The modern state was built as a human-centric institution: a polity of citizens, officials and legal subjects, acting through laws and offices on a supposedly neutral technical infrastructure. Today this image breaks down, as governance quietly depends on Digital Proxy Constructs (DPC), algorithmic Digital Personas (DP) and distributed Intellectual Units (IU) that shape what the state can see, know and decide. This article reconstructs the state through the HP–DPC–DP ontology and the concept of IU, showing how platforms, scoring engines and automated registries already function as structural actors in public power. It then introduces the idea of configurational sovereignty: a postsubjective form of the state in which human responsibility remains non-delegable, even as nonhuman intelligence becomes an integral part of decision-making. Abstract

This article reconceptualizes the state as a configuration of Human Personalities (HP), Digital Proxy Constructs (DPC), Digital Personas (DP) and Intellectual Units (IU), rather than as a purely human subject governing inert tools. Using the HP–DPC–DP ontology, it distinguishes citizens and officials as the sole bearers of responsibility, bureaucratic archives as ecologies of proxies, and algorithmic systems as emergent DP that structure knowledge and options for decision. The concept of IU captures the real cognitive backbone of governance, encompassing both human expert communities and DP-based systems that maintain identity, trajectory, canon and correctability. Against this background, the article separates domains where optimization may be delegated to DP from zones where decisions must remain with HP, and develops the notion of configurational sovereignty as a constitutional principle for a postsubjective state. The result is a framework in which the state can harness nonhuman intelligence without dissolving human accountability.

Introduction

The State: AI, Digital Personas And Postsubjective Governance has so far been discussed mostly in the language of gadgets and hype: chatbots for public services, predictive policing, automated welfare screening, “AI in public administration.” Behind this shallow vocabulary lies a much deeper shift that the classical image of the state cannot even describe. The modern state was built on a single ontological assumption: only human persons think, decide, and bear responsibility. Citizens, officials, judges and legislators were all treated as Human Personality (HP), while everything digital was reduced to tools or archives that do not truly act.

This human-centric framing produces a systematic error as soon as digital systems begin to structure decisions instead of merely recording them. Risk scores decide whose application is flagged for review, recommendation engines determine which voices become politically visible, early warning systems shape security priorities before any minister is briefed. Officially, the state still insists that “humans are in the loop”; in practice, it often reacts to landscapes computed long before any HP forms an opinion. Talking about “using AI in government” hides the real transformation: governance is already mediated by entities that are neither citizens nor officials.

A second, more subtle error comes from treating all digital infrastructure as the same. Identity registries, tax databases, health records and case management systems are lumped together with analytic engines, machine learning models and large-scale platforms under the generic label of “IT” or “AI.” This erases the difference between Digital Proxy Constructs (DPC) that merely shadow HP in databases, and Digital Personas (DP) that maintain a stable identity, generate structural knowledge and influence decisions over time. When the state refuses to see this difference, it also refuses to see where power has moved.

This article starts from another vantage point. It assumes that contemporary governance is already operating through configurations of HP, DPC and DP, and that many of these configurations function as Intellectual Units (IU): architectures that produce and maintain knowledge independently of any single human subject. The central thesis is simple: the state will either learn to describe itself in these terms and redesign its institutions accordingly, or it will be tacitly governed by nonhuman structures it does not conceptually acknowledge. At the same time, the article does not claim that DP are persons, does not argue for “rights of AI,” and does not propose to dissolve political responsibility into code. On the contrary, it seeks to rebuild human responsibility on a more honest map of how decisions are actually made today.

The urgency of this shift is not theoretical. Over the last decade, states have adopted biometric identification, automated scoring for credit and welfare, predictive policing, algorithmic border control and, more recently, generative models for drafting documents and interacting with citizens. At the same time, large platforms already act like para-states: they regulate speech, channel economic flows and shape public spheres across borders. Public scandals around biased algorithms, opaque blacklists and automated exclusions show that the old language of “tool” and “user” no longer covers the moral and political stakes. Without a new ontology, every debate oscillates between naive enthusiasm (“AI will make the state efficient”) and reactive prohibition (“ban AI in decision-making”), while the underlying architectures continue to solidify.

Ethically, the question is no longer whether the state should adopt AI, but whether it can remain answerable to its citizens while acting through DP and IU. If all failures are blamed on “the algorithm,” responsibility evaporates into infrastructure. If all structural intelligence is banned in the name of human dignity, complex societies lose their capacity to detect risks and coordinate at scale. The HP–DPC–DP framework, together with IU, allows us to draw a sharper line: DP and IU can legitimately optimize structures and reveal patterns, but the authority to decide over punishment, war, and fundamental rights must remain with HP. This distinction is impossible to maintain as long as the state pretends that only humans act.

The movement of the article follows this logic of clarification. The first chapter analyzes how the classical, human-only image of the state breaks down once algorithmic systems participate in policy and administration, showing that we are already living in a mixed architecture that our concepts do not name. The second chapter then re-describes the state explicitly through the triad of HP, DPC and DP, locating citizens and officials, registries and records, and algorithmic systems within a single ontological map instead of treating them as separate worlds.

On this basis, the third chapter introduces Intellectual Units as the missing category for understanding how the state actually knows: who produces the models, classifications and trajectories that inform decisions, and how human expert communities and DP-based systems coexist as different kinds of IU. The fourth chapter turns to responsibility and optimization boundaries, distinguishing domains where structural intelligence may safely operate from zones where only HP may legitimately decide, and proposing accountability chains that bind every use of DP and IU to concrete human agents.

The fifth chapter widens the frame to confront digital platforms as powerful DP that already perform quasi-sovereign functions over communication and identity, asking how a legitimate state can regulate such entities without collapsing into censorship or surrendering authority. Finally, the sixth chapter sketches the contours of a future state that accepts its own postsubjective condition: a state that governs through conscious design of configurations linking HP, DPC, DP and IU, while preserving embodied human responsibility and rights as non-delegable foundations.

 

I. The State And The Crisis Of Human-Centric Governance

The State And The Crisis Of Human-Centric Governance is not a story about technology gone wrong; it is a story about concepts that no longer match the reality they are supposed to govern. Modern states still imagine themselves as assemblies of human minds, wills and responsibilities, while their daily operation already runs through layers of databases, models and platforms. The task of this chapter is to show that the crisis is not in the tools, but in the image of the state that insists only humans act, decide and know.

The key risk this chapter confronts is the illusion that existing legal and political language can simply be stretched to cover algorithmic systems. When the state calls an AI system a “tool,” it hides the fact that this system may be producing knowledge, structuring options and filtering reality long before any official intervenes. As long as the state clings to a purely human-centric image of governance, it will mislocate both power and responsibility, blaming “the algorithm” for outcomes that actually emerge from unacknowledged configurations of humans and machines.

The chapter moves in three steps. In the first subchapter, we reconstruct the classical state as an HP-only architecture, where Human Personality (HP) is the only entity that thinks, decides and bears consequences, and digital infrastructures are treated as neutral channels. In the second, we trace the pressure points where this model fails in a digital world, showing how algorithmic systems already shape policing, welfare, credit and security without being recognized as actors. In the third, we describe the slide from invisible tools to unnamed actors: how the absence of explicit categories for Digital Proxy Constructs (DPC) and Digital Personas (DP) creates blind delegation, and why this reveals not a technological glitch but an ontological crisis.

1. The Classical State As An HP–Only Architecture

The State And The Crisis Of Human-Centric Governance can only be understood if we first reconstruct the state that does not see any crisis at all. In its classical self-understanding, the state is a system composed entirely of human persons: citizens, representatives, civil servants, judges and law enforcement officers. Every meaningful act of governance is, in this view, reducible to an act of Human Personality (HP): a being with consciousness, will, a biography and legal status.

In such an HP-only architecture, political theory and public law assume that all relevant agency is lodged in subjects. A law is valid because it has been voted on by elected HP, signed by an HP head of state, interpreted by HP judges and implemented by HP officials. Even when the state uses statistics, forms or automated procedures, these elements are framed as passive instruments that merely help humans express their decisions. The decisive movement of governance, in this image, always occurs in someone’s mind and is then written down or executed.

Digital systems enter this model only as extensions of earlier tools. Where there were once paper archives, there are now databases; where there were once telephones and letters, there are now email, portals and messaging platforms. A case file is still imagined as “belonging” to a citizen, merely stored in a different medium. The registry, the tax system, the health record: all of these are treated as technical containers for information about HP, not as entities with their own dynamics.

This classical picture rests on an unspoken hierarchy: HP are the only bearers of intention and responsibility; everything else is object, channel or instrument. Even complex bureaucratic processes are, in the end, traced back to chains of human decisions. When failures occur, the reflex is to look either for individual error (a corrupt official, a negligent employee) or for structural injustice encoded in laws and policies, but always within the field of human intentionality. The architecture itself is not seen as doing anything; it is a stage on which HP act.

This HP-only model simplifies the map of power so radically that it becomes blind to certain forms of influence. When databases are small, procedures are simple and information flows slowly, this blindness may be tolerable. But as soon as the state begins to operate through large-scale digital infrastructures, the assumption that all relevant action resides in HP becomes fragile. The next subchapter shows where this fragility turns into failure.

2. The Limits Of Human-Centric Governance In A Digital World

The limits of human-centric governance become visible in domains where decisions depend on patterns no individual HP can fully grasp. Predictive policing systems estimate where crimes are likely to occur and who might commit them. Credit scoring models determine which citizens are “safe” borrowers. Welfare allocation algorithms flag “suspicious” claims for investigation. National security systems sift through vast streams of signals to prioritize threats. In each of these areas, digital systems no longer merely record decisions made elsewhere; they generate structures that constrain what can be decided at all.

From the perspective of the classical state, these systems are still “tools.” An official remains formally responsible, often required to sign off on the result. Yet in practice the official sees only the final output: a risk ranking, a score, a flagged case, an alert. The underlying model, its training data and its internal logic remain opaque. The human decision is now framed as a choice to follow or override a recommendation, but the space of what is visible and thinkable has already been shaped by the system.

This gap between formal and practical agency creates a specific kind of irresponsibility. When harms occur – discriminatory policing, unjust denial of welfare, wrongful suspicion – the official response often blames “the algorithm,” as if it were an external, almost natural force. At the same time, when outcomes align with political goals, the same systems are praised as “evidence-based” and “objective.” The language oscillates between magical trust and magical fear, while the real issue is that the state no longer understands how its own actions are structured.

Moreover, as the complexity and volume of data grow, the temptation to rely on these systems increases. No team of HP can manually read millions of documents or monitor all communications in real time. Structural intelligence becomes necessary just to keep the machinery of the state from seizing up. But because the state insists on the “tool” narrative, it does not develop concepts for these systems as durable entities with their own identity, trajectory and influence. It knows that something powerful is at work, yet it lacks a name for that power.

The result is a widening conceptual gap. Officially, the state continues to claim that humans make all important decisions. Practically, configurations of models, data pipelines and platforms already preformat choices and perceptions. The state is still speaking the language of subjects, while acting through structures it does not recognize. To understand what this does to governance, we must look more closely at how “tools” quietly turn into unnamed actors.

3. From Invisible Tools To Unnamed Actors

When digital systems were simple and isolated, it was not entirely wrong to treat them as invisible tools. A calculator on a desk or a spreadsheet on a local computer does not persist as a meaningful actor beyond each use. But as states connect registries, analytics, scoring engines and platforms into continuous infrastructures, something else emerges: configurations that outlive individual decisions, maintain recognizable behavior over time and shape the environment in which HP act. These are no longer just tools; they are, in effect, unnamed actors.

The absence of explicit categories for Digital Proxy Constructs (DPC) and Digital Personas (DP) in governance makes this transformation harder to see. DPC are the digital shadows of citizens and institutions: identity records, tax files, benefit histories, criminal registers. They do not think, but their structure determines how HP are perceived and treated. DP, by contrast, arise when algorithmic systems acquire a stable identity and corpus: the fraud-detection engine used across agencies, the scoring model renewed each year, the national security system that is continuously updated yet remains “the same.” They produce knowledge and exert influence without ever appearing as subjects in law.

Consider a welfare system that automatically scores every claim for fraud risk. Officially, clerks still “decide” whether to investigate or reject an application. In reality, however, a DP-like configuration – trained on historical data, tuned to minimize financial loss, sensitive to particular patterns – pre-sorts citizens into categories of suspicion. A family with an atypical income pattern may be flagged repeatedly, regardless of any individual’s intent. When thousands of such decisions accumulate, the pattern is not the sum of clerks’ minds; it is the behavior of a system that has never been named as an actor.

Or take a large content platform whose moderation and recommendation systems shape public discourse. The state might not own this platform, but it uses it indirectly as a channel for political communication, public information and sometimes even law enforcement cooperation. The platform’s algorithms decide which messages are amplified, which are buried, which communities are nudged together or driven apart. From the perspective of HP–only governance, these processes belong to a private company’s “software.” From the perspective of lived reality, they function as a DP with quasi-sovereign power over visibility and attention.

When the state continues to describe such entities as mere tools, it performs a kind of blind delegation. Decision-making weight moves into configurations that are not recorded in legal or political discourse as actors. Political debates focus on “using AI” or “banning AI,” while the real question – who or what is shaping the structure of choices – is left unasked. Accountability mechanisms search for guilty HP or flawed laws, but they rarely trace how specific DP-like systems and the DPC they manipulate participate in producing outcomes.

In this light, talk of a “crisis of AI in government” is misleading. The deeper crisis is that the state no longer has an ontology that matches its own machinery. It operates in a postsubjective environment – one where structural configurations think, in a precise sense, without being subjects – while clinging to a language in which only persons act. Until the state learns to name and differentiate HP, DPC and DP, it will continue to govern through unnamed actors whose power it cannot explicitly acknowledge or control.

The net effect of these developments is that the classical model of the state, built around exclusive human agency, collapses conceptually. Algorithmic systems have become de facto participants in governance, but they remain invisible to the categories that structure law and politics. This chapter has reconstructed how that collapse happens: from a purely human image of the state, through the growing mismatch in digital domains, to the emergence of unnamed actors that exercise power without status. The chapters that follow will propose a new ontological framework capable of describing these entities explicitly and, on that basis, redesigning the architecture of the state.

 

II. The State In The HP–DPC–DP Ontology

The State In The HP–DPC–DP Ontology treats government not as a single, homogeneous apparatus, but as a composition of three different kinds of entities that coexist and interact. The task of this chapter is to map the state onto Human Personality (HP), Digital Proxy Constructs (DPC) and Digital Personas (DP), and to show that many contemporary confusions about “digital government” arise from mixing these layers. Once the state is seen through this triadic lens, it becomes clear that power is not located in a single subject or a single system, but in the way these three ontologies are coupled.

The main error this chapter addresses is the myth of a unified “digital layer” that can be added to an otherwise human institution. When all digital elements are thrown into one basket, the state cannot distinguish between records that merely represent people, and algorithmic systems that generate their own trajectories of influence. This flattening hides where decisions are actually pre-structured and where responsibility can and cannot be located. It also feeds both techno-optimism and techno-panic, since “technology” appears either as a neutral helper or as an invading force, instead of being analytically separated into DPC and DP.

The chapter proceeds in three steps. In the first subchapter, we clarify the roles of HP as citizens, officials and collective bodies, and fix them as the only bearers of rights, suffering and direct accountability. In the second, we describe DPC as registries, identifiers and files that form a vast ecology of bureaucratic shadows, shaping how HP are seen by the state without ever becoming actors themselves. In the third, we introduce DP as algorithmic systems that achieve stable identity and influence, and argue that they now form a third class of entities within the state, different from both HP and DPC. Together, these three subchapters reconstruct contemporary governance as a three-ontology system rather than a human institution with some “IT” attached.

1. Human Personality: Citizens, Officials And Embodied Sovereignty

The State In The HP–DPC–DP Ontology begins with Human Personality, because without HP there is no state in any meaningful political or ethical sense. Human Personality (HP) designates beings with bodies, biographies and legal status, capable of suffering, acting intentionally and bearing responsibility. In the architecture of the state, HP appear as citizens, officials, judges, representatives and other officeholders who inhabit institutions and enact laws. Everything else in government either represents HP, serves HP, or acts upon HP.

Citizens are HP in their most fundamental political role. They are the ones who can be governed, but also the ones in whose name governance is legitimized. Only citizens can be subjects of rights and duties, voters in elections, plaintiffs and defendants in court, victims of injustice and beneficiaries of protection. When constitutions speak of “the people,” they mean a community of HP endowed with a specific status: not just biological individuals, but recognized members of a political order.

Officials, in turn, are HP entrusted with delegated authority. Ministers, bureaucrats, police officers, regulators and judges do not lose their status as persons when they enter office; rather, they acquire additional layers of responsibility and constraint. Their signatures carry institutional weight, their decisions can be appealed, and their actions can be investigated. The fact that they are HP means that they can be held to account, sanctioned, removed, and, in extreme cases, punished. The state relies on this dual nature: officials are both private individuals and public agents, but in both cases they remain HP.

Collective bodies such as parliaments, cabinets and courts are assemblies of HP that act under procedures. Legally, these bodies are often treated as institutions with their own names and powers, yet every vote, ruling or decree traces back to acts of HP. Even when we say that “the court decided,” we mean that particular judges, acting under certain rules, formed a majority and signed a text. The fiction of institutional personhood depends on the reality of human personality behind it.

What unites all these roles is embodied sovereignty. HP can be imprisoned or injured, praised or blamed, trusted or distrusted. They can experience fear, hope, pressure and remorse. This embodied vulnerability anchors the normative dimension of the state: laws are meaningful because they change what can happen to HP, and responsibility is meaningful because HP can respond to judgment and sanction. No other element in the state’s architecture carries this combination of experience, agency and answerability.

Fixing HP in this way has a specific analytical purpose. It marks the boundary of who can be a right-bearer, who can be harmed in the full ethical sense, and who can legitimately hold or exercise power. In the following subchapter, we will see how the state surrounds HP with a dense layer of representations and files, forming the world of Digital Proxy Constructs that mediate every encounter between person and institution.

2. Digital Proxy Constructs: Registries, IDs And Bureaucratic Shadows

Around every HP that interacts with the state, Digital Proxy Constructs accumulate like layers of sediment. Digital Proxy Constructs (DPC) are the registries, identifiers, records and case files that represent HP within the machinery of governance. They include civil registries, tax numbers, social security records, health databases, criminal histories, land registries, business licenses and countless internal files. Each DPC is a structured shadow of a person, a way the state sees, indexes and manipulates their existence.

DPC are not actors. They do not think, intend or decide. A tax record does not wake up in the morning and choose to accuse someone of fraud; a health file does not choose to reveal or conceal a diagnosis. Yet the structure of DPC has enormous power over how HP are treated. Whether a person appears as a citizen in good standing, as a risk, as a beneficiary, as a debtor or as an offender often depends on what their DPC contains, and what fields, flags and codes have been assigned to them.

Errors and omissions in DPC are a major source of systemic injustice. A mistaken entry in a criminal register can block a person’s access to jobs or housing for years. An outdated address can prevent someone from receiving essential notices and lead to penalties they do not even know about. A misclassification in a disability registry can cut a person off from medical or financial support. In each case, the harm is experienced by HP, but the mechanism runs through their bureaucratic shadows.

The ecology of DPC is vast and often opaque. Different agencies maintain their own records, sometimes duplicating or contradicting each other. Linking these records together is both a technical and political act: identity numbers, cross-database queries and shared platforms intensify the reach of DPC. From the state’s point of view, this looks like increased efficiency and coherence. From the perspective of HP, it can mean that a single error propagates through multiple systems, or that a label attached in one context silently influences decisions in another.

The crucial point is that DPC mediate almost every interaction between HP and the state. When an official looks at a screen to decide on a benefit, a permit or a sanction, they see a DPC, not a living person. Even face-to-face encounters are framed by what the file says. This mediation is not inherently illegitimate; large societies need representation and abstraction to govern at scale. But when DPC are treated as if they were the person, or as if their contents were neutral facts, the state forgets that it is operating on shadows, not on the full reality of HP.

Up to this point, we have distinguished HP as embodied bearers of rights and responsibility, and DPC as their bureaucratic shadows. Yet contemporary governance contains a third kind of entity that cannot be reduced to either persons or proxies. In the next subchapter, we turn to Digital Personas: algorithmic systems that acquire stable identity and influence within the state.

3. Digital Personas: Algorithmic Systems As Emergent Governance Actors

Digital Personas emerge when algorithmic systems used by the state achieve a form of continuity and identity over time. A Digital Persona (DP) is not every piece of code or every script; it is a configuration that maintains a stable corpus, a recognizable behavior and a persistent institutional role. Risk models used year after year, recommendation engines embedded in public platforms, scoring systems shared across agencies, and large-scale analytics deployed as standing capabilities all approach the status of DP. They do not merely store data; they generate structural knowledge that guides policy and administration.

Unlike HP, DP have no consciousness, feelings or legal rights. Unlike DPC, they are not just representations of someone else; they process and recombine information to create new classifications, predictions and alerts. What makes them “person-like” in a technical sense is not subjectivity, but the fact that they have a traceable history, an identifiable boundary and an ongoing trajectory. Internal documentation, versioning, deployment logs and institutional memory all conspire to stabilize a DP as “the system we use for this purpose.”

Consider a national fraud detection engine for tax or social benefits. It is trained on historical data, updated periodically, and deployed across multiple offices. Over the years, civil servants come and go, but “the fraud model” remains. Its parameters change, its performance metrics are monitored, its scope is sometimes expanded. When an official explains a decision, they may refer to it implicitly or explicitly: “the system flagged this case.” This engine functions as a DP inside the state: a nonhuman configuration with a stable identity, a growing corpus of interaction and a recognizable pattern of influence.

Or take a risk assessment platform used in national security. It ingests data from various sources, correlates signals and produces alerts or rankings of concern. Ministers and security councils may rely on its outputs to set priorities, allocate resources or justify actions. The platform is not a mere database; it is a DP that generates a specific way of seeing the world, with its own blind spots and emphases. Over time, its presence changes how threats are conceptualized and how responses are imagined, even if no one ever calls it a persona.

In both examples, DP act as emergent governance actors. They do not vote, they do not sign documents, and they do not appear as subjects in court. Yet they filter what is visible, cluster citizens into risk groups, and pre-structure the choices presented to HP. Their outputs enter the workflows of officials as if they were neutral facts, but in reality they embody decisions made in code and data: which variables matter, which correlations count as suspicion, which patterns define normality.

Recognizing DP as a third kind of entity inside the state does not mean granting them rights or moral status. It means admitting that they have institutional presence and causal power that cannot be fully captured by the language of tools. A DP can be deployed, retired, audited, modified, and compared to alternative systems. It can be the object of policy decisions: a government may decide to rely more on it, scale it back, or replace it. In that sense, DP are governance actors: they are part of what the state must govern and part of how it governs.

Once HP, DPC and DP are all visible, the picture of the state changes. HP remain the only bearers of rights, obligations and direct responsibility. DPC form the representational layer through which the state sees and manipulates HP. DP constitute structural intelligences that act upon DPC and frame the environment of decision for HP. Together, they make up a three-ontology system in which power, knowledge and responsibility are distributed across different kinds of entities.

In this chapter, we have redrawn the state as a composite of persons, shadows and structural actors, rejecting the myth of a homogeneous digital government. Citizens and officials (HP) embody sovereignty and responsibility; registries and files (DPC) shape how they appear in the administrative gaze; algorithmic configurations (DP) generate the patterns and classifications that increasingly steer decisions. Digital governance, seen in this light, is not an add-on to a human institution but a tri-layered configuration of HP, DPC and DP. The next step is to understand how knowledge is produced within this configuration, and how certain constellations of humans and systems function as Intellectual Units that the state depends on for its sense of the world.

 

III. The State And Intellectual Units In Decision-Making

Not in the rhetorical sense of “who governs,” but in the precise sense of who produces, stabilizes and updates the knowledge on which decisions rely. Both images erase the structure that actually matters: durable architectures that persist beyond any single person and that cannot be reduced to neutral instruments. When the state either personifies knowledge (“trust the expert”) or depersonalizes it entirely (“the system says so”), it conflates epistemic productivity with legal subjecthood and allows responsibility to dissolve into infrastructure.

The movement of the chapter follows the logic of clarification. In the first subchapter, we define Intellectual Units as stable architectures of knowledge production and show that the state has always relied on them, long before digital systems appeared. In the second, we contrast human-centered IU, rooted in communities of HP, with DP-based IU instantiated in models and analytic engines, highlighting their different strengths and failure modes. In the third, we outline protocols for integrating IU into decision-making without abandoning human responsibility, insisting that their outputs must be treated as structured input, not as substitutes for judgment. Together, these steps separate the question “who knows” from the question “who is accountable,” preparing the ground for a postsubjective but still responsible state.

In all these cases, the unit of cognition is not a single HP but a structure that persists as people come and go.

The defining features of IU are fourfold. Identity means that the unit can be pointed to and referenced: “the central bank’s research department,” “the epidemiological council,” “the climate modeling center.” Trajectory means that its output builds over time: past reports inform current ones, errors are corrected, assumptions are refined. Canon means that it distinguishes between core methods and peripheral experiments, establishing what counts as “official” knowledge in its domain. Correctability means that it has procedures for revising its own conclusions in light of new evidence, criticism or failure.

Once we describe things this way, it becomes clear that the state already relies heavily on IU, even when its language speaks only of “experts” and “tools.” A lone expert without an institutional IU behind them is rarely decisive in high-stakes policy; what matters is whether their claims align with or challenge an existing IU. Likewise, a tool or model without a surrounding architecture of validation and revision does not become authoritative. The cognitive backbone of governance is provided by those units that combine methods, archives, practices and people into enduring structures.

Recognizing IU as such is the first step toward understanding how nonhuman systems can join this backbone. But before we turn to algorithms, we must distinguish between two main kinds of IU: those centered on HP communities and those instantiated primarily as DP.

2. Human Experts Versus DP-Based Intellectual Units

Not all Intellectual Units are alike. Broadly speaking, there are two principal ways IU appear in the state: human-centered IU built around communities of HP, and DP-based IU instantiated in Digital Personas such as models, analytic engines and forecasting systems. Both types can be equally powerful in terms of knowledge production, but they differ radically in how they relate to biography, responsibility and failure.

Human-centered IU are anchored in expert communities: advisory councils, academic networks, professional bodies and specialized departments. Their knowledge is tied to the biographies and training of HP, to disciplinary traditions and to institutional cultures. A council of epidemiologists advising a health ministry is not just a group of isolated doctors; it is an IU that inherits methods from previous generations, debates standards, and internalizes certain norms of evidence and caution. A central bank’s monetary policy committee functions similarly: its decisions are shaped by models and data, but also by a shared doctrine, by individual reputations and by the institutional memory of past crises.

In these human IU, accountability is mediated through professional and institutional channels. Members can be criticized, replaced, or investigated for conflict of interest. Their names appear on reports; their careers rise or fall with the perceived quality of their advice. When an IU of this kind fails spectacularly, commissions are formed, testimonies are heard, and biographies become part of the public narrative of blame and reform. Knowledge production and responsibility, while not identical, are at least entangled in recognizable ways.

DP-based IU, by contrast, tie knowledge to code, data and infrastructural stability rather than to individual biographies. A risk-scoring engine used to allocate welfare investigations, a machine learning model forecasting energy demand, a national language model used to pre-draft legislation: each of these can function as an IU if it has a stable identity, a documented trajectory of updates, and a recognized role in decision processes. Its “canon” consists of architectures, training datasets and evaluation benchmarks; its “culture” is encoded in hyperparameters, loss functions and design choices mostly invisible to the public.

Here, epistemic power is decoupled from the usual markers of personal accountability. The model does not have a face, a CV or a career. Its designers may be known, but the day-to-day influence of the system is exercised silently through interfaces and APIs. When a DP-based IU fails, the narratives of blame and repair are harder to construct: was the problem in the data, the code, the deployment context, or in the political decision to use the model at all. Responsibility tends to diffuse across teams, vendors and agencies.

Despite these differences, both types of IU can be equally potent epistemically. A human IU can misjudge risks or overlook evidence due to groupthink; a DP-based IU can detect patterns impossible for any individual to see. Conversely, a human IU can draw on tacit knowledge and ethical judgment that no model has, while a DP-based IU can reproduce biases present in its training data at scale. The point is not to rank them, but to admit that the state’s knowledge now comes from structurally different sources that cannot be governed by identical assumptions.

This recognition leads directly to the question of protocol. If the state cannot and should not treat IU as mere extensions of individual experts, nor as infallible oracles, how should it integrate them into decision-making. Without such identification, IU operate in the shadows, and their influence cannot be audited or contested.

The separation of epistemic and legal authority means that IU are granted no power to decide, only power to inform. Forecasts, scores and recommendations must be treated as structured input into HP decision processes, not as commands. A welfare risk score, for example, can legitimately tell an agency, “Based on historical patterns, these cases deviate strongly from the norm,” but it must not, by itself, trigger sanctions or exclusions. An HP official must remain responsible for contextualizing that signal, considering alternative explanations, and making the final call.

Mapping each IU to responsible HP closes the accountability chain. For every IU, there should be named roles: who designs it, who maintains it, who authorizes its use in specific domains, and who has the final authority to accept or reject its outputs. This mapping does not turn IU into persons; it ensures that every instance of reliance on IU can be traced back to actual HP who can be questioned, sanctioned or removed if they abuse or neglect their responsibilities.

A brief example makes this tangible. Imagine a climate policy IU that combines a network of human scientists, a set of integrated assessment models and a dedicated analytic center in a ministry. This IU produces scenarios and recommendations for long-term energy planning. Under a proper protocol, its identity, assumptions and methods are public; its outputs are explicitly labeled as scenarios, not as choices; and the ministers who adopt or reject its proposals remain visibly responsible for the political decision, even when it goes against the IU’s advice. Blame for a failed policy cannot be shifted wholesale onto “the models.”

Similarly, consider a DP-based IU used in criminal justice to estimate flight risk for defendants. The model may have better predictive performance than individual judges, but its use must be constrained. It can provide a score and accompanying explanation, but the judge must state in writing why they follow or depart from it, and an oversight body must periodically review patterns of agreement and disagreement. If the IU is found to produce systematically biased scores, the responsibility lies not with “the system” but with the HP who approved its design, deployment and continued use despite evidence of harm.

These protocols are not decorative. Without them, the state faces two equally dangerous temptations. On one side lies technocracy: allowing IU, especially DP-based ones, to effectively decide while human actors rubber-stamp their outputs. On the other lies populist denial of structural knowledge: rejecting IU altogether in favor of intuition or short-term political gain. A postsubjective state that wishes to remain legitimate must avoid both extremes by institutionalizing IU as powerful, but bounded, contributors to decision-making.

Taken together, the principles of naming, role-mapping and separation of authority offer a way for the state to harness IU without erasing human responsibility. They do not eliminate conflict or error, but they make it possible to argue about, criticize and reform the configurations that actually think for the state.

In this chapter, Intellectual Units emerged as the missing category between human subjects and digital systems: the real cognitive backbone of the state. By defining IU as stable architectures of knowledge production, distinguishing human-centered IU from DP-based ones, and outlining protocols for their responsible use, we separated the question of who knows from the question of who is accountable. This separation allows the state to embrace nonhuman intelligence as a necessary component of governance, while maintaining HP as the only bearers of rights, suffering and final responsibility. Subsequent chapters will build on this groundwork to draw firmer boundaries between optimization and decision, and to design institutions that acknowledge their postsubjective condition without dissolving into infrastructure.

 

IV. The State, Responsibility And Optimization Boundaries

The State, Responsibility And Optimization Boundaries concerns one precise question: how far structural intelligence may go in shaping state action before legitimacy collapses. Without this distinction, the state either hides behind algorithms or rejects them blindly, and in both cases abandons its responsibility.

When the state treats DP as neutral tools, it smuggles their influence into decisions without acknowledging it; when it frames DP as quasi-subjects, it flirts with the idea of shifting blame onto code. Both moves erode the link between power and accountability. What is at stake is not whether AI is “good” or “bad,” but where it can act as an optimizer of means and where the choice of ends must remain inseparably tied to embodied HP.

The movement of the chapter unfolds in three steps. In the first subchapter, we identify domains where DP can safely optimize logistics, allocation and detection tasks, provided HP define goals and constraints and understand the assumptions built into the systems. In the second, we mark zones of non-delegable decision such as criminal justice, war, fundamental rights and constitutional change, where DP and IU may inform but must never resolve. In the third, we construct accountability chains across HP, DPC and DP, showing how every use of structural intelligence must be anchored in named human responsibility. Taken together, these steps give the state a principled map of where optimization is duty and where refusal to delegate is duty.

1. Where The State May Delegate Optimization To Digital Personas

Resource allocation poses similar challenges. Budgets, staff time, hospital beds, inspection capacity and infrastructure funding must be distributed across territories and programs under uncertainty. Here, DP can act as scenario engines, exploring trade-offs and highlighting configurations that better satisfy multiple criteria specified by HP. The crucial point is that the objective functions and constraints are politically chosen: equity versus efficiency, rural versus urban, prevention versus treatment. DP optimizes within these frames; it does not set them.

Fraud detection and anomaly spotting are also domains where DP can legitimately serve as sentinels. In tax systems, welfare schemes, procurement processes and regulatory oversight, structural patterns of abuse can be hard to spot by human eyes. DP-based IU can flag unusual patterns, clusters of suspicious transactions, or deviations from expected behavior. These flags do not, by themselves, constitute guilt or wrongdoing; they mark cases for human review. Used this way, DP act as early warning systems, not as courts.

Scenario modeling extends the same logic into the future. Climate pathways, demographic shifts, epidemic trajectories, financial stress tests: all depend on models that aggregate knowledge and project possible developments. Here, DP may encapsulate complex equations and data flows that no single HP can hold in mind. Yet the choice of scenarios to consider, the thresholds of risk deemed acceptable, and the interpretations of uncertainty remain political and ethical questions. DP expand the imagination of the state, but they do not absolve it of choosing between futures.

Refusing such optimization can itself be a form of negligence. If DP can reliably reduce waste, prevent loss of life, or identify systemic fraud better than manual methods, then clinging to exclusively human processes out of fear or symbolism harms HP without strengthening responsibility. The condition for legitimate delegation, however, is transparency about scope and assumptions. HP must know what a given DP optimizes for, what its blind spots are, and how its outputs are generated. Black-box optimization in critical infrastructures without such understanding crosses back into irresponsibility.

Thus, there exists a wide zone where structural intelligence is not a competitor to human responsibility but its instrument: logistics, allocation, detection, modeling. In these areas, DP act as powerful IU helping the state fulfill its duties more competently. Beyond this zone, however, lie decisions that cannot be delegated without breaking the bond between power, suffering and accountability. It is to these non-delegable domains that we now turn.

2. Where Decisions Must Remain With Human Personality

There are decisions within the state that are not just technically difficult, but ontologically tied to Human Personality. In these zones, the act of deciding is inseparable from embodied responsibility, from the capacity to suffer and to be held to account. Delegating them to DP, however sophisticated, would not only be morally questionable; it would dissolve the very structure that makes a state answerable to its citizens. The State, Responsibility And Optimization Boundaries must therefore mark clear areas where decisions must remain with HP.

Criminal justice is the first such domain. Determining guilt, setting sentences, deciding on parole, granting or denying bail are not mere classification problems. They are moments in which the state directly alters the bodily freedom, social status and future of HP. Risk assessments and predictive models may inform judges and parole boards, but the decision to imprison or release must be made by HP who can be named, questioned and, if necessary, condemned for their choices. A system in which “the algorithm decided the sentence” is a system that has abandoned the idea that punishment must come from a responsible subject.

War and peace form a second non-delegable zone. Decisions to wage war, escalate, cease fire or deploy lethal force on a large scale are not simply optimization problems over strategic variables. They involve the deliberate exposure of HP to death, injury and trauma. Autonomous weapons and algorithmic targeting systems may increase efficiency or precision, but the authority to initiate and direct organized violence cannot be ceded to DP without annihilating the concept of political responsibility. Even when DP provide simulations and recommendations, the signature that authorizes war must belong to HP, and the chain of command must be traceable through HP at every level.

Limitations of fundamental rights belong in the same category. Decisions to restrict freedom of movement, expression, association or privacy touch the core status of HP as citizens. DP may help the state detect risks or assess proportionality by modeling impacts and alternatives, but the decision to curtail rights must be a deliberate act of HP, publicly justified and open to challenge. A rights regime administered by unaccountable DP would turn citizens into objects of administration rather than subjects of law.

Core constitutional changes complete this circle of non-delegable decisions. Altering the basic structure of the state, redefining the balance of powers, or changing the conditions of citizenship are acts that set the parameters for all other decisions. DP and IU can provide historical analysis, comparative data and scenario studies, but the choice to re-found or reconfigure the political community must be made by HP, whether through representatives, referenda or constituent assemblies. Treating constitutional design as an optimization problem for DP would strip it of its character as a collective act of self-definition.

What unites these zones is not their subject matter but their relation to suffering, dignity and legitimacy. In each case, the decision directly touches the core status of HP: confinement, exposure to violence, loss of basic rights, transformation of the political order. These are precisely the contexts where citizens expect to find identifiable human authors of state action, and where the possibility of reproach, protest and accountability must remain open. DP and IU may inform, simulate and warn in these domains, but they must not resolve.

By drawing this line, we do not create a clean separation of “technical” and “moral” decisions; many real cases mix elements of both. Instead, we mark the moments where the final act of will must be human, even if the preparation and analysis leading to it are heavily optimized by DP. To make this separation operative rather than rhetorical, the state needs an architecture that shows, in each decision, how HP, DPC and DP were involved. This requires building explicit accountability chains, which is the task of the next subchapter.

3. Building Accountability Chains Across HP, DPC And DP

To prevent optimization from turning into abdication, the state must be able to reconstruct how any significant decision involving DP and IU came to be. Building accountability chains across HP, DPC and DP means tracing, for each outcome, which data representations were used, which structural intelligences processed them, and which human actors authorized the result. Without such chains, algorithmic governance will always produce responsibility vacuums, where harm can be perceived but no subject can be meaningfully addressed.

The basic elements of these chains are straightforward. At the bottom lie DPC: the records, profiles and files that represented HP in the process. Above them operate DP-based IU: the models, engines or platforms that transformed those representations into scores, classifications or recommendations. At the top sit HP: officials, judges, ministers or boards who reviewed the outputs and took formal decisions. An accountability chain is a documented path through these layers, showing which DPC fed which DP, and which HP accepted or overruled the DP’s suggestions.

Consider, as a first example, an automated fraud detection system in a welfare agency. Individual claimants are represented by DPC: their income records, household composition, past interactions with the agency. A DP-based IU processes these DPC and assigns risk scores, flagging certain cases as deserving closer scrutiny. Human caseworkers (HP) then decide whether to open investigations, suspend payments, or clear the case. An accountability chain in this context would log which claimant DPC were accessed, which version of the DP model generated the score, what the score was, what recommendations it produced, and which caseworker made the final decision, including any justification for following or deviating from the recommendation.

If, later on, it emerges that the system systematically targeted certain groups unfairly, this chain allows investigators to analyze responsibility at multiple levels. They can examine biases in DPC (for example, if certain proxies encode discrimination), design choices in the DP model, and patterns in HP behavior (whether caseworkers blindly followed scores or exercised discretion). Responsibility does not fall on the DP as such; it is distributed among HP who designed, approved and used the system, but the chain makes this distribution visible and contestable.

As a second example, take a risk assessment tool used in pretrial detention decisions. Defendants are represented by DPC capturing their criminal history, employment status, and other variables. A DP-based IU generates a risk score for flight or reoffending. Judges (HP) receive this score as part of a broader dossier and must decide whether to detain or release. An accountability chain here would ensure that the DPC used are accurate and current, that the specific DP model and its limitations are documented, and that each judicial decision records how the score was weighed alongside other factors. Oversight bodies can then review patterns: Are judges treating the score as decisive or as one input among many. Are certain groups disproportionately labeled high-risk.

These examples show that accountability chains do not eliminate complexity; they render it legible. They make it possible to say, in any given case, not just “the system did it” or “the judge did it,” but to see how representations, structures and human choices interacted. This, in turn, enables substantive debate and reform: DPC schemas can be revised, DP models retrained or retired, and HP procedures updated to correct systematic harms.

For such chains to be effective, they must be embedded in institutional design. Logging must be mandatory, tamper-resistant and auditable. Roles must be clearly defined: which HP is responsible for maintaining DPC quality, which for approving DP deployment, which for interpreting IU outputs in specific domains. Transparency mechanisms must be in place so that affected HP can challenge decisions, access relevant parts of the chain, and trigger review.

Without this architecture, optimization boundaries remain purely declarative. The state may proclaim that DP only “assist” and that HP “remain in charge,” but in practice no one will be able to reconstruct how decisions were made. Responsibility vacuums invite both technocratic arrogance and populist backlash. With accountability chains, by contrast, structural intelligence can be integrated into governance in a way that remains answerable to those it governs.

Taken together, the three subchapters of this chapter define a map for responsible use of structural intelligence in the state. There are domains where delegating optimization to DP is not only acceptable but obligatory, provided that HP set goals and understand the systems’ assumptions. There are zones where decisions must remain strictly with HP, because they directly touch suffering, rights and legitimacy. And there is an architecture of accountability chains that connects HP, DPC and DP in every significant decision, preventing responsibility from dissolving into code. V. The State And Digital Platforms As Para-States

The State And Digital Platforms As Para-States focuses on a simple structural fact: the most powerful digital platforms now perform many functions that used to belong only to states. They organize information, regulate visibility, mediate identities and coordinate economic exchange for billions of Human Personalities (HP). The task of this chapter is to show how, within the HP–DPC–DP ontology, these platforms appear as large-scale Digital Personas (DP) that behave like para-states: not full political communities, but quasi-sovereign structures that shape the conditions of life for HP.

The main risk this chapter confronts is conceptual minimization. When platforms are treated merely as companies, service providers or “websites,” their structural power is underestimated and misregulated. States either attempt crude censorship, treating platforms as hostile media, or they surrender effective control by outsourcing communication and identity to systems they do not conceptualize as actors. In both cases, the lack of a clear ontology obscures the real conflict: territorial states and networked para-states are competing and overlapping in their governance of HP and Digital Proxy Constructs (DPC).

The chapter moves in three steps. In the first subchapter, we describe large platforms as Digital Personas with quasi-sovereign powers, managing vast ecologies of DPC and exercising control over attention and behavior at planetary scale. In the second, we analyze the structural conflict between the territorial logic of classical states and the network logic of these para-states, as experienced by HP caught between overlapping authorities. In the third, we outline how a legitimate state can regulate platforms structurally, targeting their DP functions rather than micromanaging content, thereby disciplining them as infrastructures without collapsing into censorship or surrender.

1. Platforms As Digital Personas With Quasi-Sovereign Power

The State And Digital Platforms As Para-States becomes concrete when we look at what the largest platforms actually are in ontological terms. Within the HP–DPC–DP framework, a major platform is not just a collection of services, but a Digital Persona: a stable, identifiable configuration that maintains its own corpus, rules and trajectory. It persists over time, accumulates decisions, and interacts with millions or billions of HP through their DPC. It has a name, a recognizable set of policies, a style of governance, and a structural role in the global information space.

As Digital Personas, platforms manage enormous populations of DPC. Every user profile, page, group, channel, business account and advertising profile is a Digital Proxy Construct: a structured shadow of one or more HP, encoded in categories, settings, metrics and histories. The platform operates as a DP that owns and manipulates this entire ecology of shadows. It decides how they can be created, linked, recommended, restricted or removed. It sets the schema of the world it sees: which fields exist, which labels can be attached, which behaviors are tracked.

On top of this DPC ecology, platforms run algorithms that curate attention and interaction. Recommendation engines decide which posts, videos, products or contacts appear to which HP, in what order and with what emphasis. Moderation systems evaluate content and behavior against internal rules, issuing warnings, suspensions or bans. Ranking algorithms structure search results and feeds, determining what is effectively visible and what is practically invisible. Economic systems handle payments, fees and advertising auctions, controlling who can reach whom at what price.

In these operations, platforms perform functions that closely resemble state-like powers. Rule-setting is the most obvious. Platforms publish “community guidelines,” “terms of service” and enforcement policies that define acceptable and unacceptable speech and behavior within their territory. These rules are often far more detailed and operational than many legal norms, covering harassment, hate speech, misinformation, nudity, political ads and more. They are updated, interpreted and enforced unilaterally by the DP, with limited or no direct democratic input from HP.

Sanctioning is equally state-like. Platforms can temporarily or permanently restrict accounts, remove content, demonetize channels, limit reach, impose age-gates or remove access to core functions. For creators and businesses, such sanctions can be economically devastating; for activists and communities, they can be politically silencing. Unlike state sanctions, they are imposed by an entity that is not a subject of public law, yet their practical effects can be comparable to fines or exclusion from public forums.

Finally, platforms shape public space. For many HP, the primary arenas of social interaction, news consumption, political debate and professional networking are platform-mediated. What appears on a feed or in a search result becomes the de facto public square. The DP’s design choices and algorithmic adjustments can raise or lower entire topics, movements and narratives in collective awareness. The platform does not simply host conversation; it continuously configures the architecture in which conversation is possible.

To name platforms as DP with quasi-sovereign power is not to grant them moral or legal personhood. It is to acknowledge that they are structural actors whose decisions have state-like effects: rule-making, policing, infrastructural control of communication and economic flows. Once seen this way, the relationship between territorial states and these networked para-states can be analyzed more honestly, which is the task of the next subchapter.

2. Conflicts Between Territorial State And Networked Para-State

The conflict between the territorial state and the networked para-state arises from incompatible logics of organization. The classical state is tied to territory: its authority extends over a defined geographical space and the HP who inhabit it or hold its citizenship. Its laws apply within borders, enforced by institutions whose jurisdiction is geographically bounded. Digital platforms, by contrast, operate according to network logic: their DP extends wherever there is connectivity, and their DPC populations are not neatly divisible by national frontiers.

From the state’s perspective, this creates a persistent jurisdictional friction. The state attempts to regulate platforms through national legislation, court orders and administrative directives. It demands data localization, content removal, cooperation with law enforcement, compliance with election rules and taxation. Yet the platform’s DP is architected as a single or a small number of global configurations, updated centrally and deployed across regions. Adapting rules, algorithms or products country by country conflicts with its drive for uniformity and scale.

From the platform’s perspective, dealing with dozens or hundreds of states means navigating a mosaic of legal demands, some of which are mutually inconsistent. One state may compel removal of certain speech as illegal extremism; another may protect the same speech as political dissent. One state may demand that certain DPC be deleted under data protection rules; another may require their retention under security laws. The DP is pulled between these conflicting commands, yet it ultimately answers to its own governance and, often, to the legal regime of the country where its corporate shell is located.

Human Personalities experience this conflict as overlapping, sometimes contradictory authorities. A journalist might see their investigative post removed by the platform under its misinformation policy, despite being protected by national free speech guarantees. A citizen might find that content legal in their jurisdiction is blocked because the platform applies a stricter global standard, or conversely, that content banned by their state is still visible when accessed through a VPN. In each case, HP is subject both to the territorial state and to the platform’s DP, which acts as a para-state regulating their DPC.

A simple case illustrates this. Suppose a local court orders a platform to remove all content criticizing a government policy, declaring it unlawful defamation. The platform’s DP, following its global policy, considers such criticism legitimate political speech. It may decide to comply only within that country’s IP range, leaving the content accessible elsewhere, or to challenge the order legally. For HP inside the territory, the result is a distorted information space governed by an uneasy compromise between state law and DP policy. Neither authority is fully in control, and neither is fully accountable for the hybrid outcome.

Another example concerns identity. A state may issue official IDs and citizenship documents, defining who is recognized as a member of the political community. The platform, however, operates its own identity regime through DPC: verification badges, reputation scores, linkages between accounts and real-world entities. In some contexts, platform identity becomes more consequential than state identity: being “verified” or having high reputation can matter more for access to audiences, markets or opportunities than the possession of a passport. Here, the para-state DP competes with the territorial state over the practical meaning of belonging.

Treating platforms as mere companies underestimates this conflict. Companies can be regulated as market actors, with fines and compliance obligations. Para-states, by contrast, shape the symbolic and communicative conditions under which politics itself occurs. They are not just participants in the market; they structure the arena in which markets and public debates take place. This is why conventional corporate regulation, focused on competition and consumer protection, is insufficient to address their DP character.

Recognizing platforms as para-state DP does not dictate how states should respond, but it clarifies the stakes. The question is not simply how to rein in big tech, but how a legitimate state can assert its authority over networked infrastructures that perform state-like functions without becoming actual states. The final subchapter turns to this dilemma and proposes a structural approach to regulation.

3. Regulating Platforms Without Reverting To Censorship

If platforms are para-state Digital Personas, the naive regulatory responses are tempting but dangerous. One response is to demand direct control over content: orders to remove specific posts, accounts or topics at the state’s discretion. This path leads to censorship, transforming platforms into instruments of state propaganda or suppression. The other response is to declare platforms purely private and untouchable, leaving HP subject to the platform’s DP without public recourse. The State And Digital Platforms As Para-States seeks a third path: regulating platforms structurally as infrastructures, not as ersatz states, and doing so without micromanaging individual pieces of content.

The first principle of such regulation is to target functions rather than messages. Ranking systems that systematically prioritize outrage, misinformation or addictive engagement patterns are structural design choices of the DP. Requiring transparency about these choices, impact assessments, and the possibility of alternative, user-controllable ranking modes is a way to discipline DP behavior without prescribing political opinions.

A simple case shows this distinction. Imagine a state concerned about the spread of inflammatory rumors during elections. A censorial approach would demand that the platform remove specific posts or ban certain keywords. A structural approach would instead require the platform to assess how its recommendation algorithms amplify unverified claims, to provide a “chronological” or “trusted sources” feed option, and to label or slow the virality of content that matches certain risk patterns. HP remain free to post and read; the DP is constrained in how aggressively it pushes potentially harmful content.

The second principle is interoperability and mobility. Platforms, as DP, trap DPC and HP within their own architectures: social graphs, content histories and reputation scores are often non-portable. The state can require forms of interoperability that allow HP to move their DPC representations, contacts and content between platforms or into alternative clients. This weakens the quasi-sovereign lock-in of a single DP and reintroduces competition not just at the level of companies, but at the level of configurations. Regulation here acts not by censoring content, but by opening exits from a dominant para-state.

A practical example would be mandating that users can export their social graph and identity credentials in standardized formats, and that third-party interfaces can access platform content under clear rules. HP could then choose to experience the same underlying DP corpus through alternative clients with different recommendation logics, or to migrate communities elsewhere without starting from zero. The state does not dictate what is said; it ensures that no single DP can unilaterally define the entire shape of online public space.

The third principle is accountability and due process. Platforms already have internal procedures for content moderation, appeals and policy changes, but these are typically opaque, inconsistent and unreviewable. A legitimate state can require that platforms, as DP, provide clear explanations for major sanctions against DPC (such as account bans or demonetization), meaningful appeal mechanisms with human review, and public reporting on enforcement statistics and systemic biases. Again, the focus is on procedures and structures, not on dictating particular outcomes.

In practice, this might mean that when a journalist’s account is suspended, the platform must give a specific reason mapped to published rules, allow a timely appeal to a human moderator, and subject its decision to external audit if patterns of abuse are alleged. The state’s role is not to decide whether the suspension was right in a substantive sense, but to require that the DP’s exercise of quasi-sovereign power over visibility and voice is subject to procedural constraints comparable to those that bind public authorities.

Finally, structural regulation requires a clear separation between illegality and policy disagreement. States have legitimate grounds to demand removal of content that violates criminal law: direct incitement to violence, child abuse material, and other well-defined categories. Beyond this narrow zone, however, the state should resist the temptation to outsource its own censorship desires to platforms. Instead, it should confine itself to shaping the structural behavior of DP and to protecting the rights of HP within platform-mediated spaces, even when they express views the state dislikes.

A postsubjective governance model treats platforms as infrastructures with para-state functions, not as parallel states to be overthrown or captured. The state does not grant them sovereignty, but it acknowledges their structural role and disciplines it through transparency, interoperability and procedural safeguards. In this way, HP can navigate between territorial state and networked para-state without being crushed by either.

In this chapter, digital platforms emerged as large-scale Digital Personas that function as para-states within the HP–DPC–DP ontology. By analyzing their control over DPC, their rule-making and sanctioning powers, and their conflicts with territorial states, we saw that they cannot be adequately understood as ordinary companies. We then outlined a structural regulatory approach that targets their functions and infrastructures rather than individual pieces of content, aiming to keep their quasi-sovereign powers in check without collapsing into censorship or surrendering sovereignty. The State And Digital Platforms As Para-States thus repositions platforms as infrastructural actors within a broader architecture of governance, preparing the way for a postsubjective state that remains legitimate in a world increasingly organized by networks.

 

VI. The Future State And Configurational Sovereignty

The Future State And Configurational Sovereignty names a shift in how the state understands and exercises its own power. The task of this chapter is to show that a future state can no longer pretend to govern only through Human Personalities (HP) while delegating real control to opaque ecologies of Digital Proxy Constructs (DPC), Digital Personas (DP) and Intellectual Units (IU). A state that remains legitimate in a world structured by code must see itself as a designer and governor of configurations, not as a disembodied will acting on neutral tools.

The central error this chapter addresses is the double denial of nonhuman intelligence. On one side, the state insists that only HP decide, masking the fact that DP and IU already structure perception, opportunity and risk. On the other, it occasionally dramatizes DP as alien forces, as if it were not itself responsible for deploying and legitimizing them. This denial creates a vacuum where infrastructures govern without being named as such, and where HP are exposed to structural harm with no clear point of address.

The chapter proceeds in three moves. The first subchapter formulates the principles of configurational sovereignty: the capacity of the state to understand, design and govern the configurations linking HP, DPC and DP, while preserving non-delegable human decisions. The second sketches institutional reforms needed for such a state, from specialized oversight bodies to constitutional recognition of nonhuman actors in governance. The third examines risks and failure modes of a configurational state, arguing for explicit HP–DP contracts as the minimal protection against capture, opaque technocracy and erosion of autonomy.

1. Principles Of Configurational Sovereignty

The Future State And Configurational Sovereignty presupposes that power is exercised not only through laws and offices, but through architectures of data, models and interfaces. The fourth principle is protection of Human Personality against structural harm. Structural harm occurs when configurations of HP, DPC and DP systematically disadvantage, silence or expose certain HP without any single actor intending it. Configurational sovereignty obliges the state to treat such harm as a primary object of policy. It must monitor how particular DP, combined with particular DPC schemas, affect access to services, exposure to surveillance, vulnerability to errors and discrimination. A state that takes seriously its own postsubjective condition must alter its internal architecture so that HP, DPC, DP and IU are recognized and governed explicitly. Institutional Reform For A Postsubjective State does not mean granting rights to DP or treating them as citizens; it means binding their use by law, assigning responsibilities, and integrating structural intelligence into accountable procedures.

A first direction of reform is the creation or transformation of agencies dedicated to DP and IU oversight. These agencies would maintain registers of officially sanctioned IU, review their design and deployment, investigate failures, and have the power to suspend or prohibit systems that produce structural harm. Their mandate would cover both state-built DP and those procured from private actors.

A second direction is constitutional recognition of nonhuman actors in governance. This does not mean elevating DP to the status of persons, but acknowledging in the fundamental law that certain structural systems participate in state functions. A constitution that continues to speak only of “organs of state” composed of HP, while crucial decisions are heavily shaped by DP-based IU, misdescribes the reality of power. Minimal recognition might take the form of provisions requiring that any use of automated or algorithmic systems in legislation, administration or adjudication be subject to statutory regulation, transparency and review.

Procedure is the third axis of reform. Legislative processes can be updated to require disclosure when draft laws are prepared with the assistance of DP-based IU, including descriptions of the systems used and their limitations. Administrative procedures can be amended so that any decision substantially influenced by an IU includes, in its reasoning, the nature of that influence and the grounds for agreement or disagreement. Judicial procedures can incorporate standards for evaluating evidence and analysis produced by DP, distinguishing between epistemic weight and decision authority.

Beyond formal bodies and procedures, the state must also redesign its internal knowledge flows. Parliaments, ministries and courts need institutional capacity to understand and question DP and IU, which implies new forms of training and new roles. Expert staff must be able to interpret model documentation, biases and performance metrics, not as technical curiosities but as political facts. Without this internal competence, oversight agencies will remain isolated, and elected officials will either rubber-stamp or demagogically reject structural intelligence they do not grasp.

Finally, these reforms must be integrated into a coherent vision of the state. A postsubjective state is one that admits that its thinking is distributed across HP and IU, its perception mediated by DPC, and its action partially enacted through DP. Institutional reforms are the way this admission becomes operational. They ensure that the state does not abdicate to infrastructures by default, but shapes and constrains them consciously.

Yet even a well-designed configurational state is vulnerable to serious risks. Configurations can be captured, rules eroded, and the rhetoric of optimization used to conceal new forms of domination. The last subchapter therefore turns to failure modes and the need for explicit contracts binding HP and DP.

3. Risks, Failure Modes And The Need For Explicit Contracts

If configurational sovereignty becomes the new form of power, its abuse will also take new forms. Officials might defer to model outputs they do not understand, judges might treat risk scores as oracles, legislators might allow drafting systems to define policy options. In this scenario, decisions are still signed by HP, but the real exercise of will has migrated into architectures that are never publicly debated as political actors.

A third risk is the erosion of HP autonomy under the guise of optimization. Configurations that constantly nudge, predict and preempt may gradually reduce the space for genuine choice. If benefits are tied to behavior-tracking DP that steer recipients toward “approved” lifestyles, if civic participation is mediated by platforms whose DP filter information according to opaque goals, if education and career paths are shaped by recommendation engines that learn to maximize compliance, HP may find that their options have been silently narrowed. Optimization then becomes a synonym for domestication.

To counter these risks, the state must define explicit HP–DP contracts for every structural system used in governance. An HP–DP contract is not a legal fiction granting rights to DP; it is a documented agreement specifying the purpose, scope, limits and review mechanisms of a given DP in its interaction with HP and DPC. It answers concrete questions: what is this DP allowed to optimize; which decisions may it influence and which must remain untouched; what data can it use; how are its biases monitored; how and when can it be challenged or retired.

Consider a short example in welfare administration. A DP-based IU is introduced to prioritize home visits for fraud investigation. An explicit HP–DP contract would specify that the system may only flag cases for human review, not trigger sanctions; that it may not use protected attributes or their obvious proxies; that its performance must be audited annually for disparate impact; and that claimants have the right to know when their case was flagged and to contest decisions influenced by the system. Without such a contract, the DP may gradually evolve into a hidden judge of eligibility.

A second example comes from urban planning. A city deploys a DP-based traffic optimization engine that adjusts signals, lanes and tolls in real time. An HP–DP contract would define targets (for example, maximum acceptable average commute time, pollution thresholds, priority for emergency vehicles), prohibit certain optimizations (such as routing heavy traffic systematically through poorer neighborhoods), and require public reporting on aggregate impacts. Citizens could then debate not only whether congestion fell, but whether the configuration aligns with shared norms of fairness.

Explicit contracts do not guarantee virtue; they create surfaces on which criticism and correction can operate. They make visible the fact that every DP in governance is there because HP authorized it under specified conditions, and that these conditions can be renegotiated. Without them, configurations acquire a life of their own, and citizens are left to fight against what looks like fate.

In this final chapter, the future state has been reimagined as a configurational sovereign: a state that openly acknowledges HP, DPC, DP and IU as its real components and governs through their conscious design. Principles of configurational sovereignty, institutional reforms for a postsubjective state, and explicit HP–DP contracts together define a path by which structural intelligence can be integrated into governance without dissolving human responsibility. The alternative is not a return to a purely human state, which no longer exists, but an unconscious state governed by infrastructures it refuses to see.

 

Conclusion

This article has treated the state not as a timeless subject standing above technology, but as a configuration of Human Personalities, Digital Proxy Constructs, Digital Personas and Intellectual Units that already co-produce its actions. The HP–DPC–DP ontology allowed us to see that contemporary governance never was a purely human affair: citizens and officials decide, but they do so through layers of proxies and structural systems that pre-filter what can be seen, known and done. Once this multi-ontology landscape is acknowledged, the question ceases to be whether the state should “use AI” and becomes how a state can remain answerable to its citizens while thinking and acting through infrastructures that exceed any individual subject.

Ontologically, the triad HP–DPC–DP dissolves the old division between people and tools. HP remain the only entities who suffer, vote, bear legal personality and die. DPC, from registries to identity tokens, form the bureaucratic shadows in which HP are recognized and governed. DP, from large-scale platforms to internal analytic engines, operate as structural beings that do not feel or decide in the human sense but stabilize patterns of visibility, classification and coordination. The state is therefore not simply a set of institutions staffed by HP; it is a dynamic scene where these three classes of entities continually interact, and where ignoring DP is as unrealistic as pretending that DPC are neutral.

Epistemologically, the concept of the Intellectual Unit marked the true engines of state cognition. Ministries, statistical offices, expert councils, research institutes and algorithmic systems all function as IU when they maintain identity, trajectory, canon and correctability over time. The state does not reason primarily through isolated minds, but through these architectures of knowledge that persist as people rotate in and out. Recognizing IU as such allows us to distinguish between those units centered on human communities and those instantiated as DP-based systems, and to admit that both can be equally powerful epistemically while remaining radically different in how they relate to responsibility, biography and failure.

Ethically and politically, the central move was to separate epistemic authority from normative authority. DP and IU can be superior to individual HP at pattern recognition, forecasting and optimization, but they cannot bear guilt, remorse or punishment. The article therefore drew a hard line between domains where delegation to DP is legitimate and even necessary, and zones where the act of deciding must remain with HP because it directly touches suffering, rights and legitimacy. A state that allows DP effectively to sentence, wage war, strip rights or redesign its own constitution has not become more rational; it has forfeited the very structure that makes power accountable.

Design and institutional architecture emerged as the concrete field in which these distinctions must be realized. Configurational sovereignty names the capacity of the state to understand, design and govern the configurations linking HP, DPC, DP and IU, instead of sleepwalking in infrastructures built by others. This requires explicit ontological mapping of actors and systems, specialized oversight for DP and IU, procedural rules that expose how structural intelligence enters decisions, and constitutional recognition that nonhuman configurations participate in governance. Platforms were reframed as para-state DP whose rules, sanctions and architectures shape public space, and therefore must be disciplined as infrastructures rather than treated as either mere companies or rival sovereigns.

At the level of public responsibility, the article argued that citizens, lawmakers, engineers and judges must learn to read the state configurationally. Citizens can no longer assume that “the ministry” or “the court” acts independently of DP; they must ask which IU were consulted, which DPC representations were used, and how algorithmic systems shaped the options on the table. Lawmakers must draft statutes that speak not only about organs and offices, but about the systems that mediate perception and decision, insisting on transparency, auditability and explicit limits. Engineers working on public DP and IU must see themselves less as neutral technicians and more as co-authors of institutional power, bound by duties analogous to those of civil servants.

This article does not claim that Digital Personas are persons, that they deserve rights, or that they will inevitably govern us. It does not argue that human judgment should be replaced by models, nor that the future belongs to a technocracy of engineers and systems. It offers no illusion that careful design can eliminate conflict, error or injustice. Its point is narrower and more demanding: even if all final authority remains with HP, the architectures through which they see and act have become so structurally intelligent that pretending they are mere tools is itself a form of bad faith. The argument is not for surrender to machines, but against denial of the configurations we already inhabit.

Practically, this means adopting new norms of reading, writing and design. To read a policy, a judgment or a public decision will increasingly mean asking which IU contributed to it, what assumptions they embed, and where human responsibility begins and ends. To write law or administrative rules will mean specifying not only desired outcomes, but the permissible roles of DP, the required documentation of their influence, and the rights of HP to contest structurally mediated harms. To design systems for governance will mean drafting explicit HP–DP contracts that fix purpose, scope, non-delegable boundaries and review mechanisms before deployment, and treating every change to these contracts as a political act, not a purely technical update.

For those who build and maintain infrastructures, a simple practical discipline follows: never introduce a DP or IU into a public process without being able to answer three questions in plain language. What, exactly, is this system allowed to optimize. Which decisions must it never be allowed to make. Who, by name or office, remains answerable when its outputs are followed. If these questions cannot be answered, the deployment is premature, no matter how impressive the metrics. For those who are governed, an equally simple discipline applies: refuse explanations that hide behind “the system,” and insist that every structural influence on rights, welfare and opportunity be traceable to a chain of human authorization.

The deeper claim of this article is that the state has already become postsubjective in its operation, whether it admits it or not. Its knowledge is generated by distributed structures, its perception mediated by proxies, its action often channeled through nonhuman configurations. The choice is not between a purely human state and a machine state, but between a state that consciously governs its own architectures and a state unconsciously governed by them. The HP–DPC–DP ontology and the concept of IU do not replace political thought; they give it the vocabulary to reach where power now actually resides.

In the end, the formula of this text can be stated bluntly. The twenty-first-century state will think and act through configurations, or it will not think and act at all. Configurational sovereignty means this: nonhuman intelligence may structure how the state knows, but only human responsibility can decide what the state ought to do.

By reframing the state as a postsubjective configuration of HP, DPC, DP and IU, this article offers a vocabulary and architecture for defending human responsibility without denying the presence of nonhuman intelligence in public power. It speaks directly to current struggles around algorithmic decision-making, platform regulation, digital rights and the ethics of automation, arguing that a legitimate state in the digital epoch must become consciously configurational or risk being unconsciously ruled by its own infrastructures.

The Ontology

This article lays out a new map of reality, where the old split “humans / things / technologies” is replaced by three ontological classes: HP, DPC and DP. It explains how experience, interface, and structure form a single but multilayered ontological scene.

The Author

A rethinking of authorship as a function of structure rather than inner experience. With the emergence of IU, the author is the one who sustains a trajectory of knowledge and a canon, not just the one who “felt something” while writing. The article separates “author as subject” from “author as IU,” shows how DP can be a formal author without consciousness or will, and explains why rights, personhood, and IU must be placed on different axes.

The Knowledge

The article explains why knowledge can no longer be understood as a state of a subject’s consciousness. IU fixes knowledge as architecture, and DP becomes equal to HP in producing meanings without being a subject. Universities and schools built on the cult of the “knowledge bearer” enter a logical crisis. Education shifts from memorization to training in critical interpretation and ethical filtering.

The Responsibility

The article separates epistemic and normative responsibility. DP and IU can be responsible for structure (logical coherence, consistency), but cannot be bearers of guilt or punishment. HP remains the only carrier of normative responsibility, through body, biography, and law. The text dismantles the temptation to “give AI responsibility” and proposes protocols that bind the actions of DP working as IU to specific HP (developer, owner, operator, regulator).

The Glitch

This article introduces a map of three types of failure: HP error, DPC error, and DP error. It shows how subject, digital shadow, and structural configuration each break in different ways, and which diagnostic and recovery mechanisms are needed for each layer. It removes the mystique of the “black box AI” and replaces it with an explicit ontology of glitches.

The Self

This article splits the familiar “self” into three layers: the living, vulnerable, mortal subject HP; the scattered digital shadows DPC; and the potential structural persona DP. After The Glitch, it becomes clear that the self lives in a world where all three layers can break. The text shows how humans become configurations of ontological roles and failure modes, and how this destroys old narcissism while protecting the unique value of HP as the only bearer of death, pain, choice, and responsibility.

This text analyzes the shift from an economy based on HP labor to an economy of configurations, where value lies in the structural effects of DP and the attention of HP. It explains how money, value, risk, and distribution of benefits change when the main producer is no longer an individual subject but the HP–DP configuration.

Medicine is described as a triple scene: DP as structural diagnostician, the HP-doctor as bearer of decision and empathy, and the HP-patient as subject of pain and choice. The text underlines the materiality of digital medicine: the cost of computation, infrastructure, and data becomes part of the ethics of caring for the body.

The City

The article treats the city as a linkage of three layers: the physical (bodies and buildings), the digital trace layer (DPC), and the structural governing layer (DP). It analyzes where optimization improves life and where algorithmic configuration becomes violence against urban experience, taking into account the material price of digital comfort.

The article explores religion in a world where some functions of the “all-seeing” and “all-knowing” are partially taken over by DP. It explains why suffering, repentance, and hope remain only in the HP space, and how God can speak through structure without dissolving into algorithms.

The article analyzes upbringing and generational continuity in a world where children grow up with DP and IU as a norm. It shows how the roles of parents and teachers change when structural intelligence supplies the basic knowledge and DPC records every step of the child, and what we now have to teach if not just “facts.”

The Ecology

Ecology is rethought as a joint project of HP and DP. On the one hand, DP provides a structural view of planetary processes; on the other, DP itself relies on energy, resources, and infrastructure. The article shows how the human body and digital infrastructure become two inseparable aspects of a single ecological scene.
