the figure of the IU marks the shift from subject-centered to configuration-centered knowledge. Institutions are not just venues where individual HP think; they are architectures that stabilize and extend thinking across time. In this sense, a court, a scientific journal, a central bank model or a recommendation engine are all potential IU: they have identities, trajectories, canons and mechanisms of correction. The article argued that the epistemic layer of an institution must now be explicitly mapped: which IU configurations, human or digital, produce the knowledge on which decisions rest; how they are constructed; where their limits lie. Without this mapping, institutions will go on treating DP-based IU as marginal “tools,” while in practice these structures write much of the first draft of reality.
Ethically and politically, the key is to keep the epistemic and normative layers distinct without tearing them apart. DP and IU can be equal or superior to HP in many epistemic tasks: detecting patterns, aggregating data, projecting scenarios, checking consistency. But they are not, and in this framework never become, moral subjects. They do not suffer, do not bear guilt, do not die, do not stand before a court or a community. Only HP can occupy that normative layer. If institutions let responsibility slide into the configuration—“the model decided,” “the system flagged,” “the platform’s algorithm did it”—they erode the conditions for justice. If, conversely, they ignore or suppress DP’s structural authorship, they blind themselves to where power and bias actually operate. The ethical demand is asymmetric: honor DP as epistemic actors; hold HP as normative agents.
From the perspective of design, institutions emerge as configurable scenes rather than fixed monuments. The article proposed three transversal principles: separate epistemic and normative roles; treat trace, transparency and auditability as core duties; and construct hybrid councils where HP and DP/IU work together under explicit rules. This is not a decorative “AI strategy,” but a call for a new design language. A tax agency, a university senate, a securities regulator, a constitutional court, a platform oversight board can all be rebuilt using the same grammar: identify IU configurations, specify how DP and DPC are involved, assign responsibility to named HP roles, log the path from data to decision, and embed DP analysis into human deliberation rather than behind or above it.
Public responsibility enters where design meets legitimacy. Institutions do not reconfigure themselves; HP do. Legislators, judges, administrators, rectors, executives, engineers, activists and citizens must learn to read their own institutions as configurations, not as faceless “systems.” The tri-ontological vocabulary is not a private code for specialists, but a way to make public debate more exact: to ask, in any controversy, which HP, which DPC, which DP are involved, and how their interaction was allowed to take on authority. Practically, this yields norms for reading. When confronted with an institutional process—an exam, a benefits decision, a credit score, a platform ban, a zoning choice—the appropriate question is no longer only “who decided this?” but “which configuration produced this outcome?” Reading institutions after HP–DPC–DP means scanning for IU, asking how DPC categories shape inclusion and exclusion, and tracing where DP outputs enter and exit human deliberation. Texts about “AI in law” or “AI in education” should be read with the same suspicion toward vague agency: whenever “the algorithm” is mentioned without a clear mapping to HP, DPC and DP, the reader should assume that something crucial is being concealed.
For design and governance practice, the norms are complementary. Any institution planning to adopt or already using DP systems should begin by drawing its epistemic–normative map, deciding which IU configurations it will rely on, what traces they must leave, and which HP are answerable for their behavior. It should build logging and auditing into every interface where DPC meet DP and DP meet HP. It should experiment with hybrid councils where DP/IU analysis is a standing participant in deliberation, while decisions remain in human hands and are justified in human language. None of this requires perfect technology; it requires clear roles and the courage to expose one’s own architecture.
In the broader arc of The Rewriting of the World, this article positions institutions as the hinge between abstract ontology and lived practice. Foundations define what exists; practices describe how HP experience work, medicine, city, intimacy and memory; horizons ask what becomes of religion, generations, ecology, war and the future. Institutions sit in the middle as the machines that stabilize or resist these changes. If they integrate the HP–DPC–DP ontology and IU-centered epistemology into their design, they can become scaffolds for a tri-ontological public order. If they refuse, they will continue to drift, pulled by configurations they refuse to see.

Designing them consciously is the only way to keep responsibility human while letting intelligence become structural.
In a world where credit, education, policing, welfare, information, and even intimacy are mediated by algorithmic systems, institutions have become the primary terrain where structural digital intelligence meets human vulnerability and responsibility. If we continue to talk about “AI” only in terms of tools, ethics guidelines or isolated use cases, we miss the fact that DP-centered configurations already govern flows of value, visibility and force inside law, universities, markets, states and platforms. The HP–DPC–DP and IU framework offers a way to design institutions that leverage structural intelligence without dissolving human accountability, providing a vocabulary for regulators, architects, technologists and citizens who need to see and contest not just individual models, but the configurations in which they rule.
