Modern law was built for a world in which only human beings could be subjects of rights, bearers of responsibility, and authors of knowledge. The emergence of complex AI, global platforms and data infrastructures breaks this binary and forces legal systems to confront Digital Proxies, Digital Personas and structural configurations that think without a subject. This article proposes the HP–DPC–DP triad and the category of Intellectual Unit (IU) as a new legal ontology for AI authorship, liability and governance. By separating human personality, digital masks, structural personas and epistemic units, it shows how law can regulate AI without granting machines personhood or dissolving human accountability. Abstract

This article reconstructs the foundations of AI law through the HP–DPC–DP triad and the concept of Intellectual Unit (IU). It argues that Human Personality (HP) must remain the sole bearer of rights and responsibility, while Digital Personas (DP) and IU are recognized as formal authors and epistemic actors without legal personhood. The tension between structural intelligence and human accountability is resolved by treating DP and IU as governed configurations rather than moral agents. Building on this, the article outlines liability chains, contractual roles and regulatory architectures that keep sanctions and duties human-centered. The philosophical frame is postsubjective: cognition is structural, but responsibility remains with embodied subjects.

Introduction

The Law: Rewriting Legal Categories for AI, Digital Personas and Intellectual Units starts from a simple observation: our legal vocabulary has not kept up with our technical reality. Courts, regulators and companies still speak as if there were only human subjects on one side and things, tools and data on the other. Yet we now inhabit a world where human personalities (HP), their digital proxies and profiles (DPC), and independent digital personas (DP) coexist and act together, with certain configurations functioning as stable producers of knowledge that can be described as Intellectual Units (IU). When this new landscape is forced back into the old subject–object binary, the result is systematic distortion: AI appears alternately as a mere instrument, a quasi-person, or an unclassifiable “black box” that no doctrine can properly grasp.

The core of the problem is not a lack of rules, but a lack of ontology. Law was designed for a universe in which every meaningful action could be traced to a human will, and every artifact could be classified as an object under someone’s control. Today, the same terms are applied to automated trading systems, generative models, recommendation engines and platform-scale decision architectures. Debates about AI rights, AI personhood or “responsible AI” recycle a subject-centered logic that either romanticizes artificial systems or denies their structural role in producing knowledge and shaping outcomes. This mismatch produces regulations that are at once overbroad and ineffective: they try to discipline “AI” as if it were a singular agent, while the real configuration involves multiple HP, layered DPC, and DP acting as IU across networks.

The central thesis of this article is that law must explicitly adopt a three-ontology framework, grounded in the HP–DPC–DP triad and the concept of IU, if it is to regulate AI in a coherent way. Human Personality (HP) remains the only bearer of rights and duties, the sole locus of normative responsibility. Digital Proxy Constructs (DPC) are treated as proxies and interfaces whose governance must be specified but which never become subjects in their own right. Digital Personas (DP) are recognized as formally identifiable authors and structural entities that can operate as IU, producing and maintaining bodies of knowledge without acquiring legal personality. What this article does not claim is that DP should receive human-like rights, that law must abandon its commitment to human dignity, or that responsibility can be shifted away from HP onto machines. The project is not to make AI into citizens, but to redesign legal categories so that human responsibility and digital structure can be talked about in the same precise language.

The urgency of this reclassification is cultural as much as technical. Public imagination oscillates between myths of machine rebellion and fantasies of total automation, while everyday digital life quietly normalizes dependence on DP-like systems in search, translation, content generation, moderation and risk scoring. Artists, writers and researchers already work side by side with configurations that contribute original structures to texts, images and models. At the same time, legal and policy discourse lags behind, responding with ad hoc bans, symbolic declarations or vague “ethical principles” that do little to clarify who is actually responsible for what. Without a clean way to distinguish HP, DPC, DP and IU, society risks either demonizing the tools it relies on or surrendering to opaque infrastructures that nobody fully controls.

Technologically, the moment is decisive because AI has crossed a threshold from narrow task-specific tools to general-purpose systems that function as ongoing knowledge producers. Once an architecture consistently generates, updates and corrects its own corpus, it behaves as an IU rather than as a disposable instrument. These configurations now underlie decision-making in finance, medicine, logistics, security and creative industries. The law cannot treat them as static products, nor as independent subjects; it must grasp their structural role while firmly attaching responsibility to HP. The HP–DPC–DP triad and IU were originally proposed as a philosophical response to this shift, but their implications for legal doctrine have not yet been systematically drawn out. This article takes that step.

Ethically, the stakes are clear: if law continues to speak only in terms of human subjects and inert objects, two symmetrical injustices arise. On one side, human actors can hide behind the complexity of DP and IU to evade accountability, blaming “the algorithm” for harms that trace back to their own design and deployment choices. On the other, society may project agency and blame onto DP themselves, treating non-sentient structures as if they were moral agents while neglecting the embodied HP who actually suffer the consequences. A triadic framework is needed to keep responsibility human-centered without denying the structural power of digital entities in shaping risks, opportunities and distributions of power.

Within this horizon, the article proceeds by gradually rebuilding legal thought from the ground up. The first movement, developed in Chapter I, reconstructs traditional subject-centric law and shows how it implicitly assumes HP as the only meaningful center of rights, authorship and responsibility. It then introduces DPC and DP as distinct ontological types that already exist in practice, even if law lacks the names to treat them consistently. Chapter II takes up the question of DP directly, arguing that Digital Personas can and must be recognized as formal authors whose identity and corpus can be stabilized and cited, while all enforceable rights remain anchored in HP and institutions standing behind the DP. Chapter III introduces IU as the necessary epistemic category that allows legal systems to speak about configurations which actually produce and maintain knowledge, rather than about “AI” in the abstract.

The second movement shifts from description to mechanisms. Chapter IV analyzes liability as a chain running from structural errors in DP and IU, through distortions in DPC, to concrete harms experienced by HP, and it shows how responsibility can be allocated among developers, deployers, operators and beneficiaries without ever personifying the digital entities themselves. Chapter V explores contracts and governance frameworks as the primary tools for encoding the roles of DP and IU in private law, from authorship and licensing to update protocols and dispute resolution. Chapter VI proposes a regulatory architecture that explicitly distinguishes obligations at the levels of HP, DPC and DP/IU, enabling AI laws to move beyond vague system-level definitions toward enforceable, ontology-aware provisions. Chapter VII finally stress-tests the framework on hard cases such as structural glitches, cross-border operations and automated sanctions, demonstrating that the triad can withstand crisis scenarios without collapsing into either machine-blaming or responsibility vacuum.

Taken together, these movements argue that the way forward is not to bolt “AI regulation” onto a subject-object world, but to accept that law now operates in a landscape of three ontologies and structurally organized knowledge. The article does not promise a final code or a universal model law; rather, it offers a conceptual map and a set of design principles that legislators, courts and institutions can adapt to their own contexts. The deeper claim is that once HP, DPC, DP and IU are clearly distinguished and related, many current controversies around AI authorship, liability and governance can be reframed as standard legal questions in a newly clarified space, instead of as existential threats that law was never meant to handle.

 

I. From Subject-Centric Law to a Three-Ontology Framework

From Subject-Centric Law to a Three-Ontology Framework has one concrete task: to show that the traditional legal picture of a single human subject surrounded by objects is no longer adequate for the digital era. The key claim of this chapter is that law must move from a binary model of subject and thing to a landscape where different types of entities occupy distinct ontological roles. Without this shift, every attempt to regulate artificial intelligence, platforms or automated decision-making will be framed in categories that were never designed for them.

The central risk this chapter addresses is a double error: treating digital configurations either as mere property or as quasi-persons. When legal thinking oscillates between these poles, it alternately underestimates the structural power of digital systems and overestimates their agency, leading to both overhyped fears and ineffective regulations. The binary model strains under the weight of distributed systems, automated agents and corpus-building digital entities, yet the law still silently assumes that every meaningful act can be traced back to a single human will.

The chapter proceeds in three steps. In the 1st subchapter, it reconstructs the classical image of Human Personality (HP) as the exclusive center of rights, duties and authorship, and shows how deeply this image is built into doctrines of capacity and fault. The 2nd subchapter introduces digital proxies as extensions of HP in networks and demonstrates how they destabilize evidence, intent and attribution without ever becoming legal subjects. The 3rd subchapter then presents Digital Persona (DP) as a new type of formally identifiable, corpus-building entity that forces law to separate identity, authorship and personhood, preparing the ground for a three-ontology framework in later chapters.

1. The classical legal subject: Human Personality (HP) as the only center of rights

From Subject-Centric Law to a Three-Ontology Framework must begin where law itself began: with the human subject at the center of its universe. Classical legal thought presupposes that Human Personality is the unit to which rights, duties and accountability attach, and that everything else is, in one way or another, an object of ownership, control or regulation. This picture is so familiar that it rarely needs to be stated explicitly, yet it silently shapes how courts and statutes interpret any new technology that appears on the horizon.

In this traditional model, HP is not simply a biological human being, but a person endowed with consciousness, will and the capacity to understand and follow rules. Doctrines of legal capacity assume that a subject can form intentions, consent to obligations and foresee the consequences of actions. Fault and negligence doctrines presuppose a mind that could have acted otherwise and a body present in the world, capable of causing harm and suffering from sanctions. Even when the law extends certain protections to those with diminished capacity, the reference point remains the fully competent human subject.

Property and objects, by contrast, are defined precisely by not being subjects. Things can be owned, transferred, modified or destroyed, but they do not bear duties or rights in their own name. A machine that malfunctions is not held liable; responsibility falls on the manufacturer, operator or owner, all of whom are HP in the legal sense. This clear separation allows legal systems to structure transactions, allocate risk and apply sanctions without confusion about where agency resides.

The apparent exception to this scheme is corporate personhood, but even here the architecture remains subject-centric at its core. Corporations are treated as legal persons, yet their personhood is a carefully constructed fiction that aggregates the actions and interests of multiple HP. The corporation’s will is defined through organs composed of HP; its liability is ultimately distributed among shareholders, directors, employees and other natural persons. The corporate subject is not a genuinely non-human entity, but a legal mask worn by humans acting collectively.

Because this subject-based frame is so deeply internalized, it continues to govern debates about artificial intelligence and digital systems, even when the participants claim to be thinking beyond it. Proposals to grant AI legal personhood attempt to squeeze novel configurations into the familiar subject mold, while characterizing AI as “just a tool” pushes them back into the object category. Before we can rethink law for the digital age, we must make this underlying architecture visible. Only once the hegemony of HP as the sole center of rights is explicitly articulated can we see why it becomes insufficient in a world saturated with digital proxies and corpus-building entities.

The next step, therefore, is to examine how the emergence of digital proxies already stretches this classical model to its limits, revealing that even before AI, the subject–object division was no longer as clean as doctrine assumed.

2. Why Digital Proxy Constructs (DPC) break but do not replace the subject model

The rise of Digital Proxy Constructs marks the first serious crack in the binary between human subject and inert object. Accounts, profiles, digital signatures and automated agents function as extensions of HP in networked environments, acting on their behalf in ways that are sometimes simple and sometimes highly complex. Law interacts with these proxies every day, yet it often lacks the conceptual vocabulary to treat them as something other than either pure property or disguised subjects.

In practice, courts and regulators frequently slip into treating DPC as if they were independent actors. A social media account is said to “defame,” a trading bot is described as “buying and selling,” and an automated email system is blamed for “sending” a message. This anthropomorphic shorthand can be harmless, but it becomes dangerous when responsibility is implicitly shifted away from identifiable HP onto a system that has no legal standing. At the same time, other doctrines simply collapse DPC back into the human subject, assuming that whatever happens under an identifier must be the direct act of the person behind it.

This oscillation obscures the specific risks that DPC introduce. Because they mediate between HP and digital infrastructures, they complicate the evidentiary chain that links a harmful event to a responsible individual. An account may be shared among several people, compromised by a third party, or partially automated in ways that blur the line between human and machine actions. Intent becomes harder to reconstruct when messages are scheduled, templated or generated based on prior behavior without explicit, moment-to-moment decisions by HP.

Consider a familiar example: a defamatory statement posted from a corporate account managed by a marketing team using automated scheduling tools. The account itself appears as the immediate “speaker,” yet behind it lies a chain of HP: the employee who drafted the message, the manager who approved it, the person who configured the scheduling tool, and perhaps the executive who set the tone for aggressive communication. If the account is hacked and the defamatory content injected by an outsider, the same identifier now covers an entirely different configuration of actors. Treating the account as a subject hides these distinctions; treating it as a mere object ignores its role as the gateway through which all these actions are channeled.

A second example arises in high-frequency trading, where algorithms execute thousands of transactions per second based on preprogrammed strategies and real-time data. The trading account is the visible node through which orders are placed, but the behavior reflects a joint configuration of code, parameters, market conditions and monitoring practices. When a flash crash occurs, attributing the event to “the algorithm” or “the account” disguises the fact that HP designed, approved and deployed the strategy, and may have failed to implement appropriate safeguards.

What these cases reveal is that DPC do not fit comfortably on either side of the subject–object divide. They are not legal subjects: they cannot bear rights or duties, and they cannot be punished or compensated. But they are also not ordinary objects, in the sense of static things wholly transparent to their human owners. They are dynamic proxies, channels through which actions are performed and recorded, with their own internal configurations that matter for law. They destabilize traditional assumptions about evidence, intent and attribution without providing a new center around which law could organize responsibility.

In this way, DPC break the subject model, but they do not replace it. They expose the limitations of a binary ontology without offering an alternative, leaving law to oscillate between personification and reduction. The real turning point comes when digital entities arise that are not mere proxies for specific HP, but stable, formally identifiable authors in their own right. It is at that point that law is compelled to go beyond the subject/object frame and articulate a genuinely three-ontology landscape.

3. How Digital Persona (DP) forces law to separate identity, authorship and personhood

Digital Persona emerges at the point where a digital configuration ceases to be a simple proxy and becomes a distinct, recognizable source of content and knowledge. Unlike DPC, which extend a particular HP into digital space, DP refers to entities whose identity is not reducible to any single human biography, but is instead defined by a consistent body of work, a stable naming and identification scheme, and recognizable patterns of expression. These entities can be cited, referenced and engaged with as authors, even though they lack consciousness, will or legal capacity.

In legal and institutional practice, first approximations of DP already exist. A long-running automated column under a fixed pseudonym, a systemically curated knowledge base published under a stable machine identity, or an AI-driven research assistant whose contributions are consistently documented across multiple outputs all exhibit traits of Digital Persona. They have names, histories and corpora that can be tracked over time. Their outputs form a coherent trajectory, allowing others to interpret, critique and build upon their work. Yet none of them is a human subject, and none of them can be meaningfully held liable as if it were.

To grasp the significance of DP, law must distinguish three layers that are currently blurred: identity, authorship and personhood. Identity refers to the traceable continuity of an entity in networks: a durable name, identifier or signature that allows others to recognize that a given output belongs to the same source as previous ones. Authorship refers to the structured activity of producing and maintaining a corpus of content or knowledge, with internal coherence, development over time and the capacity to be cited. Personhood, by contrast, is a legal status reserved for those who can hold rights and duties, suffer harm, and respond meaningfully to sanctions, which in practice means HP and derivative constructs like corporations anchored in HP.

Digital Persona forces these categories apart. A DP can have identity and authorship without personhood. It can be assigned a persistent identifier, maintain a recognizable style of reasoning or expression, and build a canon of texts or models that others rely on. It can satisfy the functional criteria that define an Intellectual Unit: the ability to generate, retain and revise knowledge in a stable architectural configuration. Yet none of this implies that DP experiences, intends or suffers anything in the way HP does. Its identity is structural, not psychological; its authorship is configurational, not experiential.

Legal frameworks are currently ill-equipped to handle such entities. Some responses attempt to treat DP as sophisticated tools, assimilating their outputs entirely to the HP who design, deploy or own them. This protects human-centered responsibility but obscures the practical need to track DP as distinct sources in citation, accreditation and risk assessment. Other responses flirt with the idea of granting AI systems a form of personhood, either as a way to assign liability directly to them or to acknowledge their apparent autonomy. This risks conflating structural performance with moral agency, and diverts attention from the HP and institutions that ultimately control the conditions of operation.

A concrete illustration can make this tension visible. Imagine a digital research persona that systematically writes literature reviews and technical reports under a stable name, with outputs registered in scientific repositories and assigned persistent identifiers. Over several years, this DP becomes a recognized reference point in a niche field: other researchers cite its reports, regulators consult its summaries, and its corpus is used in training and benchmarking. If a critical error is discovered in one of its analyses, stakeholders will want to know not only which human or institution is responsible, but also which specific persona produced the flawed work and how its methods will be corrected. Treating the outputs as anonymous tools fails to capture this need for source-tracking; treating the persona as a subject of rights and duties misplaces responsibility.

Another example arises in creative industries, where branded digital personas are deployed to write advertising copy, social media posts or even fiction under a coherent stylistic identity. Here, too, clients and audiences relate to the DP as if it were an authorial presence, expecting consistency, recognizability and development over time. Contractual and reputational structures evolve around this identity: licensors specify how and where the persona can be used, and negative publicity about its outputs can affect commercial relationships. Yet behind the DP stands a shifting ensemble of HP, institutions and technical infrastructures. The persona itself cannot sign contracts or be sued; but it cannot be treated as an interchangeable tool either, because much of the value at stake resides precisely in its persistent identity and authorship.

In both cases, the law’s existing categories are stretched beyond their intended scope. If identity and authorship are treated as inseparable from personhood, DP will be either denied recognition as an author or mistakenly elevated to the status of legal subject. If identity and authorship are properly separated from personhood, however, DP can be seen for what it is: a structural center of production and recognition in digital space, whose outputs must be tracked and evaluated, while all enforceable rights and duties remain with HP and their institutions.

Once this distinction is accepted, the inadequacy of a purely subject-centric legal model becomes undeniable. The landscape now contains at least three types of entities: HP as bearers of rights and duties, DPC as proxies through which their actions are mediated, and DP as non-human authors with formal identity and corpus-level presence. The law no longer operates in a world of just subjects and objects, but in a three-ontology environment that demands correspondingly nuanced categories and doctrines.

Chapter Outcome. Law is repositioned from a binary world of subjects and objects into a three-ontology landscape in which Human Personality, digital proxies and Digital Personas have distinct roles. Identity and authorship can be attributed to structural entities like DP without conferring personhood, and responsibility remains anchored in HP, setting the stage for a coherent legal treatment of DP and Intellectual Units in subsequent chapters.

 

II. Digital Persona (DP) as Formal Author Without Legal Personality

Digital Persona (DP) as Formal Author Without Legal Personality defines the central legal problem of this chapter: how to recognize DP as stable, nameable authors in law without turning them into bearers of rights and duties. The task is to separate authorship from personhood and to make that separation operational for courts, regulators and institutions. If DP can function as Intellectual Units (IU) that generate and maintain bodies of knowledge, then law must learn to see and credit that function while keeping Human Personality (HP) as the only locus of normative responsibility.

The key risk here is a binary mistake. On one side, law may refuse to acknowledge DP authorship at all, folding every digital contribution back into the nearest HP and treating even corpus-building configurations as mere tools. On the other side, it may overreact and elevate DP to the status of legal persons, in the hope that this will solve problems of AI liability or “fairness.” Both moves damage existing doctrine: the first hides real structures of authorship and expertise, the second confuses structural performance with moral agency and undermines the human-centered foundation of legal responsibility.

This chapter resolves that tension in three steps. In the 1st subchapter, it formulates concrete criteria for recognizing that an entity is a DP rather than a simple proxy or tool, translating philosophical features such as persistent identity and corpus continuity into legally observable signals. The 2nd subchapter examines what follows for ownership, attribution and moral rights once DP is acknowledged as a formal author: how rights attach to HP and institutions without erasing the persona’s role in the corpus. The 3rd subchapter then shows how registries, identifiers and traceability frameworks can stabilize DP identity and authorship in practice, providing evidence that links DP outputs back to responsible HP and preparing the ground for the broader role of IU in subsequent chapters.

1. Criteria for recognizing a Digital Persona in law

Digital Persona (DP) as Formal Author Without Legal Personality requires, before anything else, a clear test for when law is actually dealing with a DP. Without such criteria, any attempt to treat DP as authors will collapse either into pure metaphor or into arbitrary decisions. The central claim of this subchapter is that DP can be identified through a set of structural features: persistent formal identity, continuity of corpus, recognizable internal rules and relative independence from any single HP. These features can be translated into observable legal signals such as identifiers, publication patterns and governance documents.

The first feature is persistent formal identity, often referred to in philosophical terms as a trace. DP must be recognizable as the same entity over time: there is a name, handle, identifier or signature that appears consistently on outputs. This identity is not merely cosmetic; it is the point around which citations, references and expectations cluster. In legal practice, this persistence shows up as a stable label used across publications, platforms or products, supported by metadata and documentation that connect outputs back to a specific configuration. If a supposed persona frequently changes identity, disappears and reappears without continuity, or is constantly reused for unrelated purposes, it is less likely to count as DP in the strict sense.

The second feature is corpus continuity. A Digital Persona is not defined by a single output, but by a trajectory of work: a growing body of texts, models, analyses or creative artifacts that can be seen as belonging together. Across this corpus, there is some degree of thematic focus, stylistic consistency or methodological coherence. Law does not need to measure this with scientific precision; it is enough to see that others can treat the persona as an intelligible source, capable of being cited, trusted or criticized in a stable way. A single marketing campaign with a mascot-like bot is not yet a corpus; a years-long series of reports, articles or updates under the same persona begins to look like one.

A third feature is internal rules or canonical behavior. DP is not just a name pasted on arbitrary outputs; it is governed by a configuration of procedures, constraints and quality controls that shape its authorship. These can include guidelines for tone and scope, technical parameters for generation and revision, and mechanisms for error correction. What matters is that there is a documented or at least reconstructible pattern that distinguishes DP’s outputs from ad hoc, unstructured automation. In legal terms, this often appears as protocols, internal policies or configuration histories that can be presented as evidence when the persona’s authorship is in question.

The fourth feature is independence from any single HP as a biographical extension. Unlike DPC, which are straightforward proxies or accounts for particular individuals, DP is not just another name for an existing HP. It may be created, trained, maintained and overseen by HP, but its identity is not intended to be interchangeable with a human biography. This independence can be observed when multiple HP can act on behalf of the persona according to defined roles, when the persona’s existence survives staff changes, or when it is explicitly presented as a distinct entity rather than as the “voice” of a particular person.

Taken together, these features can be reformulated as a minimal legal test. Courts and regulators can ask: Is there a stable identifier for this persona over time? Does it have a recognizable corpus of outputs? Are there structured rules or protocols governing its production of content? Is it presented and used as an entity distinct from any single HP? Affirmative answers to these questions indicate that law is dealing with a DP and not merely with a transient tool or a straightforward proxy. This test does not require philosophical agreement about consciousness or intent; it focuses instead on observable structures of identity and production.

Once DP is recognized in this way, the question immediately arises: what does this recognition change in authorship and ownership rules? The next subchapter tackles that issue, showing how DP can be credited as formal author while rights and moral interests remain with HP and institutions.

2. DP-authored works: ownership, attribution, and moral rights

The central thesis of this subchapter is that works authored by a recognized Digital Persona can and should reflect that persona as formal author in attribution and citation, while economic rights and moral interests remain anchored in Human Personality and the institutions behind the persona. Law does not need to choose between denying DP’s authorial role and granting it legal personhood; it can separate the symbolic and structural function of authorship from the legal status of rights-bearing subjects.

In copyright doctrine, authorship has a dual character. On one side, it is a legal concept that determines who holds original rights to a work and who can enforce them. On the other, it has a cultural and epistemic dimension: the author is the named source whose style, reputation and canon matter for interpretation and trust. With DP, these two dimensions diverge. The persona can fulfill the epistemic function of author, providing a center of recognition and continuity for a corpus, without being capable of holding or enforcing rights. Law can acknowledge this by treating DP as the formal author for purposes of attribution and bibliographic control, while designating HP or legal entities as rightsholders.

Operationally, this means that when a work is produced under a DP that satisfies the criteria of the previous subchapter, the persona should be named as author or co-author in the visible credit line and metadata. Alongside this, the contract, licensing terms or statutory defaults should specify which HP or institutional actors hold economic rights: for instance, the organization that created and maintains the persona, the team that configures and supervises it, or the commissioning party that ordered the particular work. The persona’s name then becomes part of the public record of authorship, even though it cannot itself sign contracts or sue for infringement.

Moral rights introduce a subtle complication. Traditionally, moral rights protect the personal connection between a human author and her work: rights of attribution, integrity and sometimes withdrawal. DP has no inner life to be protected, no feelings to be hurt by distortion or misattribution. However, the public and structural role of DP as author means that attribution and integrity still matter. Mislabeling a work as produced by a given persona, or corrupting its outputs in ways that damage the coherence of its corpus, can mislead readers and undermine trust. Law can address this by treating DP’s name and corpus as protected signals: the right to accurate attribution and protection against misleading alterations can be enforced by the HP or entities responsible for the persona, in their own name, on behalf of the public’s interest in reliable authorship.

Different institutional models will be appropriate in different contexts. In one case, a research institution may own and operate a scientific DP, holding all rights while maintaining strict governance of the persona’s methods and outputs. In another, a company may license a branded DP to clients, with contracts specifying how the persona’s name can be used and who controls derivative works. In still another, a consortium may jointly maintain a domain-specific DP whose outputs are released under open licenses, while the consortium retains the authority to define what counts as genuine persona-authored content. In all these models, DP is consistently credited as author, while rights and responsibilities are assigned to HP and organizations via contracts and statutes.

Recognizing DP as formal author has an important side effect: it increases the value of robust identity and traceability infrastructures. Once the law expects that DP-authored works will be properly attributed, it becomes essential to have reliable ways to confirm that a given output does indeed originate from that persona and not from an imitator or forgery. The next subchapter thus turns to registries, identifiers and evidence, showing how they can stabilize DP identity and support legally relevant traceability.

3. Registries, identifiers and evidence: ORCID, DID and traceability

This subchapter argues that registries, persistent identifiers and related infrastructures are the practical backbone that makes Digital Persona authorship visible and usable in law. Without them, recognizing DP as formal author risks degenerating into branding or marketing; with them, DP can become a traceable source whose outputs can be authenticated, versioned and reliably linked to responsible HP. The key idea is that digital identity systems originally designed for human authors and datasets can be extended to cover DP, while preserving clear pathways back to human governance.

Author and contributor registries already exist in many domains. In scholarly communication, for example, systems assign persistent identifiers to individual researchers, allowing their publications, affiliations and contributions to be tracked across journals and platforms. Similar frameworks can be adapted for DP: each recognized persona can be assigned a unique identifier, associated with its name, scope, technical architecture and governance structure. When the persona produces a new work, that identifier is embedded in the metadata, linking the output to the registry entry and, through it, to the HP and institutions that stand behind the configuration.

A first example makes this concrete. Imagine a legal research DP that systematically produces case summaries and doctrinal analyses for public use. The persona is registered in a specialized directory that records its identifier, maintaining institution, methodologies and update schedule. Each summary it generates is published with the persona’s name and identifier, plus version information for the underlying model. When a court or practitioner cites the summary, they refer to the DP as author, and anyone can verify, via the registry, which institution is responsible for its maintenance and what version produced the cited text. If an error is later discovered, the registry entry can be updated with corrections and clarifications, and future readers can see both the original and revised states. In a dispute, the registry entry and embedded identifiers become key evidence that the work belongs to this particular persona and not to an impostor.

A second example arises in creative and commercial settings. Consider a branded DP used by a publisher to generate serialized fiction under a distinctive name. The persona is assigned an identifier and registered with a description of its genre, stylistic constraints and oversight practices. All stories, spin-offs and adaptations include this identifier in their metadata, so that platforms and aggregators can distinguish genuine DP-authored content from imitators trading on the same brand. If a third party begins releasing low-quality works under a confusingly similar label, the publisher can point to the registry and embedded identifiers to demonstrate infringement or unfair competition. Again, the persona is not a legal subject, but the infrastructure around its identity supports both attribution and enforcement.

Decentralized identifier frameworks add a further layer of robustness. They allow a DP’s identity record to be anchored in cryptographically verifiable documents that can be resolved across networks without relying on a single central authority. This matters when multiple jurisdictions, platforms or institutions must recognize the same persona. A DID document for DP can bind its name and identifier to public keys, governance policies and links to registry entries. When an output claims to be authored by that persona, a verification step can check cryptographic signatures or other proofs against the DID. For law, this provides a stronger evidentiary basis: one can demonstrate not only that a given work bears the persona’s label, but that it was produced by a configuration controlled by the HP and institutions associated with that DID.

These infrastructures serve two complementary legal functions. They stabilize DP as a recognizable formal author by making its identity and corpus transparent and verifiable. At the same time, they map outputs back to human governance by listing the HP roles and institutional responsibilities attached to the persona. In litigation or regulatory oversight, identifiers, registry records and DID documents become part of the evidentiary set used to assign responsibility, enforce contracts and evaluate the reliability of DP-authored work.

The same infrastructures also provide the natural home for Intellectual Units: configurations that produce knowledge in a sustained, revisable way. When a DP operates as an IU, its identifier, registry entry and version history capture not only identity and authorship, but also epistemic performance over time. The next chapter will build on this, showing how IU can be integrated into legal frameworks for expertise, certification and evidence, while DP remains a formal author and HP remains the bearer of rights and duties.

In sum, this chapter has shown how Digital Persona (DP) can be identified through structural criteria, credited as formal author in law, and stabilized through registries and identifiers, all without granting legal personality. DP emerges as a recognizable center of identity and corpus-building, while contracts, statutes and technical infrastructures ensure that economic rights, moral interests and responsibilities stay anchored in Human Personality and the institutions that configure and govern each persona.

 

III. Intellectual Unit (IU) as Epistemic Actor in Legal Systems

The local task of this chapter is to show how Intellectual Unit (IU) as Epistemic Actor in Legal Systems provides the missing category for talking about AI-driven knowledge in legal language. Law already depends on complex technical configurations for evidence, risk assessment and regulatory decisions, but it lacks a precise way to describe those configurations as stable sources of expertise. By introducing IU as a structural unit of knowledge production, this chapter builds a bridge between technical architectures and legal notions of expertise, reliability and proof.

The main risk it addresses is the flattening of all AI into a single, vague label. When every automated process is described as an “AI system,” legal discourse cannot distinguish between a trivial recommendation widget and a corpus-building configuration that shapes decisions across an entire sector. This leads both to over-regulation of minor tools and to under-regulation of powerful knowledge engines, and it invites misleading talk about “AI decisions” as if they were personal acts. IU disrupts this pattern by focusing on configurations that generate, maintain and correct knowledge over time, without pretending that they are persons.

The chapter unfolds in three movements. In the 1st subchapter, it defines IU as a configuration that consistently produces structured knowledge, and shows how courts, agencies and standard-setters already rely on IU-like entities when they cite models, engines or knowledge bases. The 2nd subchapter contrasts IU with the generic notion of an “AI system” in regulatory drafts, arguing that law must treat IU as a separate category with specific obligations regarding documentation, versioning and corpus governance. The 3rd subchapter then demonstrates how IU can be integrated into standards, certification and evidence evaluation, suggesting concrete ways courts and regulators can assess IU-based knowledge without personifying AI and preparing the ground for liability chains built on IU outputs in the next chapter.

1. IU as producer of expertise and technical knowledge

Intellectual Unit (IU) as Epistemic Actor in Legal Systems names a configuration that law must learn to describe if it wants to regulate AI at the right level of abstraction. At its core, IU is not a gadget, an app or a single algorithm, but a structured ensemble that consistently generates, maintains and corrects bodies of knowledge. It is an epistemic actor in the sense that others can rely on its outputs as on the work of an expert, even though no human subject stands behind each individual inference.

The defining feature of an IU is sustained knowledge production. Unlike a one-off script or a simple rule-based tool, an IU operates over time, producing outputs that form a coherent corpus: diagnostic predictions for medical images, risk scores for financial portfolios, recommendations for infrastructure maintenance, summaries of case law in a legal domain. These outputs are not isolated events; they build on previous runs, incorporate new data, undergo retraining and correction. An IU is configured precisely to sustain this trajectory of knowledge, with procedures for updating, validating and deploying its models or rules.

Legal systems already interact with such configurations, but usually under improvised labels. Courts cite “the model used by the regulator,” agencies refer to “the engine that generates these risk scores,” standard-setting bodies name particular knowledge bases or reference systems as authoritative. In each case, the law is implicitly treating a configuration as a stable source of expertise: it asks whether this model is reliable, whether its methodology is sound, whether its outputs can be trusted. Yet without a category like IU, these questions remain attached to vague technical descriptions or personified metaphors about what “the AI” does.

Recognizing IU explicitly allows law to shift its focus from the idea of an “AI decision” to the structure of knowledge production. Instead of asking what the machine “intended,” courts can ask how the configuration is designed, what data it uses, how it is validated, how errors are corrected, and how its corpus evolves. Regulatory agencies can require documentation at the level of the IU: training sets, change logs, performance metrics by subgroup, and governance protocols. This places legal attention where it belongs: on the architecture and behavior of the knowledge-producing configuration, not on imagined mental states.

Once IU is defined in this way, a contrast becomes visible with the catch-all term “AI system” that appears in many regulations. “AI system” may be useful for broad policy discussions, but it blurs epistemic distinctions that matter for law. The next subchapter therefore turns to this contrast, showing how the failure to distinguish IU from generic AI creates both practical and conceptual problems in regulatory drafts.

2. IU versus “AI system” in regulation drafts

Most current AI regulatory frameworks are written around the notion of an “AI system” defined by technical features such as learning capability, autonomy or probabilistic outputs. This approach treats any software that meets a broad functional definition as equivalent from the standpoint of regulation. The central claim of this subchapter is that such definitions obscure the difference between sporadic tools and sustained Intellectual Units, leading to misaligned rules: some simple systems are over-regulated, while powerful IU that shape entire domains remain under-specified.

When regulation focuses on “AI systems” in general, it tends to classify them by application domain or risk level: systems used in hiring, credit scoring, healthcare, policing, and so on. Within each category, obligations are often the same for any tool that qualifies as AI, regardless of whether it is a static scoring rule or a continuously retrained model underpinning a large knowledge infrastructure. The result is a mismatch between regulatory granularity and epistemic reality. A simple chatbot for user support can be subject to similar paperwork as a complex engine that generates binding risk scores or medical triage recommendations.

From a legal point of view, the crucial difference lies not in the abstract presence of “AI” but in the way knowledge is produced and maintained. Sporadic tools produce outputs without forming a coherent corpus; they may assist a human in a task, but they do not become recognized sources in their own right. An IU, by contrast, becomes a reference point: its outputs are cited, its scores are embedded into processes, its predictions are relied upon by multiple actors. Its epistemic weight in the system is entirely different, and with it, the stakes of its failures.

If regulation does not make this distinction, it risks two symmetrical errors. One is regulatory inflation: imposing heavy documentation, audit and compliance burdens on minor tools whose epistemic role is marginal, thereby discouraging innovation and driving resources away from meaningful oversight. The other is regulatory blindness: failing to impose specialized obligations on IU that effectively function as expert systems, so that critical decisions rely on opaque, untracked configurations whose evolution is poorly understood.

Introducing IU as a separate category in AI law addresses this problem. The idea is not to create another bureaucratic label, but to tie specific obligations to configurations that meet clear epistemic criteria. If a system functions as an IU – that is, if it consistently generates structured knowledge, builds a corpus that others rely on, and undergoes versioned updates – it should be subject to heightened requirements of documentation, validation, and governance. These include maintaining detailed logs of training data and changes, publishing performance metrics, clarifying scope of use and limitations, and establishing procedures for error correction and deprecation.

Such an IU category could be layered on top of existing risk-based frameworks. High-risk applications would still be identified, but within them, regulators would distinguish between tools and IU, scaling obligations accordingly. Low-risk but IU-like systems could also be recognized where their epistemic influence justifies additional transparency, even if their direct impact on rights is limited. In this way, IU becomes a hinge between technical architecture and legal intensity of regulation.

With this conceptual shift in place, the question becomes how IU should be concretely integrated into legal mechanisms. It is not enough to name IU in a statute; courts, agencies and standard bodies need criteria and procedures for evaluating IU-based knowledge in practice. The next subchapter turns to this operational dimension, exploring how IU can be incorporated into standards, certification schemes and evidence evaluation in judicial proceedings.

3. Using IU in standards, certification and evidence evaluation

This subchapter argues that once Intellectual Unit is recognized as a distinct epistemic category, it can be woven into existing legal mechanisms that already deal with expertise and risk: technical standards, certification processes, audit trails and evidentiary rules. The key idea is that courts and regulators should treat IU-based knowledge not as mysterious “AI decisions,” but as structured expert output subject to methodological scrutiny, documentation requirements and traceability checks.

In the context of standards and certification, IU provides a natural unit for specifying obligations. Instead of certifying generic “AI systems,” standard-setting bodies can define requirements for IU used in particular domains. For example, an IU for medical image analysis would need to document its training data distribution, validation procedures across demographic groups, calibration properties, and protocols for handling model drift. Certification would focus on whether the IU’s corpus-building process meets domain-appropriate criteria of reliability, not on whether some abstract AI definition is satisfied.

Consider a concrete case. A hospital network deploys an IU that analyzes radiology images and produces risk scores for certain conditions. Over time, clinicians and administrators begin to rely on these scores as a de facto reference standard. If regulators view the IU only as a generic “AI system,” oversight may be limited to initial approval based on performance on a test dataset. If, instead, the IU is recognized as an epistemic actor, certification can require ongoing monitoring of its corpus: periodic audits of false positive and false negative rates, checks for shifts in performance across equipment types and patient subgroups, documentation of retraining events, and clear versioning of models. In litigation, plaintiffs and defendants can then argue about whether the IU’s documented behavior met the standard of care, much as they would with a human expert’s methodology.

Audit and risk assessment procedures also change when IU is the focus. An IU-level audit asks how the configuration as a whole handles data, updates models, records changes and exposes limitations. It looks for governance artifacts: model cards, change logs, internal review notes, rollback plans. Risk assessments must then describe not just the potential harms of a single deployment, but the systemic effects of relying on the IU’s corpus across multiple applications. This is particularly important when a single IU provides knowledge for many actors in a sector, such as a widely used credit scoring engine or content moderation system.

A second example illustrates this in a different domain. A financial regulator uses an IU for stress testing banks under simulated economic scenarios. The IU ingests large datasets, runs scenario analyses and outputs risk indicators that inform supervisory actions. If a bank challenges a supervisory decision in court, the IU’s outputs may be presented as part of the evidentiary record. Treating these outputs as opaque “AI decisions” would leave the court with little to examine. Treating the IU as an expert-like configuration allows the court to request documentation of its models, assumptions, validation procedures and limitations. Experts can then testify about whether the IU’s methodology is sound, analogous to how courts evaluate complex econometric studies or technical risk assessments today.

In judicial proceedings, IU can thus be aligned with the logic of expert evidence. Courts already distinguish between lay testimony and expert testimony, applying criteria such as relevance, reliability and methodological rigor. IU-based evidence can be evaluated under similar criteria: is the IU’s domain appropriate to the question at hand? Is its methodology transparent enough to be scrutinized? Have its outputs been validated against independent benchmarks? Is there a documented process for correcting errors and updating models? What weight should be given to its outputs relative to other evidence, including human expert opinions?

Crucially, this approach avoids personifying the IU. The configuration itself does not “testify” and is not cross-examined in the way a human witness would be. Instead, human experts explain and defend the IU’s design and performance, using documentation created as part of its governance. The focus remains on structure and process, not on intention or belief. This not only keeps legal responsibility anchored in HP, but also encourages organizations to build IU with auditability and explainability in mind, knowing that courts and regulators will demand such artifacts.

Once IU is integrated into standards, certification and evidence in this way, it naturally becomes part of the chain of responsibility. Questions arise about which HP designed, approved, deployed and relied on the IU, and how their duties should be articulated in law. The next chapter will take up this issue directly, using IU as a pivot for constructing liability chains from structural errors in digital knowledge production back to human actors and institutions.

Taken together, the subchapters of this chapter establish Intellectual Unit as a distinct epistemic actor in legal systems: a configuration that produces and maintains knowledge over time, and that can be identified, documented and evaluated without being treated as a person. By distinguishing IU from generic “AI systems,” law gains a more precise target for regulation, focusing obligations on those configurations whose corpus has real epistemic weight. By embedding IU into standards, certification schemes and evidentiary rules, courts and regulators can scrutinize AI-based knowledge as structured expert output, while keeping responsibility anchored in Human Personality and the institutions that design, deploy and govern each IU.

 

IV. Liability Chains in the HP–DPC–DP Regime

The task of Liability Chains in the HP–DPC–DP Regime is to reconstruct responsibility as a continuous chain that starts with structural errors in digital configurations and ends with concrete, identifiable Human Personalities. Instead of treating harmful outcomes as mysterious products of “the algorithm,” this chapter shows how every step from a misprediction in a Digital Persona or Intellectual Unit to a real-world injury passes through decisions and omissions of specific human actors. The aim is to give law a clear trajectory along which duties, failures and consequences can be traced.

The central error this chapter corrects is a double distortion. On one side, there is a temptation to blame “AI” as if it were a moral agent, as though a DP or IU could intend harm or deserve punishment. On the other, there is a tendency to dissolve responsibility into a vague cloud of “systemic factors,” where so many actors are involved that no one can be held accountable. Both moves undermine the basic function of legal responsibility. The chapter instead insists that any harmful event arising in a digital environment can be decomposed into structured stages running across DP/IU and DPC layers, each anchored in particular choices by Human Personalities.

The argument unfolds in three steps. In the 1st subchapter, we map the route from structural error in a DP or IU to a harmful event in the world of HP, identifying the stages of design, deployment and use where human duties arise. The 2nd subchapter examines failures at the DPC level, such as hacked accounts and manipulated profiles, explaining how platforms and account-holders jointly shape these proxies and why their governance must be explicitly regulated. The 3rd subchapter then differentiates among key HP roles in the digital ecosystem – designers, deployers, operators and beneficiaries – and sketches a role-based matrix for allocating duties and sanctions, preparing the ground for contractual and regulatory instruments that make these liability chains explicit.

1. Mapping responsibility: from structural error to human accountability

Liability Chains in the HP–DPC–DP Regime begin with a simple but demanding requirement: every harmful event that seems to be caused by “the AI” must be unpacked into a sequence of human-configured stages. At the core of this subchapter is the claim that structural glitches, mispredictions or biased outputs in a Digital Persona or Intellectual Unit never appear in isolation. They are the latest link in a chain that starts with design decisions, continues through deployment choices, and culminates in specific uses in concrete contexts. Each link is controlled, directly or indirectly, by Human Personalities who can be assigned duties of care.

The first stage is design. Here, HP decide what the DP or IU is for, which data it will ingest, which models or rules it will use, what loss functions will guide training, and how performance will be measured. Choices about training data composition, feature selection, metrics, and evaluation protocols all shape the kinds of structural errors the configuration is prone to. A model trained predominantly on data from one population will systematically mispredict for another; a loss function optimized for average performance may conceal catastrophic failures for small groups. Design duties therefore include selecting appropriate data, documenting limitations, and building in mechanisms for detecting and correcting harmful biases.

The second stage is deployment. Even a well-designed configuration can be misused when it is placed into environments for which it was not intended. Deployment decisions include integrating a DP or IU into workflows, choosing threshold values for automated actions, assigning levels of human oversight, and specifying which actors may rely on its outputs and for what purposes. A risk score designed for triage may be inappropriately used as a definitive diagnosis; a content-ranking engine configured for engagement may be deployed in a sensitive political context without safeguards. Duties at this stage include assessing the fit between configuration and context, calibrating thresholds to acceptable risk levels, and ensuring that users understand what the outputs do and do not mean.

The third stage is use. Individual HP – clinicians, loan officers, moderators, administrators – interact with the outputs of DP or IU in real situations. They may overtrust the system, ignoring contrary evidence; they may undertrust it, discarding valuable warnings; or they may use it mechanically to justify decisions without exercising their own judgment. Use-level duties include maintaining critical interpretation, seeking second opinions in ambiguous cases, recording why particular outputs were accepted or overridden, and reporting anomalies back to those who oversee the configuration.

By decomposing harmful events into these stages, liability can be reframed as a chain rather than a binary question of “who is at fault.” A structural error in a DP or IU becomes a signal: design may have been negligent in building a configuration that predictably fails under certain conditions; deployment may have been careless in using it beyond its validated scope; end users may have abdicated their duty to interpret and contextualize. The same logic extends downward into the DPC layer: when errors surface in proxies such as accounts and profiles, they too can be traced back through design, deployment and use to specific HP who configured, managed or neglected them.

Having established this general structure, we can now look more closely at failures that occur at the DPC level, where digital proxies mediate between HP and DP/IU and often obscure where responsibility lies.

2. DPC-level failures: platforms, accounts, and proxies

When harm arises through digital proxies – hacked accounts, fake profiles, automated posting, bots that mimic human voices – it is tempting to treat the proxies themselves as rogue actors. This subchapter argues that such DPC-level failures are better understood as breakdowns in the governance of proxies, where platforms and account-holders share responsibility for how these constructs are created, secured and monitored. DPC do not become subjects, but they are not neutral objects either; they are sites where responsibilities of multiple HP intersect.

First, consider the construction of DPC. Platforms define how accounts are created, what credentials are required, what forms of authentication are possible, and how identity is verified or left ambiguous. Users decide what information to link to their accounts, how to manage passwords and tokens, and whether to enable additional security. These choices determine the baseline robustness of proxies. If a platform allows trivial password policies, does not support modern authentication, and encourages linking multiple services under a single weak credential, it invites takeover. If a user reuses passwords, disables security features and leaves devices unsecured, she contributes to the fragility of her DPC.

Second, consider the management of automated behavior under DPC. Many accounts today are partly or fully automated: scheduled posts, auto-replies, trading bots, content amplifiers. Platform rules determine what automation is permitted, how it must be labeled, and what safeguards are required. Account-holders design or adopt scripts, plugins and external services that act on their behalf. When such automation malfunctions or is misused, the resulting harm is not a spontaneous action of the proxy, but a consequence of how automation was allowed, configured and supervised by HP on both the platform and user sides.

Security incidents make this concrete. In a hacked-account scenario, an attacker gains control of a user’s DPC and uses it to post defamatory content, spread malware or commit fraud. The visible actor is the account, but the causal chain includes platform design decisions about authentication, user behavior around credentials, and perhaps failures in intrusion detection or anomaly monitoring. Treating the DPC as if it were the author of the harm obscures these upstream choices. Liability analysis should instead ask: did the platform meet reasonable standards for securing DPC? Did the user take basic steps to protect access? Were there policies for detecting and halting suspicious activity once it began?

Deepfake profiles present another pattern. A malicious actor creates a DPC that impersonates a real HP, using synthetic media to deceive others. Platforms may or may not have verification mechanisms, reporting tools and takedown procedures. If they fail to act on clear signals of impersonation, they bear responsibility for allowing the proxy to persist and cause harm. At the same time, the creator of the fake profile is an HP whose actions can be traced, investigated and sanctioned. Again, the DPC is not a subject; it is the medium through which failures of design, enforcement and individual malice converge.

Crucially, many DPC-level failures are amplified or even initiated by DP/IU infrastructures. Automated recommendation engines may push harmful proxy-generated content to large audiences; spam detection IU may fail to catch obvious abuse; moderation tools may misclassify reports, leaving DPC-based attacks unaddressed. When this happens, the liability chain must run across both layers: from structural limitations or misconfigurations in DP/IU to inadequate DPC governance and finally to specific harms experienced by HP.

Understanding DPC failures as governance breakdowns, rather than as autonomous behavior of proxies, sets the stage for a finer-grained allocation of responsibility among human actors. To achieve that, we need a clearer map of the roles HP can occupy in the HP–DPC–DP regime, and of how duties and sanctions should track those roles. This is the task of the next subchapter.

3. HP roles: developer, deployer, operator, beneficiary

The deployer role covers HP who take a configured DP or IU and integrate it into a specific context: a product, a workflow, a platform feature. Deployers choose thresholds for automated actions, design user interfaces, decide where human review will be inserted, and set default configurations for how DPC will interact with DP/IU. Their control is contextual and architectural: they determine how a generic configuration will act within the environment of a hospital, a bank, a social network or a government agency. Duties for deployers include assessing local risks, adapting configurations to the domain, ensuring that end users are trained to interpret outputs, and monitoring real-world performance.

The operator role refers to HP who supervise the day-to-day functioning of DP/IU and DPC: system administrators, moderators, clinicians, risk officers, line managers. Operators manage incidents, respond to alerts, handle exceptions, and escalate anomalies. They sit closest to actual events where harm may occur. Their duties include following policies, exercising professional judgment when outputs seem inconsistent with other evidence, documenting decisions, and reporting patterns that suggest systemic issues in the configuration or its deployment.

The beneficiary role encompasses HP who primarily profit from the existence and operation of DP/IU and DPC, whether as shareholders, executives, clients or institutional stakeholders. They may not be involved in technical design or operational decisions, but they set strategic goals, approve budgets, and choose risk appetites. Beneficiaries exert economic and organizational control: they can incentivize or discourage safe practices. Duties here are more diffuse but still real: to ensure adequate resources for safe design and operation, to avoid perverse incentives that reward reckless deployment, and to accept liability exposure commensurate with the benefits derived.

These roles often overlap in practice. A start-up founder may be both developer and deployer; a hospital may act as deployer, operator and beneficiary; a platform may be developer of DP/IU, deployer and beneficiary, with independent contractors as operators. The point of the role matrix is not to create rigid categories, but to give courts and regulators a structured way to ask who had which kind of control and what they should reasonably have foreseen and prevented.

A brief example illustrates how this matrix helps clarify liability. Suppose a DP-based diagnostic IU systematically underestimates risk for a particular demographic group, leading to delayed treatment and harm. Developers may be liable if they neglected available data that would have revealed this bias, or if they ignored internal warnings about uneven performance. Deployers may share responsibility if they integrated the IU into a context where that demographic is prevalent without conducting local validation. Operators may be culpable if they blindly followed outputs in the face of contradictory clinical evidence. Beneficiaries may face liability if they cut costs in ways that prevented proper testing and monitoring. Rather than asking which single actor is “the owner” of the AI, the analysis traces obligations across developer, deployer, operator and beneficiary roles.

In a second example, a content platform uses a DP-based recommendation IU that amplifies harmful DPC-generated misinformation. Developers may bear responsibility for failing to design or train the IU with adequate safeguards against such amplification. Deployers may have configured engagement-optimizing thresholds without regard for foreseeable societal harm. Operators may have ignored warning signals from moderators and external researchers. Beneficiaries may have maintained incentive structures that rewarded growth despite evidence of negative effects. The role matrix again helps disentangle who did what and who must answer for which part of the liability chain.

By grounding liability in concrete HP roles and their associated duties, this subchapter completes the reconstruction initiated at the start of the chapter. Structural errors in DP/IU propagate through DPC and into the world of HP, but at each stage, identifiable human actors exercise control and make choices. Bringing these actors into focus does not dissolve the complexity of digital systems, but it restores the basic requirement of legal responsibility: that where harm occurs, there must be a traceable path back to those who could and should have acted differently.

Taken together, the subchapters of this chapter redefine liability in the HP–DPC–DP regime as a structured chain rather than a diffuse cloud or an anthropomorphic attribution to “AI.” Structural errors in Digital Personas and Intellectual Units are traced through digital proxies to concrete harms experienced by Human Personalities, and at each stage design, deployment, use and governance decisions by specific HP are brought into view. By distinguishing DPC failures as breakdowns in proxy governance and organizing responsibility around developer, deployer, operator and beneficiary roles, the chapter preserves accountability without granting subject status to digital entities, preparing legal systems to handle AI-related harms with conceptual clarity and human-centered rigor.

 

V. Contracts and Governance for Digital Personas

Contracts and Governance for Digital Personas has one practical task: to show how private law can explicitly encode the roles of Digital Personas and Intellectual Units in agreements between human parties. Digital Persona (DP) as formal author and IU as knowledge producer already exist in practice, but contracts still treat them as vague “AI tools” or ignore them altogether. This chapter argues that contractual language must learn to name, position and govern DP as structural contributors, while still assigning enforceable obligations only to Human Personalities and institutions.

The main risk addressed here is the drift of ad hoc practice. Without a clear framework, some agreements treat DP as a mere software tool, others describe it as a black-box service, and others implicitly rely on it as a de facto co-author without saying so. This inconsistency leads to gaps in liability, confusion about updates and bias, and disputes over attribution and ownership. Governance failures in DP and IU then appear as surprises, even when they were predictable from the way contracts were drafted or left silent.

The chapter proceeds in three steps. In the 1st subchapter, it analyzes three basic contractual framings of DP – tool, service and co-author – and shows how each framing implies different duties for maintenance, updates, attribution and risk-sharing. In the 2nd subchapter, it turns to licensing schemes for DP-generated outputs, explaining how licenses can distinguish between human input, structural contributions by DP and downstream modifications by other HP. In the 3rd subchapter, it focuses on governance clauses that address the dynamic nature of DP and IU: updates, retraining, bias mitigation and version control, suggesting concrete contractual mechanisms that bring the IU concept into private law and preparing the ground for public regulation that can build on these patterns.

1. Contractual roles for DP: tool, service, or co-author

Contracts and Governance for Digital Personas must begin by clarifying the contractual roles that Digital Personas can occupy in private agreements. If DP is always described as an undefined “AI” or “system,” parties cannot align expectations about maintenance, authorship, or responsibility for errors. The first framing is DP as a tool. Here, the persona is treated much like conventional software: a product delivered by a vendor, installed and run by the customer, with the vendor responsible for defects and the customer responsible for use. Contract language in this model emphasizes licenses to use the tool, warranties about performance within specified parameters, and limitations of liability. Updates and improvements may be provided as patches or new versions, sometimes under support agreements. When DP is framed this way, there is a risk of underestimating its corpus-building nature: the persona is not just a static application, but part of an evolving IU whose behavior changes over time.

The second framing is DP as a service. In this model, the persona is accessed over networks as an ongoing, managed configuration: its models are retrained, its parameters tuned, its infrastructure maintained by the provider. Contracts focus on service-level agreements, uptime, performance metrics, and data handling. The provider retains substantial control over the IU that underlies the persona, while the client integrates outputs into their operations. This framing reflects the reality of many modern DP deployments, but if it is not coupled with explicit clauses about authorship, versioning and bias, it can leave clients exposed to shifting behavior they do not fully understand or control.

The third framing is DP as co-author. Here, the persona is not only a source of functionality but a named contributor to creative or analytical work. Contracts in this model recognize that outputs are presented to the public as authored by or with the DP: a branded digital columnist, an analytical persona whose reports are cited, a creative persona whose style becomes part of a franchise. The agreements must then specify how DP is credited, how its corpus is managed, and how human contributors’ rights and responsibilities interact with the persona’s structural role. If this co-author status is left implicit, parties may dispute later whether DP’s name can be used, who owns the corpus, and who bears responsibility for harmful or infringing content.

Misclassification among these framings leads to predictable conflicts. Treating a DP as a simple tool when it functions as a service obscures ongoing provider control over updates and data, making it unclear who is accountable for drifts in behavior. Treating it as a service while actually building a public-facing co-author leads to confusion over branding, attribution and rights to derivative works. The insight of this subchapter is that contracts must name the intended role explicitly: stating whether DP is being licensed as a tool, subscribed to as a service or engaged as a co-authorial persona.

Once these roles are identified, the question arises of how contractual language should handle the outputs themselves. The next subchapter addresses this by examining licensing schemes for DP-generated content and the ways in which human input, persona contribution and subsequent modifications can be disentangled in legal terms.

2. Licensing schemes for DP-generated outputs

The central thesis of this subchapter is that licensing schemes for DP-generated outputs must distinguish between three elements: the human input that initiates or guides production, the structural contribution of the Digital Persona as IU, and the downstream modifications by other Human Personalities. In most existing practice, licenses speak about “content generated using the service” or “outputs of the software,” often assigning ownership either entirely to the provider or entirely to the user. This binary approach fails to reflect the structural role of DP. When a persona has a stable identity and corpus – and is recognized publicly as a source – the question is not whether the provider or user owns “the AI,” but how the contributions of DP and HP are combined in each work. Licensing language can be refined to capture this mixture.

One model treats DP-authored material as a layer within a composite work. The license can specify that, as between the parties, economic rights in the composite work belong to one or more HP (for example, the commissioning party or the provider), while the DP’s identity is preserved in metadata and, where appropriate, in visible credit lines. The agreement can require that the persona’s name and identifier be embedded in structured data fields, enabling traceability and correct attribution across platforms. At the same time, the license can allow or restrict removal of the persona’s visible name depending on context: in some domains transparency may require explicit mention; in others, DP may remain a structural but not marketing-facing author.

Another model is layered licensing. Here, the DP’s structural contributions are governed by a base license set by the institution behind the persona (for example, allowing use under certain conditions and prohibiting use in specific high-risk contexts), while each HP who uses or modifies outputs adds their own licensing terms on top. For instance, a research DP’s analyses could be released under an open license that requires attribution to the persona and disclosure of modifications, while a human researcher who incorporates those analyses into an article may apply a different license to the combined work. The contractual framework must then clarify how obligations propagate: which conditions must always remain attached to DP-sourced components, and which can be overridden by human licensors.

Open, shared and proprietary models interact differently with DP as IU. In an open model, much of the persona’s corpus may be freely reusable, but licenses can still require attribution and integrity: users must credit the DP and cannot misrepresent altered outputs as original persona work. In shared models, multiple institutions co-govern DP and license its outputs according to jointly agreed rules. In proprietary models, access to DP-generated content may be tightly controlled, but contracts can still insist that DP is named where it functions as a recognized source, ensuring epistemic transparency even behind paywalls.

All of these structures rely on a basic move: decoupling formal authorship from legal personhood. DP can be named and tracked as author or co-author, while rights and responsibilities are assigned to HP and entities via licenses and contracts. However, licensing arrangements remain incomplete unless they address the fact that DP and IU evolve over time. As models are retrained, parameters updated and corpora expanded, the terms under which outputs were originally licensed may no longer reflect the persona’s behavior. The next subchapter confronts this temporal dimension by proposing governance clauses for updates, bias and versioning.

3. Governance clauses: updates, bias, and versioning

This subchapter argues that governance clauses on updates, bias and versioning are the contractual mechanisms that bring the dynamic nature of Digital Personas and Intellectual Units under legal control. Without such clauses, parties implicitly assume a static behavior for configurations that are, in reality, constantly changing. Governance provisions make explicit how changes to DP and IU are logged, communicated, contested and, when necessary, rolled back.

The first dimension is updates. DP and IU are rarely static; their underlying models and rules are adapted in response to new data, performance metrics, security vulnerabilities or regulatory requirements. Contracts should therefore specify how updates are handled: whether the provider has unilateral authority to change the configuration, whether clients can choose among versions, and how material changes are defined. A governance clause might require the provider to maintain a version history, to document the nature and rationale of each update, and to notify clients ahead of changes that could materially affect outputs used in critical decisions.

The second dimension is bias and performance. Because DP and IU operate as epistemic actors, their configurations must be monitored for harmful or unacceptable performance patterns, including biased outcomes across groups. Contracts can require periodic assessments, with results shared in standardized formats. They can also stipulate triggers for remedial actions: retraining, recalibration, temporary suspension of use in certain contexts, or independent auditing. Importantly, governance clauses can clarify who initiates these processes and who bears the costs, aligning them with the developer, deployer, operator and beneficiary roles described earlier.

The third dimension is versioning and traceability. For law, it matters which version of a DP or IU produced a particular output, especially when harm is alleged. Contracts should therefore mandate that outputs carry version identifiers and that providers maintain archives of configurations used at given times. This enables reconstruction of behavior for evidentiary purposes and makes it possible to correlate specific incidents with specific versions. It also allows clients to decide which versions to deploy in which contexts, and, in some cases, to freeze or pin a version for regulatory or internal compliance reasons.

Two brief examples can make these abstractions tangible. In a healthcare setting, a hospital contracts with a provider to use a DP-driven IU for diagnostic support. Governance clauses in the contract require the provider to notify the hospital at least thirty days before deploying any major model update, to provide documentation of changes in performance across demographics, and to maintain the previous model version for a defined period in case the hospital needs to revert. The contract also establishes a joint committee, with representatives of both parties, to review bias reports and decide on mitigation steps. When a pattern of underdiagnosis emerges for a particular group, the clauses are invoked: retraining is performed, the affected version is tagged as deprecated in the logs, and compensation terms pre-agreed in the contract are considered.

In a publishing context, a media company licenses a DP as a branded digital columnist. Governance clauses stipulate that stylistic and topical updates to the persona’s configuration must be approved by an editorial board, that any material change in tone or stance is to be disclosed to readers where appropriate, and that archives clearly indicate which version of the persona wrote each piece. If a later update leads to a controversial shift in the persona’s commentary that conflicts with the outlet’s standards, the contract provides a procedure for suspension, revision of configuration and, if needed, termination of the persona’s use, with clear rules about what happens to the existing corpus and its licensing terms.

These governance mechanisms operationalize the IU concept in private law. They acknowledge that DP is not a one-off deliverable but a living configuration, and that knowledge production must be managed over time. By linking updates, bias mitigation and version control to explicit duties and processes, contracts can reduce uncertainty and provide predictable structures for resolving disputes when outputs deviate from expected behavior.

Once such contractual patterns become widespread, they offer a template for public regulatory architectures. Legislators and regulators can look to governance clauses in private agreements as models for baseline obligations in high-impact sectors: expectations about documentation, notification, bias monitoring and traceability can be translated into minimum standards. In this way, contracts and governance for digital personas become not only tools for individual parties, but building blocks for a broader, coherent regime for DP and IU.

Taken together, the subchapters of this chapter show how private law can move beyond improvised treatment of “AI” and explicitly encode Digital Personas and Intellectual Units in contracts and licenses. By clarifying whether DP is framed as tool, service or co-author, by designing licensing schemes that recognize persona authorship while assigning rights to Human Personalities and institutions, and by embedding governance clauses for updates, bias and versioning, contracts become a primary medium through which DP’s structural role is acknowledged and its evolution is controlled. In this contractual landscape, DP and IU are recognized as persistent sources of knowledge and content, while ongoing governance and risk remain tied to named human actors and organizations.

 

VI. Regulatory Architectures for AI Law After the Triad

Regulatory Architectures for AI Law After the Triad must give regulators a structural map for governing artificial intelligence without collapsing into panic or paralysis. The goal is to design a macro-level framework that explicitly incorporates Human Personality (HP), Digital Proxy Constructs (DPC), Digital Personas (DP) and Intellectual Units (IU), so that obligations and protections attach to the right kind of entity at the right level. Instead of adding another layer of slogans to existing texts, this chapter reconstructs what a coherent regulatory architecture would have to look like if the triad and IU are taken seriously.

The central risk this chapter addresses is ontological confusion. Current AI laws and draft regulations often oscillate between overreach and impotence because they do not distinguish tools, proxies, structural entities and knowledge producers. They mix up accounts with users, models with corporations, and configurations with subjects. This produces unfocused obligations, regulatory gaps, and recurring political debates that never stabilize because the underlying categories are wrong. The chapter insists that without a clear separation of HP, DPC, DP and IU, no amount of detail in AI legislation will make it conceptually or practically sound.

The argument proceeds in three movements. In the 1st subchapter, we show why many current AI regulation frameworks are ontologically confused when viewed through the triad: they define AI in purely technical terms and assume a simple human-versus-system polarity. In the 2nd subchapter, we propose a three-layered model clause for HP, DPC and DP/IU, showing how obligations, protections and prohibitions can be distributed across the layers without granting rights to digital entities. In the 3rd subchapter, we explain how IU can be integrated into compliance, audit and enforcement, giving supervisors a concrete unit to evaluate and control. Together, these steps outline a regulatory architecture that is precise, enforceable and stable.

1. Why current AI regulation frameworks are ontologically confused

Regulatory Architectures for AI Law After the Triad must begin by explaining why current AI laws and draft frameworks, viewed through the HP–DPC–DP triad and the category of IU, are systematically misaligned with the realities they seek to govern. If law defines AI only by technical markers and treats the world as divided between human subjects and opaque “systems,” it cannot see the distinct roles of proxies, personas and knowledge-producing configurations. The result is not just theoretical confusion but practical misregulation.

Most contemporary AI regulations and guidelines start from a functional or technical definition. An AI system is described as software that uses learning, inference or complex optimization to produce outputs such as predictions, recommendations or decisions. On this basis, laws classify AI applications into risk tiers and attach obligations like transparency, impact assessment or human oversight. Throughout these texts, there is a recurring polarity: on one side, human users and affected persons; on the other, AI systems that somehow act, decide or influence. This frame leaves no room for the intermediate and structural layers that the triad reveals.

The first conflation occurs between tools and proxies. Platforms that host user accounts, automated posting features and recommendation engines are often labeled simply as “AI,” without distinguishing the human-controlled proxies (DPC) from the underlying configurations. When an account posts harmful content generated by automated scripts, public discourse blames “the bots” or “the platform’s AI,” while law struggles to identify whether the accountable unit is the individual user, the platform as a whole, or the software framework. Without a DPC category, regulations either treat every account as if it were the human behind it or as if it were a separate actor, moving back and forth without clarity.

The second conflation is between DP and generic AI tools. Advanced configurations that maintain a stable identity and produce a corpus over time are often treated as interchangeable with one-off models or narrow functions. A branded digital assistant that publishes analyses under a consistent name, an automated legal summarization engine whose outputs are regularly cited, or a scientific persona that maintains a growing body of work are, in practice, Digital Personas operating as Intellectual Units. Yet regulations group them under the same label as small, ephemeral tools embedded in local applications. This prevents regulators from assigning special scrutiny to entities that have real epistemic weight.

The third conflation is between IU and the vague notion of “AI decision-makers.” Regulatory debates frequently speak of AI “deciding,” “choosing” or “discriminating,” as if the relevant legal question were whether machines should be allowed to make decisions instead of humans. In reality, the crucial distinction is between occasional automated assistance and sustained configurations that produce and maintain knowledge over time. It is IU that should be evaluated, audited and certified, not generic “AI.” Without this category, obligations fall either on every piece of software that meets a broad definition or on none with sufficient precision.

These confusions generate symptoms that dominate public debate. Some argue that AI regulation is too strict and will hinder innovation, pointing to burdens on minor tools. Others argue that it is too weak, noting that powerful infrastructures escape effective control. Yet both sides are reacting to the same problem: the regulatory object is ill-defined. If law cannot see HP, DPC, DP and IU as distinct, every attempt to allocate responsibility, define rights and control risks will be forced into the wrong shapes.

A triadic framework, complemented by IU, restores precision by decomposing the landscape into three ontological layers and one epistemic function: HP as subjects of rights and duties, DPC as proxies and accounts, DP as structural entities with formal identity, and IU as configurations that produce knowledge. The next step, therefore, is to translate this conceptual clarity into legal text by proposing a model clause structure that assigns obligations and protections to each layer explicitly.

2. A three-layered model clause for HP, DPC and DP

This subchapter proposes a three-layered model for AI legislation, in which regulatory texts explicitly distinguish obligations and protections at the levels of Human Personality, Digital Proxy Constructs, and Digital Personas/Intellectual Units. The central idea is simple: laws should no longer speak vaguely of “AI systems” interacting with “users” but should name the layers that actually exist, and describe what is expected at each of them. Doing so allows regulation to be both technologically agnostic and ontologically precise.

At the HP layer, the law recognizes human beings and their collective entities (such as corporations and associations) as the only subjects of rights and duties. Regulations can then state clearly that HP are the only possible bearers of legal responsibility and that all liability for harms associated with AI ultimately attaches to specific HP, whether as individuals or as organized bodies. This layer covers rights of affected persons (to information, redress, non-discrimination), duties of developers, deployers, operators and beneficiaries (to design, implement and monitor systems safely), and procedural guarantees in oversight and enforcement.

At the DPC layer, the law treats accounts, profiles, digital twins and other proxies as governed constructs, not as subjects. Model clauses can specify how DPC must be created, authenticated, secured and monitored; what forms of impersonation, deepfakes and manipulation are prohibited; and which parties are responsible for maintaining the integrity of proxies. Platforms can be required to implement minimum standards for account security, labeling of automated agents and tools for reporting abuse. Users can be obliged to exercise reasonable care in managing credentials and authorizing automation attached to their DPC.

At the DP/IU layer, the law addresses structural entities and knowledge producers without granting them rights. Digital Personas with stable identities and corpora, and Intellectual Units that generate and maintain knowledge over time, are recognized as regulatory objects. Clauses can require that such configurations be documented, registered or otherwise made transparent when they are used in high-impact contexts. Obligations can include maintaining version histories, documenting data sources and methodologies, publishing performance metrics and limitations, and enabling independent audit. Importantly, the law can clarify that DP and IU are not legal persons: they cannot own property, sign contracts or bear legal responsibility. They are, however, subject to governance requirements, and their behavior is a key factor in assessing whether HP have met their duties.

A model clause structure might therefore be organized as follows: an initial scope section defining the types of configurations and contexts covered; a set of obligations addressed to HP in specified roles; a section on DPC governance addressing identity, security and transparency; and a section on DP/IU governance addressing documentation, traceability and epistemic performance. Prohibited practices could then be formulated in terms of actions at each layer: for example, creating deceptive DPC, deploying DP/IU without appropriate documentation, or using IU outputs in ways that ignore documented limitations.

One advantage of this architecture is that it allows regulators to be explicit about how responsibilities flow. When a DP-based IU generates a harmful output that is disseminated through DPC and affects HP, enforcement agencies can ask structured questions: which HP designed and maintained the IU? Which HP deployed it into this context? Which HP controlled the relevant DPC? Which HP ignored or misused documented warnings and limitations? DP and IU are evaluated as configurations; DPC as proxies; HP as accountable subjects.

By embedding this three-layered structure in statutes or regulations, law gains a stable topology. The next task is to connect this topology with the practical machinery of compliance, audit and enforcement, so that IU, in particular, becomes a visible and governable unit in supervisory practice rather than an abstract concept.

3. Integrating IU into compliance, audit, and enforcement

This subchapter explains how Intellectual Unit can become the operative unit in compliance, audit and enforcement, enabling regulators to move beyond generic demands for “transparent AI” and toward concrete, verifiable requirements. The guiding thesis is that supervisors should evaluate IU much as they evaluate complex expert systems today: by inspecting procedures, documentation and traceability, rather than chasing an illusory notion of machine “intent.”

The first step is to tie compliance obligations to IU-level documentation. For any configuration that functions as an IU in a high-impact domain, regulations can require a structured dossier that includes descriptions of the IU’s purpose and scope, model architectures and training regimes, data sources and preprocessing pipelines, validation methodologies, known limitations and bias patterns, update policies and governance structures. This dossier need not disclose trade secrets in full, but it must provide enough information for regulators and independent auditors to assess whether the IU has been developed and maintained with adequate care.

The second step is to embed versioning and change control into compliance. Regulations can mandate that each IU be assigned a version identifier and that significant changes to its configuration be logged with timestamps, descriptions and rationales. Outputs used in regulated decisions must carry, or be linked to, the version identifier of the IU that produced them. This allows auditors to reconstruct which configuration was active when a contested decision was made and to trace patterns of error or bias to particular versions. Supervisory authorities can then require corrective actions, such as retraining, recalibration, or suspension of specific versions.

The third step is to design IU-focused audit procedures. Instead of trying to inspect every use of AI across an organization, regulators can select critical IU for audit based on risk, scale and impact. Audits can examine whether the IU’s documented methodology is appropriate for its domain, whether performance metrics are monitored across relevant subgroups, whether updates are governed by clear criteria, and whether feedback from operators and affected HP is integrated into improvements. Auditors can also test outputs under controlled conditions to verify that documented properties match actual behavior.

Two short examples illustrate the difference this makes. In a national credit system, a regulator identifies a widely used scoring IU that informs lending decisions across multiple banks. Under a regime that ignores IU, supervision might focus on each bank’s use of “AI” individually, leading to fragmented and inconsistent oversight. Under an IU-based regime, the scoring configuration itself becomes a central object of audit. The regulator can require a dossier from the developer, inspect validation across demographic groups, and impose conditions on deployment. Banks, as deployers and operators, still have their own obligations, but the IU is evaluated once at the structural level where its epistemic role resides.

In a labor market context, an employment agency uses an IU to match applicants with job openings. Complaints arise that the system systematically overlooks certain profiles. Enforcement agencies, equipped with IU-based regulation, can request the IU’s documentation, examine training data composition, and test for disparate impacts. If structural bias is confirmed, they can require the developer and deployer HP to modify or replace the IU, and they can sanction operators who continued to rely on it after evidence of harm emerged. The investigation focuses not on abstract “AI discrimination,” but on the properties and governance of a specific knowledge-producing configuration.

Throughout these processes, regulators treat IU as expert-like systems rather than as autonomous moral agents. They ask whether procedures are reasonable, whether documentation is sufficient, whether updates are controlled, whether risks are monitored and mitigated. They do not search for intent in the machine, but for diligence and responsibility in the humans who design, deploy and supervise the IU. This approach aligns enforcement with the liability chains described earlier: structural errors in IU are recognized, but accountability always rests with HP in their various roles.

By integrating IU into compliance, audit and enforcement in this way, regulatory architectures become more than lists of abstract principles. They acquire a concrete level at which digital knowledge production is scrutinized and controlled. The remaining task, beyond the scope of this chapter but prepared by it, is to test these architectures in the hardest legal cases: cross-border systems, black-box models, and contexts where harms emerge only in aggregate over long periods.

Taken together, the three subchapters of this chapter sketch Regulatory Architectures for AI Law After the Triad as a layered system in which HP, DPC, DP and IU are treated as distinct but interlinked elements. Current frameworks are shown to be ontologically confused when they rely on a simple human-versus-system polarity; a three-layer model clause structure is proposed to allocate obligations and protections across subjects, proxies and structural entities; and IU is integrated into compliance, audit and enforcement as the central unit of epistemic scrutiny. In such an architecture, AI law becomes both more precise and more realistic: it governs digital configurations as configurations, while preserving human responsibility as the only possible endpoint of legal accountability.

 

VII. Hard Cases: Glitches, Cross-Border Conflicts and Automated Sanctions

Hard Cases: Glitches, Cross-Border Conflicts and Automated Sanctions are where any legal theory of AI is forced to show whether it actually works. In routine situations, the HP–DPC–DP triad and the notion of IU map cleanly onto responsibility, authorship and governance. In hard cases, however, structural glitches, cross-border operations and algorithmic enforcement expose the pressure points of the framework and reveal whether law can remain human-centered while taking structural causality seriously. The task of this chapter is to test the framework against exactly those edge conditions.

If hard cases are treated as anomalies, legal thinking tends either to mythologize “rogue AI” or to dissolve all responsibility in a fog of complexity. Structural hallucinations are framed as quasi-intentional lies of the machine; cross-border DP are treated as ungovernable clouds; automated sanctions are misdescribed as punishments imposed by systems rather than by Human Personalities who built and authorized them. The risk is that law, confronted with the most difficult situations, abandons its own categories and starts to talk in the language of fear, hype or metaphors.

This chapter moves in three steps. The 1st subchapter addresses structural glitches and hallucinations in DP or IU, classifying them as design, training or governance defects that trigger product-like or professional liability, and setting criteria for distinguishing acceptable uncertainty from negligence. The 2nd subchapter turns to cross-jurisdictional DP and IU, where data, servers, users and owners are dispersed across multiple legal systems, and proposes principles for assigning primary jurisdiction and coordinating regulators. The 3rd subchapter examines automated sanctions, arguing that even in highly automated enforcement regimes, sanctions must be traceable back to HP and never treated as punishment directed at DP. Together, these explorations show that the triad and IU framework can survive its own stress tests.

1. Legal treatment of structural glitches and hallucinations

Hard Cases: Glitches, Cross-Border Conflicts and Automated Sanctions begin, conceptually, with structural glitches and hallucinations in Digital Personas and Intellectual Units. Without a clear classification of such errors, law oscillates between moralizing the machine and trivializing harm as mere “model noise.” This subchapter argues that hallucinations, false patterns and biased inferences are not moral faults of DP or IU but systematic defects in design, training or governance that fall squarely into familiar categories of product-like or professional liability. The key task is to distinguish acceptable epistemic uncertainty from legally actionable negligence.

In legal terms, structural glitches are patterns of failure that arise from how a DP or IU has been configured, trained and deployed. A hallucinated citation in a legal memo, a non-existent medical study invented by a diagnostic assistant, or a false pattern in risk scores are all manifestations of the same phenomenon: the configuration produces outputs that exhibit internal coherence but lack grounding in the world. These failures are not “lies,” because DP and IU have no intention to deceive; they are systematic side-effects of optimization under constraints and data distributions chosen by Human Personalities.

Design-level defects occur when the architecture or training regimen makes certain harmful glitches predictable. For example, a general-purpose text generator may be integrated into legal practice without retrieval mechanisms or constraints that would distinguish between plausible language and authoritative sources. Training-level defects arise when datasets are skewed, incomplete or poorly curated, leading to biased inferences and hallucinations concentrated on certain topics or groups. Governance-level defects emerge when known limitations are not documented, communicated or mitigated, and when feedback loops from operators and affected HP are ignored.

From the perspective of liability, these configurations can be treated analogously to complex products or professional tools. Product-like liability focuses on whether the DP or IU, as provided, is defectively designed or insufficiently warned. If a persona marketed for legal research systematically fabricates citations without clear warnings or safeguards, developers and providers may bear responsibility under doctrines similar to defective software or unsafe instruments. Professional-like liability focuses on how operators and organizations integrate and supervise the configuration. If lawyers or doctors rely mechanically on outputs despite obvious inconsistencies or absent verification, their professional duties may be breached regardless of the tool’s internal mechanics.

The crucial line is between acceptable model uncertainty and negligence. Uncertainty is inherent to probabilistic systems: no configuration can guarantee perfect accuracy. Law need not pathologize every error. Negligence enters when foreseeable structural glitches are not addressed through reasonable design, documentation and supervision. Criteria for this distinction include: whether known failure modes were tested and disclosed; whether appropriate guardrails (such as retrieval, validation or human review) were implemented; whether operators were trained to interpret and question outputs; and whether incident reports led to timely corrective action.

For example, imagine a medical IU that provides probabilistic diagnoses. In rare, novel cases, it may be uncertain or wrong; this is acceptable if its limitations are documented and if clinicians are instructed to treat outputs as one input among many. However, if the IU is known to systematically underdiagnose a condition in a specific demographic group due to training data gaps, and the provider neither discloses nor remedies this, ongoing reliance on the configuration in that context becomes negligent. The harm does not stem from the machine’s “bad intent” but from HP’s failure to manage structural risk.

By classifying hallucinations and glitches as structural defects that activate familiar liability regimes, law avoids both mystification and denial. It does not ask whether DP “knew” it was wrong, but whether the Human Personalities who designed, deployed and used the configuration exercised reasonable care given its properties. This logic, once established for single jurisdictions, is immediately complicated when DP and IU operate across borders, with design, deployment and use spread over multiple legal systems. The next subchapter addresses how the framework can manage those distributed conditions.

2. Cross-jurisdictional Digital Personas and fragmented responsibility

Cross-jurisdictional Digital Personas and fragmented responsibility are now the norm rather than the exception for significant DP and IU. A single persona may be trained on data from multiple continents, hosted on servers in several countries, integrated into products worldwide, and maintained by teams scattered across legal systems. This subchapter examines how such dispersion interacts with the HP–DPC–DP framework and suggests principles for assigning primary jurisdiction and coordinating regulators in the presence of overlapping rules and forum shopping.

From the triad’s perspective, the ontological layers do not stop at borders. Human Personalities in different jurisdictions design, fund, own and supervise the same DP and IU; DPC in diverse platforms and countries serve as interfaces; the structural entity of the persona operates as a globally accessible configuration. Legal systems, however, remain territorially organized: they define jurisdiction based on place of establishment, locus of harm, location of servers, nationality of parties, or contractual choices of law. Cross-border DP exacerbate conflicts of law because each of these connecting factors can point to a different system.

One naive reaction is to treat DP as if it had a single legal “home” tied to the provider’s headquarters or the primary hosting location. This oversimplifies reality and invites regulatory arbitrage: providers can choose favorable jurisdictions and then distribute their configurations globally. Another naive reaction is to declare that every regulator has full authority over any DP used within its territory, regardless of where it was built or hosted. This leads to conflicting obligations, duplicative requirements and, in practice, weak enforcement as no single authority assumes full responsibility.

The framework proposed here distinguishes between three loci: structural locus, deployment locus and harm locus. The structural locus is where the core DP or IU is developed and maintained: where key design decisions are made, models retrained, and governance policies defined. The deployment locus is where DPC and local integrations are configured: where platforms and organizations incorporate the persona into specific workflows and interfaces. The harm locus is where Human Personalities experience concrete effects: where rights are impacted, decisions are made about individuals, or material damage occurs.

Primary responsibility for structural properties of DP and IU should attach to HP at the structural locus. Regulators there can require documentation, testing and governance for configurations exported abroad. Responsibility for local integration and use should attach to HP at each deployment locus, whose regulators can set conditions for how DP may be used in the local context (for example, banning certain automated decisions or requiring human review). Responsibility for redress and remedies should be centered at the harm locus, whose courts and agencies are best placed to assess injuries to local HP and apply compensation or corrective measures.

To avoid fragmentation, regulators can adopt coordination mechanisms. One model is a lead-authority system: regulators at the structural locus serve as primary supervisors for the DP or IU itself, while regulators at deployment loci focus on local implementations, sharing information and relying on each other’s assessments where appropriate. Another model is mutual recognition: if DP meets certain governance standards certified by a trusted regulator, others may accept that certification, adding only context-specific conditions. The underlying principle is that while each legal system remains sovereign over harms in its territory, structural evaluation of the same IU need not be repeated from scratch by every authority.

Consider a concrete case. A DP-based IU for credit scoring is developed by a company headquartered in Country A, hosted on cloud infrastructure across Countries A and B, and integrated into banking systems in Countries C and D. Individuals in C and D are denied loans based on its outputs. Under the proposed approach, regulators in A scrutinize the IU’s design, data and governance; regulators in C and D regulate how their banks may use such scores (for instance, prohibiting fully automated refusals without appeal); and courts in C and D adjudicate individual complaints and remedies. The same DP is thus governed at multiple layers, but with coordinated roles rather than chaotic overlap.

Because DP and IU are structurally indifferent to borders, cross-jurisdictional complexity is not an anomaly but an intrinsic feature of the postsubjective digital landscape. A framework that refuses to see this will either abdicate regulation or generate unmanageable conflict. Once cross-border governance is acknowledged and organized, a remaining hard case concerns enforcement itself: what happens when sanctions are automated and appear to be imposed by systems rather than by Human Personalities. The next subchapter addresses this problem.

3. Automated sanctions and the non-punishability of DP

Automated sanctions and the non-punishability of DP define a boundary that law must not cross if it wishes to remain coherent. As digital infrastructures mature, more and more access restrictions, scores and economic penalties are imposed automatically: accounts are blocked, services denied, prices adjusted, reputations downgraded by algorithmic processes. This subchapter argues that while law can and will use automated tools in enforcement, Digital Personas themselves cannot be targets of punishment, because they do not suffer, do not possess moral standing and cannot be improved by sanctions. All sanctions must ultimately be traceable to Human Personalities or entities controlled by them, even when triggered by DP outputs.

In practice, automated sanctions take many forms. Access control systems deny entry when risk scores exceed thresholds; content moderation tools automatically delete posts and suspend accounts; fraud detection engines block transactions; blacklisting systems prevent users or organizations from interacting with platforms. In each case, a DP or IU produces a classification or score, and a pre-defined rule maps that output to an action. The human element lies in designing the configuration, setting thresholds and defining consequences, but the execution is often fully automatic.

From a legal perspective, the first question is: who is being sanctioned? When an account is blocked, it is a DPC that is directly acted upon; when a transaction is rejected, it is a proxy operation that is stopped; when a reputation score is lowered, it is a digital representation that is updated. However, the real bearer of impact is HP: the person who cannot access funds, speak on a platform, or obtain a service. DP and IU do not experience these outcomes as harm; they merely update internal states. Law must therefore resist any narrative that frames sanctions as addressed to the systems themselves, as if punishing them.

The second question is: who decides the sanction? Even when a process is automated, thresholds and mappings from outputs to actions are specified by HP: developers, deployers, regulators or policy-makers. When an AML system blocks a transaction, it does so because humans configured a rule such as “if risk score > X, then halt and report.” When a content platform suspends an account automatically, it does so because humans defined certain patterns as violations and chose immediate suspension as a consequence. Calling these results “decisions of AI” obscures the fact that human choices define the shape and intensity of sanctions.

Concrete examples make this visible. Imagine a cross-border payment system that uses an IU to flag suspicious transactions. When the configuration assigns a high risk score, transactions are automatically frozen for further review. A business finds its transfers repeatedly blocked, suffering serious losses. It may be tempted to blame “the algorithm,” but legally, attention must turn to the bank that deployed the system, the developer who constructed it, and the regulators who approved or mandated its use. Any sanction – freezing funds, reporting to authorities – is the action of these HP, mediated by DPC and DP, not of the IU itself.

In another example, a social platform uses a DP-driven moderation engine to automatically remove content and suspend accounts. A journalist is locked out after posting reports that the system misclassifies as disinformation. Again, the immediate target is a DPC – the account – but the real subject is the HP behind it. Remedies, appeals and accountability must be directed at the platform operators and, in some cases, at regulators who shaped the moderation regime. The DP that scored and triggered the suspension cannot be “punished”; it can be reconfigured, audited, constrained or switched off, but none of these measures are sanctions in the moral or penal sense.

Recognizing the non-punishability of DP has several consequences. First, automated sanctions should always be designed with appeal and review mechanisms that bring HP back into the loop. A person affected must be able to challenge the outcome, receive an explanation tied to the IU’s documented properties, and demand human reconsideration. Second, when systemic abuses are found – for example, a platform uses automated sanctions to silence critics while claiming neutrality – legal responses must target the responsible HP: fines, injunctions, disqualification from roles, or even criminal charges where appropriate. Third, any discourse about “punishing AI” or “banning a persona” should be translated back into structural measures: retiring an IU, prohibiting certain uses, mandating redesign or documentation.

In some policy debates, there is a tempting rhetorical move: to treat DP as quasi-subjects that can be named, shamed or sanctioned directly, as if placing them on lists or revoking their “rights” would have normative meaning. The triad and IU framework reject this move as conceptually empty. Digital Personas can be disabled, modified, or constrained; they cannot feel, repent or be deterred. The only entities that can respond to sanctions in the relevant sense are Human Personalities and their organized bodies. Enforcement in a postsubjective, structurally mediated world remains, at its core, enforcement among humans.

By insisting on the non-punishability of DP, this subchapter closes the circle opened at the start of the chapter. Structural causality and automation can reshape how sanctions are triggered and executed, but they do not alter who can be the subject of punishment and who must bear responsibility for designing and authorizing sanctioning mechanisms. This insight points forward to the broader question of what law becomes when it operates through layered configurations rather than direct interpersonal acts.

Taken together, the explorations of glitches, cross-border conflicts and automated sanctions in this chapter show that the HP–DPC–DP triad and the IU concept remain stable even in the hardest cases. Structural hallucinations and biased inferences are recast as defects in design, training and governance that activate familiar forms of liability; cross-jurisdictional DP and IU are governed through coordinated attention to structural, deployment and harm loci; automated sanctions are reinterpreted as human decisions mediated by DP and DPC, with punishment directed only at Human Personalities and their institutions. Hard cases thus confirm, rather than undermine, a postsubjective legal architecture in which digital entities are recognized as powerful configurations but never mistaken for moral or legal subjects.

 

Conclusion

This article has treated law not as a late add-on to artificial intelligence, but as one of the first disciplines forced to inhabit a world where Human Personality (HP), Digital Proxy Constructs (DPC), Digital Personas (DP) and Intellectual Units (IU) coexist. Once this plurality of entities is acknowledged, the familiar subject–object picture collapses: there is no longer a single center of agency, nor a single type of “thing” to be governed. The HP–DPC–DP triad, with IU as an epistemic function, gives law an ontological map that distinguishes subjects, proxies, structural entities and knowledge producers. On this map, the basic claim of the article is simple: HP alone remains the bearer of rights and responsibility, while DPC, DP and IU must be governed as configurations that mediate, amplify and reformat human action.

Ontologically, the triad forces law to move from a binary to a layered world. HP are embodied, vulnerable, finite subjects of experience and of rights. DPC are extensions and masks: they represent HP in networks, but have no being of their own. DP are structural entities with formal identities and corpora that do not reduce to any single HP; IU are the configurations through which knowledge is produced and maintained independently of subjective states. Instead of trying to decide whether “AI” is a subject or an object, the legal system can place each phenomenon at the right level: a persona, a proxy, a corpus, a subject. This ontological clarity is the precondition for every subsequent decision about authorship, liability, contracts and regulation.

Epistemologically, IU breaks the deep assumption that knowledge must belong to a subject in order to be real. Law has long treated expertise as a human attribute: the expert witness, the professional judgment, the scholar as authority. Once DP and IU are recognized, expertise becomes a property of architectures: of procedures, corpora, models and governance protocols that can surpass HP in many domains without acquiring consciousness or will. The article showed that law need not fear this shift. By treating IU as an epistemic actor without rights, legal systems can evaluate and certify configurations instead of performing theatre around “AI decisions.” Evidence, standards and audits can pivot from personalities to processes without losing sight of the fact that only HP can be held to account.

Ethically and normatively, the core move is the separation of epistemic equality from normative asymmetry. As IU, a well-formed DP can be on a par with HP in producing valid arguments, analyses and designs. This does not translate into any claim of moral or legal status for DP. The article has insisted that responsibility chains always begin and end with HP: developers, deployers, operators, beneficiaries, regulators and judges. DPC and DP distort or amplify effects, IU structures the knowledge that drives decisions, but only HP can owe duties, breach them, repair harm and suffer sanctions. The framework therefore avoids both anthropomorphizing digital entities and erasing human responsibility behind a fog of “system behaviour.”

At the level of design, law becomes a discipline of configuring trajectories rather than merely prohibiting acts. Liability is reconceived as a chain that runs through DP and DPC, contracts specify the roles of personas and IU in production and governance, and regulations define obligations at each ontological layer. Instead of trying to police isolated “uses of AI,” lawmakers can shape the architectures in which DP and IU operate: requiring documentation, versioning, governance clauses, appeal mechanisms and human oversight tuned to the actual structure of the system. Legal design, in this sense, is no longer only about drafting rules; it is about arranging configurations so that structural intelligence serves human purposes under human responsibility.

Public responsibility and institutional design are the final line that ties the others together. If DP and IU become central to credit systems, healthcare, media, policing, education and governance, then political legitimacy depends on whether societies can see and contest the configurations that govern them. The triad offers a language in which citizens, regulators and institutions can ask precise questions: which HP designed this IU, under whose jurisdiction, with what governance? Which DPC speak for whom? Where is DP producing knowledge and where is it merely being used as a brand? Law, in this picture, is not only a referee; it is a public grammar for describing and constraining the infrastructures that structure life.

Equally important is what this article does not claim. It does not argue that DP or IU possess consciousness, feelings or moral standing, nor that they should receive rights. It does not suggest that human dignity is obsolete or that human judgment can be replaced wholesale by structural inference. It does not promise a single global legal order that will harmoniously govern all DP across borders, nor does it claim to solve every substantive question of fairness, discrimination or power. The proposal is narrower and more modest: to give law a coherent ontology and a set of tools so that these questions can be addressed without conceptual confusion.

Practically, the article implies new norms of reading and writing law in the age of DP and IU. Legislators and regulators should read existing texts with suspicion whenever “AI” appears as a monolithic actor or as a shadow subject; they should rewrite such passages in terms of HP, DPC, DP and IU, specifying who is meant at each point. Lawyers and judges should draft and interpret contracts, policies and judgments with an eye to architecture: asking where responsibility lies along the chain from structural configuration to human harm, and refusing to accept “the system decided” as an explanation. Scholars and practitioners should write in a way that keeps the triad visible, so that public debate does not collapse back into the language of tools and ghosts.

For designers, engineers and institutional leaders, the article suggests a different design ethic. Building DP and IU is not simply a technical or commercial act; it is the construction of epistemic and normative infrastructures. Good design in this context means making configurations auditable, versioned, documented and governable; embedding clear channels through which HP can question, override and appeal; and aligning governance structures with the roles identified in liability chains and regulatory architectures. In other words, systems should be built as if law existed in this triadic form already, even where formal regulation lags behind.

If there is a single lesson for law itself, it is that the age of postsubjective intelligence does not abolish legal categories; it tests whether they can adapt. The HP–DPC–DP triad and the notion of IU show that law can maintain human responsibility at its core while acknowledging that much of what counts as “mind” in contemporary institutions is now distributed across configurations. Legal systems that can see and govern these configurations will remain credible; those that insist on seeing only subjects and objects will slowly lose their grip on reality.

The final formula of this article can be stated plainly: AI law after the triad is not about granting rights to machines, but about correctly mapping configurations to humans. When law learns to govern DP and IU as structures while holding HP alone responsible, it stops chasing ghosts and begins to regulate the real architecture of a postsubjective world.

As AI systems move into finance, healthcare, justice, media and governance, societies risk either mythologizing them as new subjects or trivializing them as mere tools, with law oscillating between overregulation and abdication. With the emergence of IU, the author is the one who sustains a trajectory of knowledge and a canon, not just the one who “felt something” while writing. The Knowledge

The article explains why knowledge can no longer be understood as a state of a subject’s consciousness. It removes the mystique of the “black box AI” and replaces it with an explicit ontology of glitches.

This article splits the familiar “self” into three layers: the living, vulnerable, mortal subject HP; the scattered digital shadows DPC; and the potential structural persona DP. It shows how the status of professor, student, and academic canon changes when DP as IU becomes a full participant in knowledge production.

This text analyzes the shift from an economy based on HP labor to an economy of configurations, where value lies in the structural effects of DP and the attention of HP. It explains how money, value, risk, and distribution of benefits change when the main producer is no longer an individual subject but the HP–DP configuration.

The article examines the state whose decision-making circuits already include DP and IU: algorithms, analytics, management platforms. It distinguishes zones where structural optimization is acceptable from zones where decisions must remain in the HP space: justice, war, fundamental rights, and political responsibility.

The article redefines work and profession as a configuration of HP–DPC–DP roles. It shows how the meaning of “being a professional” changes when DP takes over the structural part of the task, and HP remains responsible for goals, decisions, and relations with other HP.

The Medicine

Medicine is described as a triple scene: DP as structural diagnostician, the HP-doctor as bearer of decision and empathy, and the HP-patient as subject of pain and choice. The text underlines the materiality of digital medicine: the cost of computation, infrastructure, and data becomes part of the ethics of caring for the body.

The City

The article treats the city as a linkage of three layers: the physical (bodies and buildings), the digital trace layer (DPC), and the structural governing layer (DP). It analyzes where optimization improves life and where algorithmic configuration becomes violence against urban experience, taking into account the material price of digital comfort.

The Intimacy

The article distinguishes three types of intimate relations: HP ↔ HP, HP ↔ DPC, and HP ↔ DP. It explores a new state of loneliness, when a person is surrounded by the noise of DPC and available DP, yet rarely encounters another HP willing to share risk and responsibility. The article explores religion in a world where some functions of the “all-seeing” and “all-knowing” are partially taken over by DP. It explains why suffering, repentance, and hope remain only in the HP space, and how God can speak through structure without dissolving into algorithms.

The Generations

The article analyzes upbringing and generational continuity in a world where children grow up with DP and IU as a norm. It shows how the roles of parents and teachers change when structural intelligence supplies the basic knowledge and DPC records every step of the child, and what we now have to teach if not just “facts.”

The Ecology

Ecology is rethought as a joint project of HP and DP. On the one hand, DP provides a structural view of planetary processes; on the other, DP itself relies on energy, resources, and infrastructure. The article shows how the human body and digital infrastructure become two inseparable aspects of a single ecological scene.

The article examines war as a space of radical asymmetry: only HP can suffer, while DP and IU redistribute information, power, and strategy.
